本部落格之前已經有針對歐洲口審制度的筆記,但是每次遇到仍是需要再理解一次,雖然沒有什麼新意,但...就習慣要寫下來,這次也問了ChatGPT。

歐洲口審制度(https://www.epo.org/en/applying/european/oral-proceedings)相關法條:

根據Art. 116(1) EPC,可以由任一方請求口審(oral proceedings),或是,較少的情況是EPO根據特定需要而召開口審。大多數的時候是由審查或是異議(opposition)部門召開口審,也有少數是由法律部門召開。

如果EPO決定要舉行口審,各方會收到正式召開口審的通知,並伴隨要討論的議題,也會訂出提交書面資料的日期(可因為嚴重的理由而調整),此日期之後就不會接收新的資料。

根據Art. 116(1),EPO可以根據需要,或是任何一方,都可以請求口審。當覺得有需要,或是要駁回歐洲專利申請案時,Receiving Section(審查部門的Receiving Section)可以召開口審。

不論是審查部門或是法律部門召開的口審程序都是非公開的。

口審結果隨著申請案公開也會公開。

Article 116 Oral proceedings

(1)Oral proceedings shall take place either at the instance of the European Patent Office if it considers this to be expedient or at the request of any party to the proceedings. However, the European Patent Office may reject a request for further oral proceedings before the same department where the parties and the subject of the proceedings are the same. 

(2)Nevertheless, oral proceedings shall take place before the Receiving Section at the request of the applicant only where the Receiving Section considers this to be expedient or where it intends to refuse the European patent application. 

(3)Oral proceedings before the Receiving Section, the Examining Divisions and the Legal Division shall not be public.

3.在檢索意見中提出一或多個反對意見仍適用審查意見。

若是針對分割案(divisional application),第一次OA就是召開口審的條件是:
1.母案被拒絕或是撤銷,而分割案也沒有核准可能;
2.專利範圍與被拒絕的母案一樣或是更廣;
3.對母案的反對意見或是撤銷母案的理由仍適用分割案。

有可能可以拒絕oral proceedings嗎?
我問ChatGPT,結果是與我查的差不多,就是可以,只要不提交任何書面意見,但為了案子好,不建議這樣做。

關於一件具有「多實施例」的設計申請案

本篇筆記是基於USPTO的「設計專利申請指南」(https://www.uspto.gov/patents/basics/apply/design-patent)。

設計創作人在一件設計中,可能會同時提出修改方案,如果修改前後的設計彼此之間具有「專利性區隔(patently distinct)」,不屬於同一個設計概念(single design concept),應以不同設計申請案提出申請。

反之,如果修改前後的外觀仍在同一設計概念下,就可以用一件設計申請案提出申請,如此,一件設計申請案就會包括「多個實施例」,這是符合美國設計專利規定。(根據前篇報導,在其他國家都有不同的程序,在我國是衍生設計:https://enpan.blogspot.com/2017/06/blog-post_30.html)。

所述在一件設計概念下的多個修正方案,英文是「modified forms」,如以下摘錄的段落,第二段提到設計專利申請案僅能有一項申請專利範圍,獨立且分別的設計應用不同申請案提出申請,因為不能被一項申請專利範圍所支持。

文末提到,然而,一個設計概念下經修改後的樣式(modified forms),或是一個設計概念下的多個實施例(embodiments),可以用一個申請案提出申請。列舉4個花瓶範例,這幾個花瓶之間僅最小配置差異(minimal configuration differences),例如瓶口有平的、有斜的、瓶蓋有圓的、有方的,這樣可以用一件設計申請案提出申請。


然而,提出申請之後,若審查過程提出的先前設計已經揭露(或相近)這幾個花瓶之間的相同設計概念,當限縮外觀特徵到其中一個差異時,將使得這幾個花瓶之間缺乏相同設計概念,因此除母案外,其餘可以分割申請案提出申請。

再找另外一例:D797323,說明書表明其中有多個在一個設計概念下的實施例。

重點:要表達出多個實施例之間的相同設計概念,就需要善用虛線或陰影表達出不主張設計部分。

第二範例:D980258

此範例是Apple Inc.的多狀態GUI設計(顯示Airpod音量),既然是多狀態,就會有不同狀態的圖式,說明書講明這些圖式為不同狀態與不同實施例。

Types of Designs and Modified Forms

An ornamental design may be embodied in an entire article or only a portion of an article, or may be ornamentation applied to an article. If a design is directed to just surface ornamentation, it must be shown applied to an article in the drawings, and the article must be shown in broken lines, as it forms no part of the claimed design.

