Intended Use 難以核准專利?

Intended Use

審查委員在判斷一份專利範圍的是否符合法定標準時,通常是先確認發明為何,權利範圍為何,包括從說明書各部份瞭解整篇專利的重心,接著去解讀專利範圍

在判斷專利範圍是否具有專利性之前,解讀專利範圍主要是透過分析來確認專利範圍的邊界(boundary),就方法步驟而言,權利範圍的限制則用來定義出各步驟(steps)或是動作(acts);就物品而言,權利範圍定義出結構或是材料的特徵。

就權利範圍的描述來看,所有描述都是一種限制,但是描述語言本身也會產生不少模糊地帶,就MPEP 2106內容,其列舉幾種會產生限制權利範圍的問題的內容:
  1. intended use or field of use,也就是描述於權利範圍中的「用途」,此類描述並不會對範圍有所影響,列舉一例,此例中,審查委員以「intended use」核駁描述於主要範圍與附屬範圍中的內容不具專利性(進步性),也就是審查委員認為寫出用途,對技術而言,並無影響,比如:將「一般的電路」應用於一個特別的用途中,被認為是相同的電路會執行相同的功能,「用途」在這裡並無意義;
  2. "adapted to"或"adapted for",也就是應用的對象,此類描述也是說明該發明的用途,對解釋申請專利範圍仍無用處;
  3. "wherein",也就是進一步的限制,常是對特定元件作進一步解釋,此點本應是被考慮進去的,但在一些情況下仍然對解釋專利範圍沒有助益;
  4. "whereby",此類語句是功能性描述,通常在各元件描述之後,表達整個權利範圍的功效,此類語句可能不會被解釋進權利範圍中!

以上幾種描述語句可能產生解釋專利範圍的問題,然而,在判例Hoffer v. Microsoft Corp.中,法院認定,"whereby"用語所描述的條件是有形的(material),則可影響該項專利性,不能被忽略,然而,若是用於方法專利中,"whereby"若只表示出功效,則不會對權利範圍有影響(no weight)。

以下為Hoffer案的權利範圍的一部分!


在侵權判斷時,原告自然是希望範圍愈廣愈好,所以Hoffer表達"whereby"僅是表達功效,而沒有實質權利限制(no weight),但是法院則認為,只要"whereby"內有關專利性的內容,仍不能忽略!此處內容,法院認為已經超過僅有功能性的描述而已,而屬於權利範圍的一部分!

About Claims XXVII

這只是一個小提醒!雖然不是每個審查委員都這樣想,但是還是最好符合一下要求!


就是審查委員要求在Claim中的縮寫在第一次出現時應該要寫出全名,比如I2C第一次出現時,應該寫出I2C(Inter-Integrated circuit)、UART要寫成UART(Universal Asynchronous Receiver/Transmitter)...等!

事實上,是否連CPU, RAM都要寫出來,應該還不至於,但是有時會有審查委員要求就是了
至少台灣在審查基準還有規定:
說明書應用中文記載(專施3.II);惟在不會產生混淆的情況下,對於該發明所屬技術領域中具有通常知識者所熟知之特殊技術名詞,如CPU、PVC、Fe、RC結構等,得使用中文以外之技術用語

菜瓜布




家裡買了個菜瓜布,看似普通,但是其中特別就是在菜瓜布還跟著一個圓錐形的吸盤一起賣,菜瓜布中間洞,可以用完後,直接套上那個圓錐形的吸盤,非常方便,除了可以固定位置外,也不會因為隨便擱置造成髒亂。

就想找找相關專利,簡單使用「菜瓜布」、「孔」、「洞」、「廚房」、「清潔」這些關鍵字交叉搜尋,找到中華民國新型專利第M284349號,雖然實施例有些不同,圖示是用鉤子,而且「穿孔」比較靠近邊緣,但是特徵應該是一致的!


