The addition of the word “type” to an otherwise definite expression (e.g., Friedel-Crafts catalyst) extends the scope of the expression so as to render it indefinite. Ex parte Copenhaver, 109 USPQ 118 (Bd. Pat. App. & Inter. 1955). Likewise, the phrase “ZSM-5-type aluminosilicate zeolites” was held to be indefinite because it was unclear what “type” was intended to convey. The interpretation was made more difficult by the fact that the zeolites defined in the dependent claims were not within the genus of the type of zeolites defined in the independent claim. 用途發明中用語“EFFECTIVE AMOUNT”的明確性議題 - Ex parte Skuballa (BPAI 1989)
The common phrase “an effective amount” may or may not be indefinite. The proper test is whether or not one skilled in the art could determine specific values for the amount based on the disclosure. See In reMattison, 509 F.2d 563, 184 USPQ 484 (CCPA 1975). The phrase “an effective amount . . . for growth stimulation” was held to be definite where the amount was not critical and those skilled in the art would be able to determine from the written disclosure, including the examples, what an effective amount is. In reHalleck, 422 F.2d 911, 164 USPQ 647 (CCPA 1970). The phrase “an effective amount” has been held to be indefinite when the claim fails to state the function which is to be achieved and more than one effect can be implied from the specification or the relevant art. In reFredericksen, 213 F.2d 547, 102 USPQ 35 (CCPA 1954). The more recent cases have tended to accept a limitation such as “an effective amount” as being definite when read in light of the supporting disclosure and in the absence of any prior art which would give rise to uncertainty about the scope of the claim. In Ex parteSkuballa, 12 USPQ2d 1570 (Bd. Pat. App. & Inter. 1989), the Board held that a pharmaceutical composition claim which recited an “effective amount of a compound of claim 1” without stating the function to be achieved was definite, particularly when read in light of the supporting disclosure which provided guidelines as to the intended utilities and how the uses could be effected.

A product-by-process claim, which is a product claim that defines the claimed product in terms of the process by which it is made, is proper.Purdue Pharma v. Epic Pharma, 811 F.3d 1345, 1354, 117 USPQ2d 1733, 1739 (Fed. Cir. 2016); In re Luck, 476 F.2d 650, 177 USPQ 523 (CCPA 1973); In re Pilkington, 411 F.2d 1345, 162 USPQ 145 (CCPA 1969); and In re Steppan, 394 F.2d 1013, 156 USPQ 143 (CCPA 1967). A claim to a device, apparatus, manufacture, or composition of matter may contain a reference to the process in which it is intended to be used without being objectionable under 35 U.S.C. 112(b) or pre-AIA 35 U.S.C. 112, second paragraph, so long as it is clear that the claim is directed to the product and not the process.
An applicant may present claims of varying scope even if it is necessary to describe the claimed product in product-by-process terms. Ex parte Pantzer, 176 USPQ 141 (Bd. App. 1972).
A single claim which claims both an apparatus and the method steps of using the apparatus is indefinite under 35 U.S.C. 112(b) or pre-AIA 35 U.S.C. 112, second paragraph. See In re Katz Interactive Call Processing Patent Litigation, 639 F.3d 1303, 1318, 97 USPQ2d 1737, 1748-49 (Fed. Cir. 2011). In Katz, a claim directed to “[a] system with an interface means for providing automated voice messages…to certain of said individual callers, wherein said certain of said individual callers digitally enter data” was determined to be indefinite because the italicized claim limitation is not directed to the system, but rather to actions of the individual callers, which creates confusion as to when direct infringement occurs. Katz, 639 F.3d at 1318, 97 USPQ2d at 1749 (citing IPXL Holdings v. Amazon.com, Inc., 430 F.3d 1377, 1384, 77 USPQ2d 1140, 1145 (Fed. Cir. 2005), in which a system claim that recited “an input means” and required a user to use the input means was found to be indefinite because it was unclear “whether infringement … occurs when one creates a system that allows the user [to use the input means], or whether infringement occurs when the user actually uses the input means.”); Ex parteLyell, 17 USPQ2d 1548 (Bd. Pat. App. & Inter. 1990) (claim directed to an automatic transmission workstand and the method of using it held ambiguous and properly rejected under 35 U.S.C. 112, second paragraph).

