AI輔助準備訴訟不會簡單被判定放棄律師當事人特權 - Warner v. Gilbarco, Inc . et al (E.D. Mich. 2026)

討論此案例的主要理由是法院判決與前篇「使用商用AI將放棄律師-當事人特權 - United States v. Heppner (S.D.N.Y. Oct. 28, 2025)(https://enpan.blogspot.com/2026/06/ai-united-states-v-heppner-sdny-oct-28.html)」的意見相左,前篇Heppner案被告(刑事案件)在沒有律師建議的情況下使用消費者版本AI(Claude AI)取得法律意見,過程中輸入從律師來的資料,而此AI平台的隱私策略是讓Anthropic使用用戶提供的資料作為訓練AI的用途,法院判決這個行爲破壞當事人與律師之間通訊的保密性(confidentiality),不適用律師工作成果豁免權(work-product doctrine)。反之,本篇討論案例為民事訴訟,當事人原告Warner自為訴訟代理(pro se,沒有聘請律師),Warner使用ChatGPT輔助當事人準備訴訟材料,法院認為這仍是受到保護的工作,法院不認為生成式AI會將其訴訟資料揭露給第三方,因此沒有放棄律師工作成果豁免權(work-product doctrine)的問題。

下這個標題「AI輔助準備訴訟不會簡單被判定放棄律師當事人特權 - Warner v. Gilbarco, Inc . et al (E.D. Mich. 2026)」應該也是頗為危險,因為法院判例還沒有形成,很多判決都是當下情境下的決定,有時無法一體適用,但判決的“意旨”是很好的參考資訊。

本篇判決是來自「United States District Court Eastern District of Michigan Southern Division」(又東又南的法院 - 美國密西根南區東部地方法院),案件資訊:

本案原告WarnerGilBarco公司提起民事訴訟,被告在探索程序(discovery)中發現原告證詞使用第三方AI工具,被告請求法院推翻原告的「律師-當事人特權」與其「律師工作成果豁免權」

本篇判決摘要:

第一,法官認為work-product doctrine保護“另一方或其代表用於準備訴訟的文件與物品”("documents and tangible things that are prepared in anticipation of litigation or for trial by another party or its representative"),也就是work-product doctrine保護原告準備訴訟的資料,特別是原告自為訴訟代表,有權主張其工作成果豁免權也包括「AI輔助的材料」,因此仍適用「律師工作成果豁免權」。

(編按,相較之下,前篇Heppner因為聘僱律師並未指使他使用AI,因此放棄了律師工作豁免權,差異在於是否聘請律師,是否使用AI是律師的指示。)

第二,法院認為只有向對手揭露其工作成果才是放棄工作成果豁免權,法院認為ChatGPT僅是個工具,不是人,即便其背後有“管理人”,因此判定使用ChatGPT並沒有放棄律師當事人特權(Attorney-Client Privilege)。

第三,法院同意原告主張使用AI等行為是其內部分析與心智活動(mental impressions/thought process),並非是文件或是證據內容。並且,原告的意見算是“合理地”提出,被告所提出的意見(如果法院同意的話)使現代訴訟都無法避免地失去了律師工作成果豁免權。

還有一個想法是,被告並沒有充分證據表明原告將機密文件提供給AI是違反相關特權,如果僅是懷疑就否決所有權利,以及如果用了AI就失去固有的保護權利,並不成比例。


本案也算不上是任何判決,目前僅是證據揭露階段的爭議,但也就有很多值得參考的功課了。

HeppnerWarner兩個案例答案不同,但其中爲不太一樣的背景與訴訟情節,不見得可以說是"相反"的意見,且使用AI的情況/隱私條款也不盡相同,兩種意見也都頗合理,法院、律師正在與AI拉扯中。

當客戶不再只聽律師的話時

前幾天分享訴訟過程機密文件交給AI的後果可能會放棄了律師-當事人秘匿的特權的案例,但是現在的當事人並不會乖乖地等律師的意見,無法期待焦慮、面對複雜法律程序以及甚至懷疑律師意見的當事人不會去問AI ... 但在許多不明的情況下,律師怎麼做?