專利範圍:
1.一種可懸掛滴水泡棉菜瓜布之結構,包括有一菜瓜布結構體,其特徵為:於該菜瓜布結構體靠近任一周邊適位設一可懸掛用之穿孔。

2009瀏覽器大戰

瀏覽器大戰

每年年終,總會有些一年來的統計或是重大事件的公佈
Linux世界也是,透過一些回顧,可以整理一下大致世界是怎麼走的

Linux Magazine提到2009產生了「瀏覽器大戰」,IE從一開始利用作業系統的優勢一下子佔據整個瀏覽器世界,到現在成為主流,當然,也成為各家瀏覽器的最大假想敵

Linux Magazine認為IE是2009最大輸家,主要是Firefox與Chrome侵蝕了不少IE的佔有率,尤其是IE在歐洲再也不是一定是預設的瀏覽器,讓使用者可以自己選擇,這絕對是流失佔有率的第一原因,再來就是「技術性」比對,IE的效能不見得比其他好,反而有相容性的問題


Linux Magazine認為Chrome是最大贏家,經過2008年的醞釀,2009則有小爆發,加上開始釋出Linux與Mac版,佔有率自然增加,而且有未來話題--Chromium OS


Linux Magazine認為Firefox有輸有贏,在Firefox成為威脅IE的要角,但因為沒有作業系統加持,同時也被Chrome所威脅,未來有很大挑戰,但是Firefox的外掛與社群支持卻又是一個可以持續進展的動力


其他小家,我則給予最大敬意,也有使用,比如Opera, Safari等

未來,或許因為雲端化,作業系統再也不是一定是微軟獨霸,而可以選擇其他的平台,IE也更是岌岌可危。

EU專利邁向實質統一

歐洲議會(EU Council)同意下一步就是歐洲聯合專利(EU Patent)

經2009年9月4日歐洲各國簽訂里斯本公約(Lisbon Treaty)後,歐盟產生第一任主席,也就表示歐洲逐漸邁向統一之路更明朗!專利也不例外,所謂歐洲聯合專利(EU Patent)也隨之慢慢加溫!

現行的歐體專利其實已經有這種聯合專利的精神,包括EPO與各國之間建立的審查高速公路,就是以歐洲整體為一個對象,而經EPO專利局申請、審查,已經能夠直接指定登錄國家,現在要討論的則更進一步是統一的專利訴訟體系(unified patent litigation system)與相關體系的法院系統,如European and Community Patent's Court (ECPC)。當然有關歐洲聯合專利的語文、相關費用,比如年費、訴訟與各國利益分配的問題則是有待解決,而相關專利的議題包括有:專利權效力、授權、與專利權的消失、訴願程序、應該有一致性,目前至少共識是有的!

漂浮屋


聖經中的方舟, the ark, 是個拯救人類的大船,在很多人看來是個神話,但確實有很多古老民族的古老神話有類似的故事,似乎當時確實是個全球性的洪水。電影中也有一些相關搞笑或是正經八百的內容!比如2012
面對未來,如果全球氣溫繼續上升,確實某天會需要「大船」,大船絕對是比飛機更好的救難選擇!

與海爭地的荷蘭面對全球氣候變遷確實是最積極的國家之一,有30%的土地是在海平面以下,現在國土政策改變從「填海」成為「可以漂浮的房子」。

快速審查綠色申請案

美國商業部(Commerce Department)在哥本哈根舉行氣候變遷會議前提出針對綠色科技專利申請案的加速審查領航計畫(pilot program)

主要是為了提昇並鼓勵「綠色」相關技術的研發,使得能夠較早掌握市場

一般專利申請案如果沒有提出任何加速審查的方案,通常都是依序進入審查,審查的快慢也會跟技術領域有關,而相關「綠色」科技則是平均30個月(2年半)得到第一次官方意見(first office action),而40個月得到最終意見(final office action),這顯然是比一般案件更久,所以加速此類技術應該是必要的

在此領航計畫中,前3000相關「綠色」申請案,若提出請願書(petition),將可進入加速審查的程序,這就與一般USPTO所提供的加速審查請求(Accelerated Examination Request)不同,可參考http://enpan.blogspot.com/2009/09/blog-post_10.html,此類加速審查通常要提出Examination Support Document,使能產生超短的審查時間!

小實體申請案加速方案

即日起至2010年2月28日,USPTO提出一個加速小實體(small entity)申請案審理的暫時計畫
特別是針對兩件2009年10月1日前提出申請,且其中具有共同擁有人或是共同發明人的小實體申請案,若是其中有一件已明確認定拋棄,而另一件則會被提早審理。

此計畫有幾個要件:
1) 申請案為非臨時申請案(nonprovisional application),且申請日早於2009年10月1日
2) 相關申請人有另一件早於10.1.2009的審理中的非臨時申請案,且此案是已符合相關申請規定(37 CFR 1.53)的申請案
3) 申請案與另一件審理中的案子有共同的擁有者或是至少一位共同發明人
4) 申請人應於該案進入審查前提出明確放棄的聲明(不得回復),且也不會再提出放棄的權利的申請,並同意不退費
5) 應提出請願(petition under 37 CFR 1.102)聲明放棄(應於2/28/2010以前提出)