通過各種證據說明如何"合理"地解釋專利範圍/用語 - In re Sneed (CAFC 1983)
在訴願階段(當年應該是BPAI),審查意見組合先前技術,還參考申請案中背景技術的描述(AAPA),作出再領證申請案不具非顯而易見性(35 U.S.C. § 103)的審查意見。
針對解釋專利範圍,參考說明書並採用最廣而合理的解釋原則(broadest reasonable interpretation),其中"最廣"提供申請人有其修正與解釋空間,但仍要"合理",於是法院參考各種證據、專家意見與先前技術來解釋專利範圍與申請人想要修正的內容。以下有精闢"合理"範圍的解釋過程。
對照先前技術針對管線設計與應用領域的教示,以相關領域一般技術人員而言,會考慮所述"flexible plastic pipe"採用1.5吋與2吋管徑的聚乙烯管,但是系爭案說明書與證據並未支持申請人/上訴人對於專利用語(即"flexible plastic pipe")的解釋。
根據證據顯示,1.5吋管徑的柔性管足以承載足夠的水供應鑽孔機運作,但這已經是先前技術揭示的內容,也反駁了申請人答辯1.5吋管子不足以供應足夠的水的意見。因此法院駁回申請人要修正的內容以及對於修正內容的答辯理由。
針對系爭案申請人主張系爭案發明相關產品已經商業成功的答辯意見,此時,法院需要先建立商業成功與系爭案發明的關聯性("requisite nexus between the claimed invention and its alleged commercial success"),也就是需要探討本案專利權人Fas-Line Sales & Rentals, Inc.公司產品與發明的關聯(nexus),法院認為(1)該公司業務範圍並不限於系爭案發明,還包括了器材租賃與安裝,(2)沒有舉證該公司銷售數據分配到各個業務領域,(3)根據發明人證詞說明系爭案發明為非常好的產品,但這也是現在的技術,無關過去的銷售數據,加上(4)即便"柔性塑膠管"愈來愈普遍,但系爭案發明是"鋪設柔性管的方法",兩者關聯性不大。基於以上理由,無法建立商業成功與系爭案發明的關聯性。

因為BRI原則被駁回專利的案例 - In re Bigio (Fed. Cir. 2004)
Claim 1:
A hair brush comprising
an elongated member element having handle segment and a bristle substrate segment on a common axial centerline,
said bristle substrate defining an hourglass shape with a core segment having along its longitudinal extent, a smoothly curved progressively radially smaller central region and progressively radially larger end regions,
said bristle substrate carrying a plurality of hair brush bristles,
said hair brush bristles segregated into groups of small bundles disposed over said bristle substrate in a series of axially aligned and radially distributed linear bristle rows,
each bristle bundle in a respective linear row spaced axially apart along said bristle substrate and extending substantially radially with respect to said axial centerline and forming an hourglass shaped hair brush bristle system for said hair.
在審查階段,審查委員引用先前技術:英國專利17,666(Flemming)與美國設計專利No.424,303(Tobias)或No.140,438(Cohen),認為claim 1為顯而易見。引證案都是超古的前案:

申請人Bigio(可能是哥倫比亞人)為了要區隔與前案的差異,解釋本案"hair brush"限制在「頭皮毛髮的刷子/brushes only for scalp hair」,但是BPAI否決這個解釋,理由是因為"hair brush"可以包含人類頭皮的刷子,還可以包括動物,並且認為“牙刷”也算是類似的先前技術。
Bigio針對是否牙刷是本案類似的前案提出上訴。
就審查階段而言,最廣而合理的解釋(BRI)原則讓申請人有修正專利而移除不清楚的部分,也就是能夠讓公眾排除其他解釋可能而能獲准專利。
本案中,BPAI解釋髮梳不僅包括人類頭皮的梳子,也可包括動物的毛髮梳子,甚至是人類眼睫毛的刷子,沒也限制到特定的毛髮。
解釋專利範圍:
法院同意BPAI拒絕申請人要以說明書的描述限制專利範圍,比如限制到人類的頭皮,也就是解釋專利範圍的一般原則,不能僅以說明書內容限制專利範圍。
是否牙刷是本案類似前案?
這裡提出兩個測試類似先前技術的原則:
(1)是否是相同技術領域(field of endeavor)?
(2)如果不是相同技術領域,是否前案仍合理涉及發明要解決問題。
BPAI認為Flemming為相同領域的先前技術,理由是相同領域一般技術人員判斷他們是功能與結構相似的物品,認同這些前案為合理且相似的前案,法院也是認同這個見解。
結論是,當引用前案的功能與其結構相似,就是屬於相同技術領域,如果又僅是尺寸上的差異,或是材料上的改變,前案與引證案差異就是顯而易見的。
my two cents:
根據MPEP 2173,在BRI解釋原則下,申請專利範圍的用語應給予明白而普通的解釋,除非與說明書抵觸,引用本案例,說明專利範圍的用語的意思是以相關領域一般技術人員來判斷,且不能單純以說明書內容來限制較廣的專利範圍用語,專利說明書最好的用意就是告知公眾專利範圍的作用。