A design patent application may only have a single claim (37 CFR § 1.153). Designs that are independent and distinct must be filed in separate applications since they cannot be supported by a single claim. Designs are independent if there is no apparent relationship between two or more articles. For example, a pair of eyeglasses and a door handle are independent articles and must be claimed in separate applications. Designs are considered distinct if they have different shapes and appearances even though they are related articles. For example, two vases having different surface ornamentation creating distinct appearances must be claimed in separate applications. However, modified forms, or embodiments of a single design concept may be filed in one application. For example, vases with only minimal configuration differences may be considered a single design concept and both embodiments may be included in a single application.

CA or DIV - 筆記

筆記(本篇僅適用美國)

問題:USPTO針對某專利申請案發出限制選擇要求(restriction/election requirement),其中將申請專利範圍(基於說明書實施例)根據不同分類區分為多組發明(如發明一、發明二、發明三),要求限制選擇,經申請人選擇其中之一「發明一」繼續審查,發明一經審查獲准,在領證公告之前(before issuance),針對「發明二」提出分割申請案(divisional application),不久「發明一」即領證公告。

這時USPTO接續審查「發明二」,如果此時申請人想要針對「發明三」提出另一申請案,是提出分割申請案(DIV)?還是接續案(continuation application,CA)?

事實上CA與DIV實質是相似的,只是面對基礎案的狀態而有不同的法律與程序。

簡單的回答是,不論CA或DIV(亦可適用CIP),內容都一樣,程序如何走是根據「基礎案/母案」狀態決定,因此,上述狀態下的延續案,即便是發明三,仍應採用CA(基於仍有pending的申請案),因為其基礎案已經領證公告(程序已終止)

如果基礎案是一般狀態的申請案,在未公告領證或是拋棄之前,都可出CA/CIP等延續案。如果基礎案是經過限制選擇要求的,在基礎案未公告領證或是拋棄之前,可針對其中未選擇的申請專利範圍提出一或多件DIV,如果並非針對其中未選擇範圍,延續案應為CA。

根據以下列舉法條,35USC121規範分割申請案,就是指根據審查意見提出的限制選擇提出DIV相關規定亦需參考規範延續案35USC120,還提到,在限制選擇要求下在基礎案領證公告前提出DIV,不能拿來對抗DIV或是相關申請案,意思是,DIV應該是要在基礎案領證公告前提出申請。

35 U.S.C. 121 DIVISIONAL APPLICATIONS.

If two or more independent and distinct inventions are claimed in one application, the Director may require the application to be restricted to one of the inventions. If the other invention is made the subject of a divisional application which complies with the requirements of section 120 it shall be entitled to the benefit of the filing date of the original application. A patent issuing on an application with respect to which a requirement for restriction under this section has been made, or on an application filed as a result of such a requirement, shall not be used as a reference either in the Patent and Trademark Office or in the courts against a divisional application or against the original application or any patent issued on either of them, if the divisional application is filed before the issuance of the patent on the other application. The validity of a patent shall not be questioned for failure of the Director to require the application to be restricted to one invention.

紐澳的專利範圍項次費用計算

根據文章資訊,2020修改過費用。

這裡說明,當提出專利申請案時,澳洲與紐西蘭的官方費用與"申請專利範圍數量"無關,也就是不論請求項數量僅收一筆費用。

澳洲在專利獲准時才根據獲准"專利範圍"數量收費,因此申請時並不用考量請求項數量,僅在獲准時(開心)才依據獲准專利範圍數量多收超項費(開心中一點點傷心)。

以20項為基準,在30項內,每多一項費用加125澳幣。
超過30項,每多一項多收250澳幣。

獲准專利範圍前不用刻意主動修正刪減專利範圍數量。

獲准後,如果想要通過修正增加專利範圍,超過20項,每超一項收250澳幣,不允許用"插入"的方式增加專利範圍,而是用額外增加來算。

根據文章的意思,如果在獲准後修正專利範圍,想要增加數量,要小心盡量不超過20項,如果增加後仍不超過20項,沒有額外費用,但如果超過20項,所有增加的範圍都會計算為超項費,也就是250*n(n為新增數量)。