Thomson Reuters Practical Law article ‘Why clients should not put privileged advice into public LLMs’提出法院需要處理目前面臨的問題,大家想問的問題之一是,是否將資料上傳到商業LLM(如ChatGPT、Gemini、Claude... )就是送資料到公共領域(public domain)?是否傳送給LLM就代表對手可以從中取得機密資料?

律師無法要求當事人不用AI,但可以降低AI帶來的風險,釐清哪些AI工具可以使用、如何驗證AI提供的意見、如何維護法律上該有的權利... 。前篇參考文章(https://lsj.com.au/articles/your-clients-are-using-ai-anyway-and-its-creating-a-privilege-risk-lawyers-cant-control/)中提出一些建議,列舉一些(筆記)。
  • 工作前需要指示當事人不能(或是哪些事不能)使用公共領域的AI。
  • 律師應用當事人懂的語言與方式工作。
  • 建立工作流程,一步步走,讓當事人知道在進度中。
  • 律師自己要進步,法律意見也要進步,使用AI也是勢不可擋。
  • 無法否定的是AI可協助工作流程快一點,就讓它參與吧。

或許我面對的"底層"工作並沒有那麼複雜,但確實已經受到「邏輯與理智上」的挑戰,當發明人不再僅提出自己的發明,還疊加許多AI資料時,我怎麼辦?如何與AI共存?事實上到目前為止無法處理的是AI講的話我看不懂,AI自以為是的內容還是太多,目前建議發明人自己要先理解AI的內容,到底是不是自己的發明,不能直接輸出AI內容又不曉得裡面的內容,這對我這小小的頭腦而言負擔太沈重。

上傳保密文件給AI的可能後果 - UK v. Secretary of State for the Home Department (UTIAC)

筆記

前篇討論「使用商用AI將放棄律師-當事人特權 - United States v. Heppner (S.D.N.Y. Oct. 28, 2025)」,其中涉及的議題是當事人尋求AI提供法律意見,但行為因為不符合Attorney-Client Privilege條件而失去特權保護,使得相關文件需要被揭露。

另有案例 - Glencore International AG v Commissioner of Taxation [2019] HCA 26,關於律師與當事人之間的權利義務關係,律師原本的工作就是維護當事人利益,當中需要雙方花時間充分的溝通、協助法律進程,以及在法庭上爭取權益,而現在的當事人已經沒有時間與律師慢慢磨了,動不動就找AI的幫助,超過律師可以控制的狀況。此案例主要問題是,當事人尋求AI協助法律問題,如果是將需要保密的部分提供給一般可公眾使用的生成式AI,這些保密內容有可能會提供給其他人,而使用者其實並不曉得AI到底會怎麼處理這些內容,甚至不曉得儲存在哪裡。(updated)

本篇參考的文章就提到幾件法院案例,其一為前篇報導的 - United States v. Heppner (S.D.N.Y. Oct. 28, 2025);本篇特別補充英國有案例 - UK v. Secretary of State for the Home Department (UTIAC),判決結果是上傳機密文件到開源的AI工具 - 如ChatGPT,將使相關資訊在網路上被公開,也就違法律師與客戶之間保密協定,並放棄了相關法律特權,主要是指律師-當事人特權(Attorney-Client Privilege)。(updated on June 28, 這裡我提出個疑點:此判決通篇說“open-source AI,如ChatGPT”,我覺得應該是指可讓公眾使用的AI(accessible to the general public),或說open AI,且經查不少資料,ChatGPT應不算open source AI。如果"open-source AI"用在地端,應該也不會有洩密的問題。)

