Motorola對Apple在德國贏了一個永久禁制令

Motorola在2/3在德國法院贏了Apple，對蘋果的iCloud發出永久禁制令，擴及蘋果的雲端服務與用這雲端服務的裝置

這顯然是個大勝仗，在日漸成熟的智慧型手機領域中，雖然iPhone很強，但在功能上並不見得勝了多少，功能與軟體上差不了太多，甚至硬體規格還比許多Android新的機種都還要差。“雲端服務“此時將成為決戰場之一，如iCloud，雖是舊的概念，但搭配Apple一系列iOS產品，馬上顯示出有雲端服務的優點，至少話題十足！而且，將來配套的應用將會愈來愈多，成為智慧手機不可或缺的一項服務

結果，這項在德國一個法院的判決將影響整個Apple相關的商業佈局，沒有"雲"的智慧手機，恐怕會弱掉不少

此次訴訟是去年四月在德國Mannheim地方法院提出，Motorola引用的專利涉及多個傳呼器（Pager）之間資訊同步的技術，歐洲專利號為EP0847654，可參考下圖，其中有產生改變的第一傳呼器130，無線通訊至基地台110，將可將狀態改變傳給其他傳呼器150，使得其他傳呼器可以據此作改變，因此，就果效來看，使用者對一傳呼器的改變能自動對另一傳呼器進行改變。其中列舉一些狀態改變的項目，如：訊息、鬧鐘時間等，經其中一部傳呼器設定後，將可同步於其他裝置。


主要權例範圍Claim 1涉及一個在傳呼器上傳遞狀態改變的方法，其中包括有無線接收從基地台來的第一訊息，透過傳呼器產生改變，並以無線傳輸方式傳送第二訊息。

1. A method of communicating changes in a status of message information in a pager comprising the steps of:
wirelessly receiving a first message from a base station, the first message having first information for a user of the pager and having a status associated therewith;
changing the status of the first information responsive to an input to the pager; and
wirelessly transmitting a second message having second information indicative of the status of the first information to the base station responsive to the step of changing.

這個專利顯然是揭露兩個傳呼器之間的資料同步問題。就上述範圍來看，確實頗廣，是否傳呼器對應到本案利用手機的同步技術？有待商榷，但就功能而言，或許可稱為ㄧ致，手機利用網路通訊與雲端，與另一設備同步資料，這確實如同iPhone與iPad之間用iCloud的資料同步功能

transmitting by a wireless messaging infrastructure a first message having a first status;
in one transceiver of the plurality of transceivers, changing the first status of the first message to a second status responsive to an input to the one transceiver, and transmitting a second message indicative of the second status;