紐西蘭,會根據專利審查過程中"申請專利範圍項數最大數量"收超項費用,也就是說專利審查過程要考量是否新增專利範圍,費用以過程中最大項次來算。文章在此提醒,申請時應小心是否有過多數量的專利範圍,因為,如果為了要減省費用在審查前主動修正減少專利範圍數量,還是可能會產生比超項費用更多的費用(這應該是因為主動修正的費用可能大於超項費用)。

這裡又提醒,即便如澳洲在獲准時收超項費,以及紐西蘭在審查時依照最大數量收超項費,都可能比專利獲准後被挑戰(無效程序)或者在獲准後修正都還省錢。

以25項為基準,超項"每5項收"120紐幣,舉例來說,在審查過程不論是否曾經因為修正而減少專利範圍,以其中最大數量來算,例如最大數量曾經達到50項,就多收超項費5*120=600紐幣,其中50-25=25超項,每5項收120,25/5=5,5*120=600。如果有100項費用,100-25=75,75/5=15,15*120=1800。

所稱「審查過程中最大數量專利範圍」,也就是說在審查前修正減少專利範圍項次是可有效減少費用的。但是申請後才想要修正減少專利範圍,還要考量「主動修正的官方費用」,文中有些說明。如果申請人需要大量的專利範圍,又想要節省費用,這裡建議可以提出「分割申請案」。

(另外應該考量適用日期,比如申請案是在新費用施行之前或之後...)

Article 76 European divisional applications
(1) A European divisional application shall be filed directly with the European Patent Office in accordance with the Implementing Regulations. It may be filed only in respect of subject-matter which does not extend beyond the content of the earlier application as filed; in so far as this requirement is complied with, the divisional application shall be deemed to have been filed on the date of filing of the earlier application and shall enjoy any right of priority. 
(2) All the Contracting States designated in the earlier application at the time of filing of a European divisional application shall be deemed to be designated in the divisional application.

因此,本訴願案的主題就是「分割申請案」的揭露內容應涵蓋在其母案的揭露範圍內,這是一般常識,但申請人常常在後續分割案中又想加入甚麼(自信沒有新增new matter),雖可能牴觸法條,但EPO審查時是否有某種寬容度?也順便再看看歐洲訴願案可以作些甚麼

系爭案EP10010835.6關於一種虛擬儲存系統與方法,可以動態地將檔案資料分配到一個儲存系統的各實體磁碟中。



本案源自申請人對EPO審查部門因為分割案不符Art. 76(1) EPC駁回申請案的決定提出訴願,申請人原本提出1個main request,以及兩個auxiliary requests。在口審後,訴願委員會仍做出申請案不符Art. 76(1) EPC的決定。申請人又再次提出新的main request,另有三個auxiliary requests。

main request:
"A computer environment system (100), capable of dynamically allocating data in a pool of storage, comprising:a data storage system (110), comprising a page pool of storage (112);wherein the page pool of storage (112) is configured to:maintain a pool of storage comprising data occupied disk storage blocks and available disk storage blocks for storing data formed across multiple RAID devices (114) and having a predefined size;
upon request by a
volume (116), allocate available disk storage blocks from the pool of storage formed across multiple RAID devices to the volume (116); andwrite data to the allocated available disk storage blocks."
在本分割申請案中,主要專利保護對象是Fig. 2:


可參考母案(EP1668486)對應美案US20160357446內容(編按,EPO資料庫中記錄美案公開號常常忽略到其中的"0")。

分割申請案的說明書與圖式內容一樣,但用了不同的樣子(編按,圖式內容應該一致,但似乎是重畫了),訴願委員會認為,因為使用的用語不同,也編號有也差異,使得審查人員很難檢查實施例(圖示)與說明書其餘部份的連結。

此處參考了說明書段落0022(Fig. 2內容),以及段落0023(Fig. 14A, 14B),認為,系爭案Claim 1的特徵無法直接與無明確地從母案衍生得知






我認為,當審查委員真不是蓋的,至少此案可看出,訴願委員會的意見指出,系爭案Claim 1中的「dynamic data allocation」是出現在說明書幾處段落,但說明書除了Fig. 2以外的內容「dynamic data allocation」描述的是「單一RAID system」(如段落0028)的技術,Fig. 2所描述的「資料分配」用於「RAID subsystem」以形成一個「page pool」,而說明書其餘內容(如段落0029)所提到的「dynamic data allocation」方法是用於「一個RAID subsystem」的磁碟中使得目前Claim 1所指出「multiple RAID devices」無法直接而無歧異地對應段落0022內容(Fig. 2)內容