上傳保密文件到開源AI工具,也就將資訊放在公眾領域,也就違反律師-客戶保密與拋棄法律特權。

這裡提到Microsoft Copilot沒有上述風險(?)。

這段說明AI訓練過程會產生illusion,在法律上的意見並不可靠。

一旦保密資訊成為公眾可存取的資料,法院也就沒有保密義務了。

前篇報導:考量AI發明的專利適格性,將AI技術分為三個層次: 
(1) data layer(資料層),這是關於用於訓練AI的訓練資料(training data)、測試資料(testing data)與驗證資料(validation data),經完成訓練後建立AI模型,AI模型最後根據輸入資料產生預測結果等的輸出資料。
(2) application layer(應用層)(i.e., software),這是關於電腦軟體,通過軟體驅動AI系統執行相應的動作、作決定以及產生結果。舉例來說,深度學習模型讓AI搜尋抽象的數據,AI神經網路則是倚賴數學模型執行分析。
(3) system layer(系統層)(i.e., hardware),這是關於AI系統的硬體,即電腦硬體。

MPEP 2106.05 Eligibility Step 2B: Whether a Claim Amounts to Significantly More

A. Relevant Considerations For Evaluating Whether Additional Elements Amount To An Inventive Concept

The Supreme Court has identified a number of considerations as relevant to the evaluation of whether the claimed additional elements amount to an inventive concept. The list of considerations here is not intended to be exclusive or limiting. Additional elements can often be analyzed based on more than one type of consideration and the type of consideration is of no import to the eligibility analysis. Additional discussion of these considerations, and how they were applied in particular judicial decisions, is provided in in MPEP § 2106.05(a) through (h).

Limitations that the courts have found to qualify as “significantly more” when recited in a claim with a judicial exception include:

Improvements to the functioning of a computer, e.g., a modification of conventional Internet hyperlink protocol to dynamically produce a dual-source hybrid webpage, as discussed in DDR Holdings, LLC v. Hotels.com, L.P., 773 F.3d 1245, 1258-59, 113 USPQ2d 1097, 1106-07 (Fed. Cir. 2014) (see MPEP § 2106.05(a));
  • ii. Improvements to any other technology or technical field, e.g., a modification of conventional rubber-molding processes to utilize a thermocouple inside the mold to constantly monitor the temperature and thus reduce under- and over-curing problems common in the art, as discussed in Diamond v. Diehr, 450 U.S. 175, 191-92, 209 USPQ 1, 10 (1981) (see MPEP § 2106.05(a));
  • iii. Applying the judicial exception with, or by use of, a particular machine, e.g., a Fourdrinier machine (which is understood in the art to have a specific structure comprising a headbox, a paper-making wire, and a series of rolls) that is arranged in a particular way to optimize the speed of the machine while maintaining quality of the formed paper web, as discussed in Eibel Process Co. v. Minn. & Ont. Paper Co., 261 U.S. 45, 64-65 (1923) (see MPEP § 2106.05(b));
  • iv. Effecting a transformation or reduction of a particular article to a different state or thing, e.g., a process that transforms raw, uncured synthetic rubber into precision-molded synthetic rubber products, as discussed in Diehr, 450 U.S. at 184, 209 USPQ at 21 (see MPEP § 2106.05(c));
  • v. Adding a specific limitation other than what is well-understood, routine, conventional activity in the field, or adding unconventional steps that confine the claim to a particular useful application, e.g., a non-conventional and non-generic arrangement of various computer components for filtering Internet content, as discussed in BASCOM Global Internet v. AT&T Mobility LLC, 827 F.3d 1341, 1350-51, 119 USPQ2d 1236, 1243 (Fed. Cir. 2016) (see MPEP § 2106.05(d)); or
  • vi. Other meaningful limitations beyond generally linking the use of the judicial exception to a particular technological environment, e.g., an immunization step that integrates an abstract idea of data comparison into a specific process of immunizing that lowers the risk that immunized patients will later develop chronic immune-mediated diseases, as discussed in Classen Immunotherapies Inc. v. Biogen IDEC, 659 F.3d 1057, 1066-68, 100 USPQ2d 1492, 1499-1502 (Fed. Cir. 2011) (see MPEP § 2106.05(e)).