這算是很奇怪的方式,似乎在鼓勵減少個人發明!但或許只是要減輕一些審查員的負擔

IP5


由EPO, JPO, KIPO, SIPO, USPTO組成的IP5公佈網站:http://www.fiveipoffices.org/

IP5形成的願景是消除不必要的重複審查工作,並能改善效率與品質,使得專利權在各國間有一致性,有穩定的權利
"The elimination of unnecessary duplication of work among the offices, enhancement of patent examination efficiency and quality, and guarantee of the stability of patent right".

目前這五個專利局的申請量可參考下圖
可見各專利局都有很沈重的負擔,但相較於台灣用增加人力或是參考他國審查意見的方式消化審查負擔,這些專利局在國際上確實有優勢,而且是利用現有的PCT作為IP5的合作平台,而不必另闢方式,這實在是個很有效率的方法

The Heads of the IP5 Offices have reiterated that the PCT is an international framework for work-sharing and recognise that the PCT plays a significant role in work-sharing. Its use as a work-sharing platform should be enhanced by the five offices.
The Heads of the IP5 Offices have agreed to work with WIPO towards improving the well-functioning of the PCT system.

但要在此平台下合作,仍有一些前提,比如在國際審查時,對於專利性的意見要準時提出;各局在做出核准意見需有一致性。在這個競合的關係下,各國審查制度與審查委員的素質一定要提升到國際水準,同時因為各專利局原來都有不同的運作方式,審查程序,甚至有不同的技術分類,都需要有些妥協!但相信發明人都樂於見到這些改變

遲來的正義(間歇式雨刷)


專利也有遲來的正義
原因就是專利訴訟也可以搞很久

車用的雨刷是個很久的發明
雨刷就在擋風玻璃上刷來刷去,算是簡單的機構

一位大學教授Roberts Kearns則發明一種間歇式雨刷(Intermittent Windshield Wiper),專利則如下圖:
最早1967年的專利US 3,351,836

之後有不少後續相關專利,比如:

這種雨刷是將原本一直規律動作的雨刷改成刷一兩次就停一段時間,讓駕駛者能夠有一段可以清楚看出窗的時間,這也是一種體貼的創新!

這位先生,先自己拿去賣,後來福特與克萊斯勒也來賣,結果Robert Kearns在1982年提出告訴,到2005年才有結果,判這兩家車廠賠幾百萬美元!但是,判決之前不久,Robert Kearns才剛因癌症過世!

TIPO has updated the fee schedule on Dec. 8 2009, especially the fee on the limited claims.
專利規費收費準則
The new fee schedule will be taken in effect on Jan. 1 2010.

Currently and in the past, the number of claims in a single Taiwan patent application are not limited in a fixed official fee. Applicants would submit unduly over-claiming claims into TIPO. Those claims usually bring torments from overloading examinations to the examiners. This situation may level down the examination quality, and bring public's denouncing.

Probably it is a good news, a basic examination fee (NT$7000) is charged by TIPO on 10 claims, and every exceeding claim charges NT$800 when the filing date of a new patent application is after Jan. 1 2010.

However, in my opinion, 10 claims would be much less but fairly only NT$800 may charge the each exceeding claim, and no limits on the number of independent claims. Actually it is similar with current China's way.

Other good news is the cost reduction of patent application to annual fee for the 7th to 9th patent years by NT$1000, and NT$2000 cost down for the patent year after/on 10 years. The utility model and design patents also have cost reduction.

(一)發明專利申請案應依申請專利範圍之請求項數逐項收費部分:
修正實體審查申請費之規費收取方式,將申請專利範圍之基本請求項數設定為10項,請求項數於10項以內者均收取基本費新臺幣(以下同)7,000元,超出前述10項之基本項數者,每項收取800元。
(二)專利年費部分:
1、發明部分,第7年至第9年每年減收1,000元;第10年以上每年減收2,000元。
2、新型部分,第4年至第9年每年減收1,000元,第10年以上參照第7年之金額,減收新臺幣10,000元。
3、新式樣部分,第4年至第6年每年減收1,500元,第7年以上每年減收4,000元,第10年以上參照第7年之金額,減收新臺幣13,000元。