以開放的態度解釋專利範圍 - In re Skvorecz (Fed. Cir. 2008)
再領證審查結果引用以下前案,核駁claims 1-5, 7,claim 6是可核准專利範圍。前案如下:
案件進入訴願,除上述涉及102的核駁意見外,BPAI另作出兩項核駁理由:claim 5不明確以及claims 1-5, 7不滿足撰寫要求(35USC112),這時專利申請人Skvorecz可以提出再審(rehearing),或是重啟(reopen)USPTO審查程序,結果申請人是選擇訴願再審,BPAI仍是駁回本案。

這似乎是一個經典案例,說明如果先前文獻中有錯,剛好錯到揭露到後申請案中的重要內容,仍不能成為有效的證據。本篇是討論從patently-o文章中提到的案例(https://patentlyo.com/patent/2022/07/prior-wherefore-though.html)。
In re Harry Louis Yale案件資訊:
系爭案:(Serial No. 554,071 filed June 2, 1966 as a continuation-in-part of serial No. 365,173 filed May 5,1964.)(編按,目前找不到文本)
本案是在審查階段USPTO核駁申請案開始,當時審查結果是認為系爭專利claims 1-10不具專利性,發明關於吸入式麻藥,成分為「3-bromo-3-chloro-1,1,1,2,2-pentafluoropropane」,其中分子式為「CF3CF2CHClBr*」,使麻藥可與氧氣一起給藥,請求項1即描述了相關成分,請求項2描述其純化物,請求項3涵蓋了共沸混合物,請求項4-5描述與防腐劑的混和物,請求項6-10則是描述誘發麻藥與所述成分的方法。

其中Clements揭露麻醉氣體的成分,其中有「CF3CF2CPIClBr」;Suckling揭露了吸入式麻醉藥的成分,但沒有「CF3CF2CHClBr」;Muray提到了系爭案中化合物的備製方法;Chemical Abstracts顯示系爭案中的化合物的開始原料是已知的。
基於以上幾個前案,USPTO駁回專利申請案,案件經上訴訴願委員會(應該是BPAI),也是判定系爭案中成分已經被前案揭露,整體上為顯而易知(35 USC 103)。
審查意見特別引用的前案特徵是Clements圖3中揭示的「CF3CF2CHClBr」。
特別的是,專利申請人/上訴人Harry Louis Yale的主張在於「Clements中列出的"CF3CF2CHClBr"是印刷錯誤(typographical error)」。
上訴人認為,很明顯地,相關領域一般技術人員可以知道Clements中寫的「CF3CF2CHClBr」是錯的,理由是:
(1)Clements文獻中僅揭示已知化合物;
(2)其中測試的化合物僅畫在圖表中;
(3)圖3中顯示的「CF3CF2CHClBr」並沒有出現在其他地方;
(4)圖3中的內容不合理。
上訴人也請出專家,其中有一位是Clements文獻共同作者。當時訴願委員會並未被說服,反倒認為相關領域一般技術者並不知道這是一個錯誤,也不見得是錯誤,也會被教示所述「CF3CF2CHClBr」是一種麻醉藥。且再根據其他前案,相關領域一般技術人員可以知道如何製作相關成分。
然而,在CCPA,不僅是Clements有印刷錯誤的問題,也是相關領域一般技術人員在閱讀Clements時知道的錯誤。因此,因為有錯,不能說相關領域一般技術人員可以在精神上忽視這個錯誤,或是用其他成分替代。也就是說,相關領域一般技術人員不會被印刷錯誤的內容引導使用錯誤的成分作為麻醉藥。
基於相關專家證詞也證明Clements中描述的成分是明顯的印刷錯誤,表示Clements並非可以與其他引證文獻證明系爭案發明是顯而易見的。
"Since the listing of CF8CF2CHClBr in Clements is an error obvious to one of ordinary skill in the art, it cannot be said to describe or suggest that compound to those in the art. The public is not put in possession of the compound; thus, it would not be obvious to use it as an inhalant anesthetic as in Suckling or to mix it with the various other compounds which are mixed with the fluorinated hydrocarbons of Suckling."

證據中的數值或技術描述有錯,即便好像可以對比到審查中的專利內容,但仍不能算是證據,反過來,如果證明先前技術有錯,或許就可以排除其證據力。
這讓我想到曾經報導的「自動前案產生器」 - 要隨意申請專利嗎?小心自動前案產生器(https://enpan.blogspot.com/2016/04/blog-post_26.html),這是一個想要摧毀專利系統的"陽謀",當利用電腦技術隨意拼湊專利文獻持續產生一些前案文檔,這些「先前技術」是否可以成為有效的前案?看來,如果嚴格檢驗這些前案文章,應該是不用太過擔心才是,除非這類AI愈來愈厲害....。