Limitations that the courts have found not to be enough to qualify as “significantly more” when recited in a claim with a judicial exception include:

Adding the words “apply it” (or an equivalent) with the judicial exception, or mere instructions to implement an abstract idea on a computer, e.g., a limitation indicating that a particular function such as creating and maintaining electronic records is performed by a computer, as discussed in Alice Corp., 573 U.S. at 225-26, 110 USPQ2d at 1984 (see MPEP § 2106.05(f));
  • ii. Simply appending well-understood, routine, conventional activities previously known to the industry, specified at a high level of generality, to the judicial exception, e.g., a claim to an abstract idea requiring no more than a generic computer to perform generic computer functions that are well-understood, routine and conventional activities previously known to the industry, as discussed in Alice Corp., 573 U.S. at 225, 110 USPQ2d at 1984 (see MPEP § 2106.05(d));
  • iii. Adding insignificant extra-solution activity to the judicial exception, e.g., mere data gathering in conjunction with a law of nature or abstract idea such as a step of obtaining information about credit card transactions so that the information can be analyzed by an abstract mental process, as discussed in CyberSource v. Retail Decisions, Inc., 654 F.3d 1366, 1375, 99 USPQ2d 1690, 1694 (Fed. Cir. 2011) (see MPEP § 2106.05(g)); or
  • iv. Generally linking the use of the judicial exception to a particular technological environment or field of use, e.g., a claim describing how the abstract idea of hedging could be used in the commodities and energy markets, as discussed in Bilski v. Kappos, 561 U.S. 593, 595, 95 USPQ2d 1001, 1010 (2010) or a claim limiting the use of a mathematical formula to the petrochemical and oil-refining fields, as discussed in Parker v. Flook, 437 U.S. 584, 588-90, 198 USPQ 193, 197-98 (1978) (MPEP § 2106.05(h)).

美國Copyright Office的生成式AI與著作權報告(1)

早在2023年美國聯邦記事(federal register March 16, 2023)就已經探討審查與註冊包含以AI技術生成的著作的政策。

到了上個月(May 2025),看到美國版權局發表「著作權與AI」的報告,這裡筆記第三部分 - Generative AI Training (pre-publication)  。

討論議題一:著作權保護的內容如何以及為何用於發展生成式人工智慧模型(generative AI model)?(以下為根據報告內容整理的重點)

I. 建立生成式AI的機器學習
機器學習的基本概念是使用輸入資料與期待的輸出資料形成的訓練集(training data)建立一個數學模型(statistical model),通過數學演算法學習歷史數據的特徵建立的模型能執行預測,經比對實際數據後,調整學習得出的模型,使之預測數據愈來愈接近實際數據。

根據以上簡單描述機器學習的概念,生成式AI是運用"使用神經網路(neural network)建立模型的機器學習演算法"生成的AI模型,神經網路的功能由參數(parameters/結構/數值)描述,用於定義輸入資料與輸出資料之間的映射關係(mapping of inputs to outputs),大量的參數形成神經網路計算高複雜度轉換演算的權重(weights)。(在此一提的是,一開始神經網路中各節點連結關係賦予隨機數值(權重),也不會產生/預測什麼有意義的資訊(與期待輸出值差很大),但隨之反覆地運算並調節權重,改善效能得出使神經網路轉換出貼近期待輸出值的權重值)最終,得出可以反映從訓練集中學習的模式(pattern)的神經網路的權重,並可將訓練好的權重建立的模型應用在產品中,不過其中運用的訓練集也面臨著作權人的檢視。

II. 訓練生成式AI模型所需的資料
所謂「生成式AI/Generative AI」是一種數學模型,以語言模型為例,可以根據「前言」計算出各種「後語」的機率後,從中(機率最高者)決定「後語」,並可依據提示語(prompts)繼續生成一連串內容。