一個基礎聚合物專利

一個基礎聚合物專利(US2,071,250)

「聚合物」可簡單稱為「塑膠」,由很多小單位的共價連結形成的結構
一個稱為「Polymer Online」的文件揭露了作為天然、合成聚合物的技術資料,包括相關專利:


這裡介紹一個基礎的聚合物專利 US2,071,250,Linear Condensation Polymer,是用來生產塑料、橡膠與纖維的基本反應,顯然這個專利(與相關技術)造成了一個工業的發展


所謂condensation polymer就是以上圖所示的例子的連續重複鍊結的結構,每一條結構形成聚合物的基本單元!該案更列舉更多的範例

但要形成有用的產品,則需要裝置製造這類的結構,就像是上圖顯示的裝置,其中標號1為一圓形玻璃容器,有個阻隔器6設於瓶頸3上,其中有冷凝的部份(4,5),有加熱的部份(8),原料就置放於標號7的碟盤上。經過適當的壓力與加熱、冷凝的程序,形成有柔軟度的聚合物纖維

日本PPH


日本PPH

2010/1/29起,用以加速審理的PPH(專利審查高速公路)結果將可作為日本與歐洲專利的審判基礎,目前已有日本-加拿大的PPH計畫適用,因此,原本相關由PCT審理局做出的國際檢索報告(International Search Report)也將會作為日本與美國間的審判基礎

會議結果:
(1) 啟動新的JPO-EPO PPH領航計畫
當由其中之一個專利局做出「核准」決定,另一個專利局則會據以加速審查。此新的PPH計畫將是日本第12個PPH合作協議
(2) PPH擴大應用,如三邊PPH計畫

經之前試行後,將於January 29, 2010啟動三邊PPH的計畫,其中將基於PCT受理局(ISA)或是經過國際初步審理國(IPEA)所作出的核准決定,作為PPH加速審理的基礎

專利與產品:環保提袋

專利常常是閒置在那裡而未實施,或是有其他用途
難得看到就在手邊的好發明,與相對的專利
看到有國外代理人出版整年的年曆,每天記載一件同天核准(公告)且有代表性的專利
自己就想說可以朝這方面努力,每天記載一篇好專利,但是的確是個不可能的任務!

申請專利範圍中的前言部份(preamble)是否具有限制權利範圍的效力?
就審查而言,經驗是,美國審查委員幾乎都是跳過前言中所描述的內容或是元件,而直接針對權利範圍主體中各元件來進行比對!但對侵權鑑定而言,嚴格來說,所有描述於權利範圍中的文字皆會被作為列為限制條件,包括前言部份!

根據MPEP2111.02所描述,前言是否為限制權利範圍的條件是依據個案情況(case-by-case)而定,並沒有一定的檢驗方式,看來,是個案看審查委員或是法官的認定!

MPEP 2111.02 EFFECT of Effect of Preamble

The determination of whether a preamble limits a claim is made on a case-by-case basis in light of the facts in each case; there is no litmus test defining when a preamble limits the scope of a claim. Catalina Mktg. Int'l v. Coolsavings.com, Inc., 289 F.3d 801, 808, 62 USPQ2d 1781, 1785 (Fed. Cir. 2002). See id. at 808-10, 62 USPQ2d at 1784-86 for a discussion of guideposts that have emerged from various decisions exploring the preamble's effect on claim scope, as well as a hypothetical example illustrating these principles.

有以下討論:
權利範圍前言表達整個權利範圍的含意,是否應該讀入權利範圍,就看它是否給予整個範圍生命(give life)、意義(meaning)與活力(vatality),這或許很抽象,但多少應該給了一些建議!

就案例而言,以下引用一個「a method of treating or preventing pernicious anemia in humans by administering a certain vitamin preparation to "a human in need thereof,"」前言描述(有關藉由管理維他命來治療或防止貧血的方法),法院認定此處描述到「人」,且整個範圍就是與人的貧血有關,顯示此處前言給予整個專利範圍「意義」,所以有效力!

另一案例,前言描述「An abrasive article」(研磨物),清楚表達整個專利範圍應有的內容,但法院認為,這段話表達權利範圍為一個研磨物,但其中內容「abrasive grains and a binder」的結合則並非一定是前言所述的研磨物。就此而言,前言部份是要定義出產出物的結構!