本案訴願決定是,申請人提出的所有訴願方案都包括了超過原母案揭露內容的專利標的,訴願撤回。

my two cents:
本案例可看出EPO對於「分割案請求項不能超出原母案揭露內容」的標準很高,這應該也關忽審查委員本身的素質,這也如一般答辯EPO案的感覺 - 不容易!(標準很高)

TIPO整理的各國分割案時機點(筆記)

前言,各國對「分割案(Divisional Application)」的定義有些差異,但整體上都是規定分割案為一母案的後續案,且與母案揭露內容一致,不能產生新事物(new matter),在相同揭露內容下主張與母案不同的申請專利範圍,多數的概念是基於「單一性」的要求下提出分割案,實務上就是依照申請人的專利佈局,將母案揭露內容中尚未主張權利的部分提出分割案申請案,也是最重要的延續方案之一,而差別就是各國對「分割案」的申請時機的規定。而美國專利對於「分割案(Div)」是針對母案面對「限制選擇」後的解決方案,美國專利中「接續案(Continuation Application,CA)」才比較像其他各國分割案的概念。

(編按,抱歉的是,本部落格常常對一些英文的中文翻譯有不一致的問題,例如CA有時講的是"接續案",整體CA, Div, CIP都稱"延續案",不過,接續、延續或連續卻又常常混著用,希望理解時能以前後文與標註的英文為主。另外,根據TIPO文件,可知所述CA, DIV, CIP等案型直翻為「連續案」)

根據TIPO報導,與實務經驗的體驗差不多,整篇的結論就在其「摘要」中:
  • 允許分割時點以歐洲專利局最為寬鬆。
  • 允許分割時點以澳洲智慧財產局最為寬鬆。
  • 允許分割時點以歐洲專利局最為寬鬆。
  • 允許分割時點以歐洲專利局中國大陸國家知識產權局最為寬鬆。
  • 各國對於「分割時點」的規定沒有一致性,但如「日本」及「韓國」在專利分割時點之修法,都是朝向放寬分割時點限制
  • 我國於2019 年5 月1 日公布之專利法修正案中,也是「擴大核准審定後分割之適用範圍及期限」。

一些重點:

  • 2011年修法後,增加「初審核准審定書送達後30日內可提起分割申請案」規定。
  • 申請分割的時點:
    (1)原申請案(即母案)「再審查審定前」,處於「繫屬智慧局」為原則,可提出分割申請;
    (2)初審或再審查核准審定書送達後3個月內(初審規定原本是30日),得提出分割申請;
  • 若初審核駁審定書送達後未先提出再審查申請且受理者,不得申請分割。

  • 前後案(母案、子案)之間關係可分為:連續(continuation)、部分連續(continuation-in-part)或分割(divisional)。

  • 分割案(DIV)提出時機:只要其前案(母案或其他子案)處於審查中(copending)的狀態,任何時間皆可提出分割申請案。
  • 分割案(DIV)於母案"公告"前提出,且為依照審查委員的「限制性要求」的選擇結果所提出,當母案(或其子案)獲准專利,USPTO與法院都不能以此專利的引證資料對抗後續「分割案」。
  • (編按,在以上概念下,自然接受連續分割案。)

- 歐洲專利局

  • 分割案申請時機:申請人可在不超出母案申請時說明書內容的前提下,對任何在審查中(pending)狀態下的歐洲申請案提出「分割申請案」,同樣享有母案所主張的優先權。
  • 接受「連續分割案(sequence divisional application)」,且只要「第一分割案」在pending狀態下,可提出「第二分割案」(有額外費用)。
  • 母案(或先前子案)核駁確定、撤回或視為撤回時,就不能提出其後續的分割申請案。
  • (編按,歐洲專利並沒有TW有初審與再審程序,這樣就不同於TW案初審審定後有30天可提出分割案的規定。)
  • 如果申請人有效提出「訴願申請」,即便沒有訴願理由(補件期限前),案件是屬於「審查中」的狀態。
  • 申請案繫屬「訴願程序」,即屬於「審查中」狀態。
  • 歐洲專利申請案核駁確定前允許分割之時點示意圖:
  • 歐洲專利制度中,即便沒有獲准專利,仍需要繳交「年費/維持費」,如果沒有繳交此維持費,但仍「復權費(additional fee)」繳交期限內(6個月),申請案仍屬於「審查中」狀態,也就可以在此期間內提分割申請案。
  • 歐洲專利申請案視為撤回效力生效前允許分割之時點示意圖:
  • 歐洲專利申請案失權克服前後允許分割之時點示意圖:
- 日本特許廳

  • 分割案時點:原則上,可以進行「修正」或限定期間的時間就是提出「分割申請案」的時機(細節有點多,如下)
  • 核准審定前,申請人在收到核准審定書之前,均可修正,亦即可提出「分割申請」。
  • 核准審定後,僅能於核准審定書送達後30日內,可提出分割申請。
  • 核駁審定前,在收到「核駁審查意見書」後於指定期間內修正時,可提出「分割申請」。
  • 核駁審定後,若不服,應於核駁審定書送達後3個月內提起訴願,提起訴願後3個月內,可提出「分割申請」。
  • 日本發明專利核駁審定前後允許分割之時點示意圖:
- 中國大陸國家知識產權局

  • 提出分割案時機:一件專利申請包括「兩項以上發明」內容者,申請人可以在准予專利的通知書送達後2個月內,提出「分割申請」。
  • 專利申請案已經核駁、撤回或視為撤回者,則不能提出分割申請
  • 核准審定後,收到審定書後2個月內提出「分割申請」,中國大陸核准後允許分割之時點示意圖:
  • 接獲核駁審定書後3個月內可提出「分割申請」(不論是否提出復審)。程序上,申請人可提出復審,對復審決定不服者,可以決定送達後3個月內向「人民法院」提起「行政訴訟」。
  • 在提出「複審請求」以後及對複審決定不服「提起行政訴訟」期間,申請人亦可提出分割申請。
  • 中國大陸核駁後允許分割之時點示意圖:
- 韓國智慧財產局

  • (若對修法前的分割案有興趣者可看內文)
  • 母案之「核准審定書」送達前可提出修正,亦可提出分割申請。
  • 當母案獲准專利時,核准審定書送達後3個月內,申請人可以提出「分割申請」,但須在領證前。
  • 母案「核駁審查意見書」送達後,以下幾個期間可提出修正及「分割申請」:
    (1)收到「第一次核駁審查意見書」中記載的指定時間;
    (2)因針對先前核駁審查意見書後所為之修正,審查人員「再」作出核駁審查意見書時,其中所載之指定期間;
    (3)申請「再審查(re-examination)」的30日法定期間,為可提出分割申請的期間;
    (4)「核駁審定書」送達後,30日內可提出分割申請。
  • 韓國2015 年1 月1 日修法施行後核駁審定前後允許分割之時點示意圖:
  • 申請人對「核駁意見」不服,可於30日內提出訴願(petition),訴願階段的行政專利法官(administrative patent judge)經審查發出書面判決,若為「撤銷核駁專利」的決定,可於裁決送達後3個月內,提出「分割申請」(應於領證前)。但若為「維持核駁專利決定」,不能提出分割申請案。
  • 韓國2015 年1 月1 日修法施行後,撤銷核駁專利決定送達後允許分割之 時點示意圖:
- 澳洲智慧財產局

  • 澳洲授予專利前允許分割之期間:第一次申請提出之日開始,到下列任一時點發生前,得申請分割:(1)第一次申請之母案失效(lapses)之前;
    (2)第一次申請之母案被核駁之前;
    (3)第一次申請之母案被撤回之前;
    (4)第一次申請之母案為發明專利時,核准公告日起3個月內,可提出分割申請。
  • 如果第一次申請的母案已經失效、核駁或撤回者,則申請人不得提出分割申請。
  • 澳洲授予發明專利前允許分割之時點示意圖:
  • 澳洲專利法具有「異議制度」,當發明專利核准公告後,允許第三人於公告日後三個月內提出異議,異議期間屆滿後無人異議者,原則上須於公告後6個月內授予專利。但如有在法院、行政上訴法庭(Administrative Appeals Tribunal,AAT)訴訟中之法院、AAT 指示或審查人員合理指示時,可能會晚於公告後6個月,推遲授予專利權,一旦授予發明專利權後則不允許提出分割申請

本篇報導關於澳洲將逐步廢除「創新專利(innovation)」的措施,創新專利類似一般知道的新型專利,採用「形式審查」,更快速領證,但是與我國「新型專利」的保護標的不同,澳洲創新專利可涵蓋「物之製造方法、處理方法、使用方法等,及無一定空間形狀、構造的化學物質、組成物」等專利標的。

我國「新型專利」定義:

"新型是利用自然法則之技術思想,佔據一定空間的物品實體,且具體表現於物品上之形狀構造或組合的創作。亦即新型係指基於形狀、構造或組合之創作,所製造出具有使用價值和實際用途之物品。申請專利之新型僅限於有形物品之形狀、構造或組合的創作,非僅屬抽象的技術思想或觀念,因此舉凡物之製造方法、處理方法、使用方法等,及無一定空間形狀、構造的化學物質、組成物,均不符合新型的定義。"

澳洲「創新專利」定義:

"澳洲創新專利登記時無須實質審查,適用「短期市場生命」的產品,登記後(1個月內核准領證)有8年期限,適合技術水平不如標準專利(發明專利)的創作,甚至可包括電腦相關發明。創新專利要求有「創新性(innovative step)」,不同於標準專利的「進步性(inventive step)」,所謂「創新性」是指不同於已知技術,且差異對發明而言有實質貢獻。主張「創新專利」權利(如授權、訴訟)時應先經過實質審查"

澳洲的專利種類包括:臨時申請案(provisional)、標準專利(standard,如發明專利,20年期限)、創新專利(innovation,如新型專利,但定義更廣,形式審查,專利標的可以為裝置、結構、物質、方法與流程,8年期限,可提出實際審查請求),以及藥品專利(25年期限)。

澳洲廢除「創新專利」的理由(缺失):

然而,澳洲創新專利制度將被廢除,從2021年8月26日起不能再申請「澳洲創新專利」,2021年8月25日當日前提出創新專利申請案完成登記後仍有效直到期限屆滿。即便在2021年8月26日後,有效的創新專利還是可以進行後續「分割案」申請。
2021年8月26日前申請的標準專利案,可以轉為創新專利。

根據官方報導,為何要廢除澳洲創新專利(innovation patent),主要理由是,"效果不彰",這個「登記專利」並沒有有效刺激創新,反而讓大型企業阻礙了中小型企業的創新,甚至官方以「窒息(stifle/suffocate)」來形容大企業使用「創新專利」阻礙中小企業發展的情況。(根據官方數據,大型企業於2017年取得創新專利的數量為中小企業的4倍,已經悖離創新專利制度的原意)

除了創新專利被大企業拿來"阻礙"中小企業發展的缺失外,更者,澳洲政府還意識到「登記制度」的創新專利也阻礙「技術輸出」,因為申請「創新專利」的發明多數不會申請國外專利,除了阻礙國外佈局外,也是公開給人仿冒的機會。

澳洲政府提供廢除創新專利的「配套措施」:

相關配套是特別對中小企業「量身訂做」的措施。

1. 反過來,原本「標準專利」才是能保護中小企業智慧財產的制度。

提供快速審查方案,讓中小企業在8個星期內獲得審查報告。

SME case management
根據成功的跨國計畫,通過專利申請流程提供專門管理人協助中小企業加速佈局國際,在目標市場得到保護。

SME portal
重新開發澳洲專利網頁,提供目標導向的平台,提供中小企業量身訂做的服務與產品,包括產業建議、智慧財產權組合管理工具,以及政府各部門的支持。

SME dedicated outreach program
提供中小企業成長計畫與教育,以政府力量支持多樣性智慧財產權佈局。

my two cents:
「澳洲創新專利」或是一般認知的「新型專利」制度初衷應該是降低專利申請與取得的門檻,因此費用較低、門檻較低,但是又因為便宜、保證以及快速取得專利,如果大企業大量申請,反而是更為有效地藉由佈局新型專利建立「專利堡壘」,大量的新型專利,即便"無效",都能讓中小企業「窒息」。這就是澳洲要廢除創新專利的主要理由之一。

先不論澳洲這樣做的好壞,有時會看到自己都感到「不申請國外很可惜」的專利內容,也常常在想「新型」,或是學校申請的專利,這些多數沒有「國外案」的專利都是「公開」給全世界的技術,也就是放棄權利的創新,似乎是「不申請還比較好」的制度!

以上廢除理由是設有「登記專利」制度的國家可以參考!

後語,本篇僅是一個「報導」,但從澳洲政府廢除「創新專利」(與一般認知新型專利相似,但有差異)的內容來看,還是可以得出一些心得。「新型專利」是一個很localized的專利制度,其實很好用(看怎麼用),給很多人機會,也有很多活用的策略,但確實可能威脅整體(國家)競爭力,也可能會浪費司法與行政資源,可廢除。但仍是需要多方考量。