生成式AI的運作是估算出"tokens"(代碼)的機率而決定輸出的文字,其中運用了通過事先賦予數值的字詞,也就是將語言轉換成數值形式,如向量值,所述代碼就是連接著每兩個向量值,通過代碼機率的演算決定/預測轉換輸出的字詞。

然而,生成式AI,如語言模型(language model),訓練過程需要使用大量文字、影像與聲音,如影像模型,訓練過程需要大量的文字與影像。訓練時需要將文字、影像與聲音轉換成代碼(tokens),這些訓練集(training data)引起著作權爭議。

III.訓練模型與訓練資料的關係
可以從各種來源取得訓練集(training data),常見的就是以爬蟲程式(web crawlers)從網路上下載公眾可取得的資料以及原本就存在的資料庫,如wikipedia、專利資料庫等,也包括圖書館、書本的檔案,還有特別經過授權取得的資料。

從各種來源取得的資料需要通過一個組織程序(curation process,包括篩選/filtering、清洗/cleaning與編譯/compiling)預備成為訓練模型的訓練集。

訓練模型的過程包括訓練階段(training phase,還可分為pre-training, post-training, fine-tuning)與記憶階段(Memorization)。

在此一提的是,OpenAI稱在訓練階段耗費最大量的運算與儲存資源,以教導模型語言、文法與推理;在記憶階段並不是複製資料,而模型中的權重僅是大量反映出訓練代碼中資料統計關係的數值串。(不過,新聞與媒體聯盟(News/Media Alliance)認為,如果是這樣,為何AI生成的內容會是逐字一樣的內容,不論其中運算做了什麼,效果與記憶與保存是一樣的。)

當然,生成式AI不可能自己隨意生成內容,一定是訓練過程決定其輸出應為正確且貼近原意,因此生成(同過數值演算、模式/pattern設定)的內容應該要與原本來源一致或接近才對。這也導致了著作權爭議。

IV.在生成式AI系統中部署模型
在實際應用時,使用者不會直接與數學模型互動,這些模型是部署在AI系統中,其提供了軟體工具與使用者介面(如ChatGPT APP/webpage)。

模型輸出與其使用了什麼訓練集有關,並讓模型運作時仍擷取除了原本訓練集以外的內容,如擷取增強生成(retrieval-augmented generation,RAG)技術,許多模型運用搜尋引擎使用RAG,也就是在模型運行時,產生系統執行的查詢(query)將最高排序的結果以擴展的提示語回饋給模型,再輸出給使用者。

舉例來說,當詢問一個問題給生成式AI,生成式AI助理(Claude)即詢問外部搜尋引擎,取得搜尋結果的前幾名,如取自一些網站的文章,生成問題的答案。上述在訓練語部署生成式AI時取得的資料與內容,都是用來強化模型的能力。

基於以上描述為何生成式AI會涉及著作權保護的內容,包括訓練模型用的資料與部署模型時運用的外部資料。

討論議題二:是否有侵權行為?

著作權法(Copyright Act)賦予著作權人的權利包括再製(reproduce)、散布(distribute)、公開展演(publicly perform)與公開展示(publicly display)其創作,並及於衍生的創作(derivative works)(編按,參考我國著作權法:利用衍生著作之人,應取得衍生著作及原著作之著作財產權人之授權)。

建立侵權的表面證據(prima facie case of infringement)有兩個要件:(1)有效著作權的所有人身分(ownership of a valid copyright);(2)複製原創作品的構成要素(copying of constituent elements of the work that are original)。

建立與部署生成式AI的幾個階段中可能會使用"有著作權保護的內容",可能涉及多種侵害他人權利的法規,建立與部署生成式AI的幾個階段包括:(1)資料收集和管理(Data Collection and Curation);(2)訓練(training);(3)擷取增強生成(RAG);(4)輸出(output)。