"[A] claim preamble has the import that the claim as a whole suggests for it." Bell Communications Research, Inc. v. Vitalink Communications Corp., 55 F.3d 615, 620, 34 USPQ2d 1816, 1820 (Fed. Cir. 1995). "If the claim preamble, when read in the context of the entire claim, recites limitations of the claim, or, if the claim preamble is 'necessary to give life, meaning, and vitality' to the claim, then the claim preamble should be construed as if in the balance of the claim." Pitney Bowes, Inc. v. Hewlett-Packard Co., 182 F.3d 1298, 1305, 51 USPQ2d 1161, 1165-66 (Fed. Cir. 1999).

(A preamble reciting "An abrasive article" was deemed essential to point out the invention defined by claims to an article comprising abrasive grains and a hardened binder and the process of making it. The court stated "it is only by that phrase that it can be known that the subject matter defined by the claims is comprised as an abrasive article. Every union of substances capable inter alia of use as abrasive grains and a binder is not an 'abrasive article.'" Therefore, the preamble served to further define the structure of the article produced.).

小結:就上而言,雖然前言並非一定對權利範圍產生限制,但是應該還是要表達出整個專利範圍的樣貌,應可能作為限制條件!

Google Chromium OS

從去年發表的Google Chrome可看到Google不僅要佔有搜尋引擎,還要佔有瀏覽器,更是為了往後佔有作業系統來鋪路

現在很多東西都是網路化,或說雲端化,從Google, yahoo甚至微軟提供多樣的網路應用軟體,包括手機應用就知道,這是一個檔不住的趨勢!

就Google自己介紹Chromium OS來看,這OS就是一個雲端系統的介面
所有應用程式都在網路上,都是Google App,所有軟體不用安裝,沒有更新的問題,版權問題更是簡化,簡單來說,OS就只是一個網頁瀏覽器,只不過,可能不是我們經常使用的感覺
Chromium OS大概要解決最大的問題就是網路安全!

值得注意的是,他是一個開放原始碼的計畫,所以表示任何人都可依據開放原始碼的規則去改,去散佈,去訂做一個作業系統!

WIPO PatentScope

WIPO發表「進階線上專利資訊服務」

初步有8個專利局(非洲區智慧財產組織、古巴、以色列、韓國、墨西哥、新加坡、南非與越南)加入提供WIPO專利檢索的服務(PATENTSCOPE®),其中有很多在之前並未有數位化的檢索服務,除了技術資訊外,更提供技術領域與法律狀態的檢索

簡單用關鍵字「Uninterruptible Power Supply」測試一下,可以看到豐富的檢索結果
此例顯示在此關鍵字下,PCT有4660件、韓國有488件、以色列有103件...,並包括有IPC分類、申請人(以數量分)、發明人與各年度公開案,自然也可以看到表列出的專利案

ubuntu and a Lazy man

Linux在一般使用上,應該是挺開心的 第一,免費使用 第二,軟體幾乎無限多,而且幾乎都不會有版權的問題,就以Fedora為例,完整安裝有至少三張DVD,夠多吧! 第三,軟體安裝有很多方法,Ubuntu中的軟體安裝程式讓使用者點選,隨時從網路上下載安裝,一氣呵成! 第四,硬體支援甚至比Windows好,我的經驗是,重裝自己的筆電時,用的不是回復光碟,因為不見了,就用一般Windows安裝,最後,遇到很多驅動程式的問題,雖然筆電的網站有提供,但實用之後,有些還不是很正常,有些也沒找到;結果,決定安裝Ubuntu,一切很順利,但也不是沒有缺點,筆電上的Fn鍵就不太支援! 第五,硬體需求比Windows低 第六,我認為介面更好用! 第七,可大可小,可大至作為伺服器,可小至安裝於USB碟中 雖然,更多人是因為「筆電預載Windows」、「不習慣」,「Office相容性」,或是「好像很難」等的問題而不使用Linux,但是其實當中的「藉口」愈來愈小,尤其是現在很多事情都是用網路上的,電腦世界也慢慢會「雲端化」、「網路化」,個人電腦就只是一個操作介面,跟作業系統無關!Linux是一個不錯的選擇 我認為Ubuntu是個懶人、普通人用的作業系統 除了Ubuntu本身的軟體安裝程式,設計上已經可用點的來選擇想要的軟體,然後能夠直接網路下載安裝 更有人為Ubuntu設計了LazyBuntu,說像是「大補帖」,收集了成百上千的好用軟體,用script相互連結,判斷相關性,也是只要用選的,就可以自動安裝!