(1)資料收集和管理(Data Collection and Curation)
在此階段是要建立訓練模型的訓練集(training dataset),包括下載資料、轉換資料成為不同格式的內容,例如向量演算、篩選內容以及修改,將會觸及內容的「重製權(right of reproduction),即便有許多資料在蒐集後會被拋棄(但有可能保留在資料庫),都可能面臨侵權的問題。

(2)訓練(training)
在訓練模型之前,建立的訓練集會有「重製權」的爭議,在訓練過程中,其中內容同樣會被批次(in batches)重製,或有一段時間持有被著作權保護的內容,面臨著作權侵權的疑慮;訓練過程也將迭代地更新模型的權重(weights)以優化效能,權重會涵蓋訓練集中有著作權保護的內容,因此最終使用這些權重的人(如OpenAI的企業客戶)都有可能涉及著作權爭議。

舉例來說,生成式AI會根據使用者輸入的提示語(prompts)而生成圖案,即便生成式AI再厲害,也不會無中生有(有學者提出:"a model is not a magical portal that pulls fresh information from some parallel universe into out own."),因此這些圖案可能與訓練過程中使用的訓練集中的影像一致,也就觸及著作權侵權的議題。


另外有人主張,很多數位檔案是被加密與壓縮儲存的,這些內容不會被直接理解,因此直接侵權的內容應該是固定的、可被理解、重製或被傳遞的。

進一步地,模型中的"權重"記憶從訓練集的特定表示式(經過抽象化/abstraction或是轉換),因此有人主張模型中的權重並不直接包含訓練集的內容,而是通過抽象化過程從資料集學習/萃取資訊,不能表示被保護原始內容,但這樣仍可能侵害「衍生著作權(derivative work right)」。

在案例"Kadrey v. Meta Platforms"中,法院認為Llama模型侵犯衍生著作的主張是沒有意義的,但是,這是因為法院認定模型中運用的資料是經過抽象化的資訊,而此案例中的原告並沒有主張模型"可能會"吐出(spit out)被著作權保護的真實內容,或是輸出與原始著作權保護內容足夠相似的內容

在案例"Andersen v. Stability AI"中,法院否決了第三方(非原告或被告)提出撤銷訴訟的請願,此第三方並未參與模型的訓練過程,但下載並使用已經被訓練好的模型模型中事實上具有以特定格式存在的原始內容的副本或被保護的元件,因此,此案法院的判斷並同於上述Kadrey案中認為訓練與操作存在實質差異的決定。

USPTO基於以上法院意見,認為,判斷模型的權重是否涉及「重製權」或是「衍生著作權」,需要判斷是否模型保存或是記憶從原始內容得出實質可被保護的表示內容("substantial protectable expression from the work at issue"),從以上意見可知,在準備訓練集時使用的內容以及訓練模型都涉及"重製權",而使用最終得出的權重中僅實質相似的內容則會侵害著作權。

(3)擷取增強生成(RAG)
基本上,RAG會有兩種工作方式,第一種是AI開發者複製內容到擷取資料庫(retrieval database),生成式AI系統會存取資料庫以取得需要的內容,並隨著使用者的提示語(prompts)提供給AI模型;第二種則是生成式AI系統從外部來源(搜尋引擎或網站)取得內容。如此,RAG同樣會涉及著作權中的重製權。

ChatGPT相關專利審查與答辯筆記

OpenAI關於生成自然語言的專利之一:

US12008341: Systems and methods for generating natural language using language models trained on computer code

申請時Claim 1: computer-implemented method,另有system與non-transitory computer-readable medium including instructions that are executed by one or more processors to perform operations comprising... 。


這樣純軟體方法的專利範圍明顯會面對35U.S.C.101核駁意見:採用TWO-STEP專利適格性檢視法,以上步驟被視為抽象,是人類心智可以紙筆完成,屬於法定例外不予專利事項。


再者,也被判斷為沒有整合為具體的應用,判斷的方法就是查專利範圍中是否有額外元件(additional elements),審查意見指出專利範圍(claims 1, 19, 20)中的額外元件包括:"docstring generation model", "user interface", "non-transitory computer readable medium"等,但被視為僅是以一般目的電腦執行抽象概念,因此判定專利範圍沒有整合法定例外為具體的應用

審查意見也提到專利範圍中幾個步驟如"receive", "access", "output"等處理資料的步驟,僅是在法定例外上加入微不足道的額外解決活動(insignificant extra solution activity)。(編按,白話來說,就是整體專利範圍屬於抽象概念,沒有甚麼特徵形成有意義的限制!如此,僅是使用一般目的電腦的軟體發明是沒有進步概念的(inventive concept)

這麼厲害的答辯,等於將審查指南抄了下來,審查委員可能一時還不曉得怎麼辦,專利就准了。

AI生成的圖案的著作權議題 - 重製、改作或是合理使用(中華民國著作權法)

在此不專業地引用著作權法討論(僅用於自己理解):

從不少討論轉成特定風格的圖案的討論可知,AI生成的圖案沒有著作權,自己玩也沒有,甚至商業上使用AI生成特定風格的圖案也可以,因為風格不受到著作權法保護。著作權法保護的是著作人的著作(我國著作權法第10條),但「依本法取得之著作權,其保護僅及於該著作之表達,而不及於其所表達之思想、程序、製程、系統、操作方法、概念、原理、發現(我國著作權法第10-1條),就我個人的判斷,複製風格應該是著作權法不及於的「思想、概念」

只是爭議的是,AI(如ChatGPT)是因為學習了大量的特定風格的影像後才能幫助使用者生成相應風格的圖案,觸及的法律應該是AI是否合理使用特定風格的影像?

侵害著作權一般稱為「抄襲」,根據TIPO的解釋:https://www.tipo.gov.tw/tw/cp-180-219595-56bdc-1.html,通常所謂的「著作抄襲」,應該是指構成著作「重製權」或「改作權」的侵害,其中引用「最高法院81年度台上字第3063號」判決,其明確指出「認定抄襲之要件有二,即(1)接觸,(2)實質相似。

也就是說,要證明他人有「接觸」自己的著作,我想多數人應都接觸過吉卜力風格的著作;另一個是他人的著作與自己的著作構成「實質相似」。

若有「接觸」著作,就判斷是否「實質相似」,「實質相似」還要區分是否新的著作有自己獨立的創作在裡面,AI沒有人的思想,如果沒有獨立創作,AI生成「實質相似」的圖可能構成「重製權」的侵害,或是,如果有獨立創作,實質相似就構成「改作權」的侵害。

因此「像不像/實質相似」應該就是本次吉卜力著作權之亂的討論重點。

根據我國著作權法第44、45、50、52條規定,讓政府機關使用、為了報導;教學等目的,在特定條件下免責重製他人著作,但合理範圍並不及於"有害於著作財產權人之利益者"。(著作權法第44條:「中央或地方機關,因立法或行政目的所需,認有必要將他人著作列為內部參考資料時,在合理範圍內,得重製他人之著作。但依該著作之種類、用途及其重製物之數量、方法,有害於著作財產權人之利益者,不在此限。」)

根據不少的著作權法規定的『合理範圍』規定,個人使用並不構成著作權侵權,如我國著作權法第65、91條:「著作僅供個人參考或合理使用者,不構成著作權侵害。」

OpenAI雖可能喊冤,或是要求大家不要再要求生成吉卜力風格的圖案,但"...之亂"對於OpenAI、吉卜力(日本動畫)都是極好的行銷,讓全世界人都見識到大家的厲害。

如此,如果風格被模仿者認為其利益被害,應該是可以主張權利,例如主張不公平競爭、稀釋原創作價值...,可以通過調解、訴訟取得合理使用報酬。吉卜力工作室若感到權利被侵害,...可向OpenAI討個公道。

即便有以上的理解,不過最終還是要法院認定:
