犀牛盾 v. 惡魔殼「違反公平交易法」判決歷程筆記

之前的最高法院民事裁定報導:犀牛盾RHINOSHIELD v. 惡魔殼DEVILCASE「違反公平交易法」之判決 - 最高法院民事裁定113年度台上字第1585號(https://enpan.blogspot.com/2024/10/rhinoshield-v-devilcase-1131585.html)。

公平交易法第25條:

事業違反本法之規定,致侵害他人權益者,被害人得請求除去之;有侵害之虞者,並得請求防止之。

公平交易法第30條:
事業違反本法之規定,致侵害他人權益者,應負損害賠償責任。

公平交易法第31條
1. 法院因前條被害人之請求,如為事業之故意行為,得依侵害情節,酌定損害額以上之賠償。但不得超過已證明損害額之三倍。 
2. 侵害人如因侵害行為受有利益者,被害人得請求專依該項利益計算損害額。

判決:
1. 迪摩凱斯公司行銷、販售之系爭惡魔盾一代、二代手機殼抄襲系爭Mod NX手機殼整體外觀,屬足以影響交易秩序而顯失公平之行為,違反公平交易法第25條之規定。
2. 愛進化公司依公平交易法第30條、公司法第23條第2項之規定,請求迪摩凱斯公司、李哲緯應與上訴人迪摩凱斯公司連帶負損害賠償責任,為有理由,其損害賠償金額以100萬元為當。
3. 愛進化公司依公平交易法第29條之規定,請求迪摩凱斯公司排除及防止侵害,為有理由。
4. 愛進化公司依民法第195條第1項後段之規定,請求迪摩凱斯公司應於其官方網站及臉書社群網站粉絲專頁之貼文欄刊登本案民事判決當事人姓名、案由及主文,且此部分之貼文應設定為公開,其時間為自張貼上開貼文起1個月,為有理由。
5. 系爭Mod NX手機殼之「邊框背板模組化與厚度設計」外觀,不構成公平交易法第22條第1項第1款之著名商品表徵(證據不充分),迪摩凱斯公司、李哲緯行銷、販售系爭惡魔盾一代、二代手機殼,並未違反公平交易法第22條第1項第1款之規定。

3. 請求迪摩凱斯公司排除及防止侵害。
4. 要求在被告官方網站與社群網站公開判決。
5. 原告的「邊框背板模組化與厚度設計」外觀,不構成公平交易法第22條第1項第1款之著名商品表徵。

判決:
1. 被上訴人與上訴人迪摩凱斯國際股份有限公司均係從事生產、銷售手機保護殼商品之業務,所訴求之消費者相同,營銷管道亦類似,彼此間具有公平交易法第4條所規範之競爭關係。
2. 被上訴人於107年8月行銷販售適用於iPhone XR、iPhone 11、iPhone 11 Pro、iPhone 11 Pro Max手機之Mod NX系列手機保護殼,詎迪摩凱斯公司陸續於108年1月、109年9月間行銷販售所示之手機保護殼,高度抄襲系爭Mod NX手機殼整體外觀設計,其相關之背板圖樣等配件亦有類似情事,消費者在異時異地隔離觀察,確有產生混淆誤認之虞 ... 對消費者而言足以構成混淆,難以分辨其間差異。
3. 迪摩凱斯公司之高度抄襲行為,不僅攀附被上訴人公司商譽,亦係以不當競爭手段影響相關消費者之交易決定,足以影響整體交易秩序而屬顯失公平之行為,構成公平法第25條規定之禁止行為,被上訴人得請求排除及防止侵害,迪摩凱斯公司與其負責人即上訴人李哲緯並應就被上訴人所受損害連帶負賠償責任 ...被上訴人請求上訴人連帶賠償新臺幣100萬元本息。

PHG factors - PHG Technologies, LLC v. St. John Companies, Inc. (Fed. Cir. 2006)

回頭看看2006年PHG factors,這個判斷系爭設計是否是功能性的方式仍適用於現在侵權判斷,如之前討論的案例 -“普通觀察者比對非功能性元件”是評斷設計侵權與否的準則 - Range of Motion Products, LLC v. Armaid Co. (Fed. Cir. 2026)(https://enpan.blogspot.com/2026/09/range-of-motion-products-llc-v-armaid.html)。

被告/上訴人:ST. JOHN COMPANIES, INC.
原告/被上訴人/專利權人:PHG TECHNOLOGIES, LLC
系爭設計:D496,405、D503,197
判決日期:November 17, 2006

案件源起地方法院對被告St. John的侵權行為發出初步禁制令(preliminary injunction),被告上訴CAFC。

PHG擁有的系爭設計關於醫院用的識別標籤,分別如下:

D503,197(標籤圖樣)

以上兩件設計看來是同一的醫療用的標籤產品,主要視覺特徵是一半以上的平均寬度的表格,最後兩行有些高度與寬度的變化,甚至還有申請相應的發明專利(09/952,425
),這件發明案之後成為系爭設計是否有效的證據之一。被告St. John販賣這類標籤,原告PHG於2004年在系爭設計尚未核准公告前對被告發出警告信,但被告不理會並繼續販售被告侵權的標籤。到了2005年系爭專利領證後,原告即向被告提出侵權告訴。

基於被告St. John在接獲警告信後繼續販售被告侵權產品,PHG向法院提出對被告侵權產品的初步禁制令請願,防止繼續販售侵權產品。St. John則向法院提起反訴,主張系爭設計主要是功能性的特徵並提出系爭設計相應的發明專利申請案‘425的審查歷史中的證據;反之,PHG在答辯中引述共同發明人的證詞,說明醫療標籤表的實現設計很多,選擇目前系爭設計的理由是「“most aesthetically pleasing to us”」(最具有美感)。(updated on Sep. 21, 2026)

地院說明PHG系爭設計可區隔先前技術的裝飾性外觀
本案系爭設計經被告St. John主張為功能性特徵,法院仍是同意PHG的意見,表示(1)系爭設計的外觀並非由其功能所支配;(2)強調設計的標籤表格的下方兩行大小不同的標籤與排列是裝飾性的;(3)設計發明人考量很多排列方式後選擇系爭設計的樣子是基於是最流暢最好看的(“the best flow and look”);(4)系爭設計的新穎特徵是底部多種大小標籤的擺設,並區隔先前技術。

地院說明侵權成立理由
(1)“普通觀察者”眼光來看難以辨識出系爭設計與被告侵權產品的差異;
(2)被告侵權產品"瓢竊"了PHG的“與先前技術區隔”的設計,也就是“底部多種大小標籤的擺設”。

法院發出初步禁制令理由
地院判決侵權成立,並認為(基於原告的證據)如果不發出“禁制令”會造成無法恢復的損害,並考量原告(勝訴)成功合理的可能性(reasonable likelihood of success),因此同意發出暫時禁制令以阻止被告繼續販售被告侵權產品。

(補充)依照前例 - Amazon.com, Inc. v. Barnesandnoble.com, Inc., 239 F.3d 1343, 1350 (Fed. Cir. 2001),是否發出初步禁制令有四個考量:
(1)專利權人成功的可能性(指訴訟成功/證明侵權的可能性);
(2)如果沒有禁制令會造成無法恢復的損害;
(3)平衡訴訟雙方處境;
(4)關於公眾利益。

被告St. John上訴CAFC。

CAFC階段:
CAFC法官需要審理:基於上述考量是否需發出初步禁制令,以及被告須建立專利無效的實質問題(substantial question of invalidity)。

被告St. John引用系爭設計相應的發明專利申請案'425答辯中的聲明,藉此證明系爭設計中與先前技術區隔的特徵在其申請人答辯中證明是功能性的特徵。

原告自然是拿地院判決當作依據,認為系爭設計中不同尺寸的標籤是裝飾性的特徵,並認為被告考量設計中單獨的特徵,而非對設計外觀的整體。

這時,考量系爭設計的整體(as a whole - its overall appearance)是否是受到其功能性的支配("dictated by functional considerations")?經參考多件前例,考量因素包括:


整理出PHG factors: 
(1)是否受保護的設計代表了最好的設計;
(2)是否有替代設計讓指定的物品的功效產生不利影響;
(3)是否有伴隨發明專利; 
(4)有否廣告吹捧設計具有的特定功能;以及
(5)是否設計中有任何元件或整體外觀明顯非由功能決定?

經法院審理,上述系爭設計的標籤底部有些變化的標籤符合「腕帶大小的標籤/wristband-sized label」,如此可判斷系爭設計中底部的標籤有高度與寬度的變化,這證明系爭設計這部分的標籤尺寸變化是功能性的,而其餘規則排列的標籤就是醫療運用的一般標籤,這樣使得法院判斷PHG理由不成立。

就侵權判斷而言,根據上述討論,系爭設計中能與先前技術區隔的新穎特徵屬於功能性的特徵,使得整個系爭設計沒有非功能性特徵來界定專利範圍,也就不能進行侵權分析,因此CAFC沒有對侵權議題進行審理。

CAFC判決原告PHG沒有建立第一個初步禁制令的因素 - 也就是沒有證明「原告訴訟勝訴的可能性」,判定地院錯誤同意原告請求的初步禁制令,因此撤回地院同意初步禁制令的決定。

my two cents:
本案例除了建立了到現在都是實用的PHG factors外,還提醒設計強調的是“裝飾性”,而如果有一間對應的發明專利案,發明專利一般強調的是“功能性”,本案特別的是以發明專利強調的功能證明系爭設計的特點是“功能性”的,使得系爭設計面對缺乏與先前技術區隔的裝飾性外觀的困境。

設計專利侵權判斷要點筆記

本篇筆記我國專利侵權判斷要點之「第二篇 設計專利侵權判斷」,之前也有個筆記:我國專利侵權判斷要點 - 筆記(https://enpan.blogspot.com/2026/05/blog-post.html),本篇針對設計專利作一點摘要。

設計專利侵權判斷流程大致上與發明、新型相當,同樣採用「兩階段」判斷流程,第一階段確定專利權範圍,第二階段為比對、判斷確定後之專利權範圍與被控侵權對象。然而設計專利範圍以圖面外觀為主就有獨特性,比對與解析被控侵權對象的判斷原則差不多。

解釋設計專利範圍的原則:
1. 以圖式為準:設計專利權範圍由外觀及物品共同確定。
2. 審酌說明書:確定專利權範圍,得審酌說明書所載之內容,包括設計名稱(確定物品)、物品用途(輔助確定物品)及設計說明(說明外觀創作特點)。
3. 整體原則:在確定專利權範圍時,應綜合圖式各視圖所揭露的形狀、花紋、色彩等全部內容構成一設計。
(強調的是,說明書僅係輔助說明圖式所揭露的內容,不能取代圖式;即便說明書有記載,但沒有呈現在圖中,不算是專利權範圍。)

另可考量:
(1)繪製設計專利圖式時之通常方法,例如虛線在圖式中所代表之意義;
(2)申請歷史檔案中有關確定專利權範圍的部分;及
(3)就設計專利圖式所揭露的設計特徵,區分視覺性特徵及純功能性特徵。

設計專利侵權判斷流程(TIPO註解:流程中「物品是否相同或近似」、「外觀是否相同或近似」及「是否適用申請歷史禁反言或先前技藝阻卻」之判斷並無先後順序關係。):

第(1)步驟:對照專利權範圍中之物品及外觀,解析被控侵權對象中對應之設計內容。
第(2)(3)步驟:判斷被控侵權對象與系爭專利之“(2)物品”與“(3)外觀”是否相同或近似,如果兩者既不相同也不近似,即未構成侵權。
第(4)步驟:在上述相同或近似的比對過程中,可以判斷是否適用申請歷史禁反言或先前技藝阻卻。
(若查申請歷史判斷已經構成“申請歷史禁反言”,則相關議題(專利特徵)就不適用“均等論”;若沒有構成申請歷史禁反言,還有主張“先前技藝阻卻”的答辯機會,被控侵權人可擇一主張或一併主張。)
第(5)步驟:在上述第(2)(3)步驟,搭配第(4)步驟的適用主張,若判斷系爭設計與被控侵權對象“物品”與“外觀”為相同或近似,即判斷被控侵權對象構成侵權 。

外觀之相同或近似判斷原則:
1.直接觀察比對。普通消費者選購商品之消費型態,係以肉眼直接觀察、比對商品。
2.整體觀察、綜合判斷。觀察系爭專利圖式中各視圖所揭露之形狀、花紋、色彩所構成的整體內容與被控侵權對象中對應該圖式之設計內容。
3.視覺印象,也就是觀察容易引起注意的部位或特徵。判斷被控侵權對象與系爭專利之外觀是否近似時,得依該專利產品之性質、功能限制、先前技藝及共通形態等因素,考量二者之差異對於被控侵權對象之整體視覺印象的影響。
4.其他因素:
(1)當系爭設計特徵純粹是功能性,非透過視覺訴求的創作,不應考量「純功能特徵」。
(2)系爭設計的圖式包括文字、數字、商標或記號,應視為花紋,不考慮其隱含的意思。
(3)具變化外觀的設計,應以所有變化狀態共同構成專利權範圍。

三方比對法:
係判斷被控侵權對象與系爭專利是否近似的輔助分析方法,藉由先前技藝分析系爭專利所屬技藝領域之先前技藝狀態及三者之間的相似程度,輔助判斷被控侵權對象與系爭專利之整體外觀是否近似。

(1)若被控侵權對象與系爭專利的相似程度比起「系爭專利與先前技藝的相似程度」更為接近;且被控侵權對象與系爭專利的相似程度比起「被控侵權對象與先前技藝的相似程度」亦更為接近時,得判斷被控侵權對象與系爭專利之外觀近似。
(2)若被控侵權對象具備系爭專利明顯不同於先前技藝的設計特徵時,可考慮設計特徵是否會使被控侵權對象與系爭專利產生混淆之視覺印象為斷,不得僅因欠缺或稍 加改變任一設計特徵,即認定二者之外觀不近似。

“普通觀察者比對非功能性元件”是評斷設計侵權與否的準則 - Range of Motion Products, LLC v. Armaid Co. (Fed. Cir. 2026)

CAFC En Banc(08/11/2026)駁回侵權訴訟原告Range提起CAFC重審以及全院聯席重審的請求(The petition for rehearing en banc is denied),理由是:"There is no need to overrule a prior holding of this court.",因此案件以CAFC於年初02/o2/2026的判決作為結論:同意地方法院在評估系爭設計與被告侵權設計之間"整體"的相似性來考量兩者之間的相似與差異,而這個整體相似性的判斷是以熟悉先前技術的普通觀察者來查驗是否有被欺瞞或被誘使購買以為是某來源的商品。

本案「Range of Motion Products, LLC v. Armaid Co. (Fed. Cir. 2026)」案件資訊:

本案源起專利權人ROM於2021年4月在地方法院以系爭設計'155對被告Armaid提起侵權告訴,並主張初步禁制令請願,但被駁回,於是雙方協議撤銷訴訟。但隔年,ROM又以相同系爭設計對Armaid再提起侵權告訴,在解釋設計專利範圍階段,地方法院將設計的特徵中分辨出功能性元件與裝飾性元件,判定'155有許多設計特徵是功能性的,因此其中可以主張權利的裝飾性特徵變得很窄,經比對被告侵權產品 - Armaid2,地院判決侵權不成立。

在1990年代曾販售過前一代(Armaid1),並且有對應發明專利US5,792,081(編按,確實是比較"古典")

針對地院判決侵權不成立,原告上訴CAFC,原告/專利權人ROM主張地院解釋專利範圍時"錯誤地"將“結構元件”(功能元件)從設計移除;還認為即便地院正確地解釋專利範圍,'155與Armaid2實質相似。

地院認定為系爭設計的按摩器的雙臂的“形狀”是功能性的,CAFC同意地院把按摩器的“雙臂”形狀當作功能性元件,也不是如ROM認為將全部功能性元件都移除。這裡重申設計侵權的兩步驟判斷法:
(1)先確認設計專利範圍,就是看圖面(illustration),法院也認為沒有圖僅用說明的無法理解設計範圍;
(2)再比對被告侵權設計。

其中即基於幾篇前討論的案例 - Egyptian Goddess Inc. v. Swisa, Inc. (Fed. Cir. 2008)的判決意旨:比起文字描述,設計範圍的解釋較佳地是基於圖面(illustration)的表示,判斷設計侵權與否,則以普通觀察者(定義為熟悉先前設計的人/消費者)的眼光判斷是否造成混淆來斷定。

Egyptian案例討論:普通觀察者是否被欺瞞的設計侵權判斷原則 - Egyptian Goddess, Inc. v. Swisa, Inc. (Fed. Cir. 2008)(https://enpan.blogspot.com/2026/09/egyptian-goddess-inc-v-swisa-inc-fed.html)。

一件設計往往包括了功能性與非功能性元件,設計專利範圍需要識別出非功能性的特徵,法院引用過去案例中提出的幾個判斷“功能性/非功能性”元件的方法,這裡提到案例Sport Dimension    (1997),以及PHG Techs. (Fed. Cir. 2006)。

雖年代不同,但仍可參考:設計專利範圍解釋 - Sport Dimension, Inc. v. Coleman Co., Inc. (Fed. Cir. 2016)(https://enpan.blogspot.com/2016/05/sport-dimension-inc-v-coleman-co-inc.html)。

"whether the protected design represents the best design; whether alternative designs would adversely affect the utility of the specified article; whether there are any concomitant utility patents; whether the advertising touts particular features of the design as having specific utility; and whether there are any elements in the design or an overall appearance clearly not dictated by function."

PHG factors:
  1. 是否受保護的設計代表了最好的設計;
  2. 是否有替代設計讓指定的物品的功效產生不利影響;
  3. 是否有伴隨發明專利;
  4. 有否廣告吹捧設計具有的特定功能;以及
  5. 是否設計中有任何元件或整體外觀明顯非由功能決定?

在本案中,CAFC引用前例PHG說明判斷設計中的功能性元件:這樣設計是否是最好的?是否有替代設計對其功能產生不好的影響?是否有任何關聯的發明專利(發明功能往往界定的是功能性的特徵)?是否有特別強調設計具有特定功能的廣告?以及是否有任何設計元件或是整體外觀非由功能決定?

(編按,就此最近案例來看,顯然用PHG判斷方法判斷功能性元件是現行在用的。)

法院參考上述Armaid1(第一代)的對應發明專利US5,792,081,也具有可以按著四肢的雙臂結構,因此認定雙臂為功能性元件,也就是CAFC同意地院將按摩器的雙臂當作功能性元件的判斷。(編按,查設計中的功能元件的有效證據就是看看前案有沒有!!!也查到ROM相關產品在廣告中也有強調這雙臂的“功能”。)


如此已經判斷出系爭設計的非功能性部分,再來就是比對被告侵權產品,原則是以普通觀察者的眼光來看,如果兩者實質相同到會以為買的產品是另一個來源的,侵權成立。主要引用前例就是以上提到的Egyptian。

然而,即便已分辨出設計中的功能性與非功能性元件,在設計比對時並非僅比對裝飾性(非功能性)元件而已,而是整體來比。


這裡提到兩個情況:
1. 從外觀來看系爭設計與被告侵權設計明顯不同 ("sufficiently distinct" and "plainly dissimilar"),侵權不成立。
2. 如果兩者並非明顯不同("not plainly dissimilar"),這是就要以先前技術(prior art, 非限制設計)來比系爭設計與被告設計,藉此識別出抽象不易察覺但對普通觀察者而言卻值得注意的(noticeable)差異("identify differences that are not noticeable in the abstract but would be significant to the hypothetical ordinary observer familiar with the prior art")。

從Egyptian判決節錄:


因此,很明確的設計侵權判斷方法,先辨明出設計的功能性與非功能性元件,再以普通觀察者比對兩個設計是否實質相同,當設計之間非明顯差異時,會比對先前技術,讓熟悉先前技術的普通觀察者可以得到值得注意的差異。

雖有反對意見認為就讓普通觀察者直接比對兩個設計是否相同來判斷侵權與否,但CAFC反對這個過度簡化的侵權設計判斷方式("reject the proposal to establish that amounts to an oversimplified version of the ordinary observer test"),因為其中並未解釋專利範圍,也沒有考量設計中功能元件會讓設計之間都很像的問題。

三個物件對比:

經比對,廣義來看,整體設計是相似的,根據地方法院的判斷,確實很像,但是是在功能性的特徵上,因此侵權比對應以對設計特徵有貢獻(增添設計元素)的裝飾性元件來看。


地院根據以上原則得出系爭設計與被告設計的差異:
(1)D'155採用固定臂,Armaid2的半矩形鉸鏈裝置佔很大的比例。
(2)D'155有整體分離的外觀。
(3)整體來看,Armaid2有較大的槽
(4)Armaid2的鉸鏈裝置有更圓滑的末端。



CAFC同意地院判決 - 侵權不成立。

my two cents:
就我的眼光來看,D'155與Armaid2的外觀確實很像,細看是有一些比例不同的元件,如果法院要說服我,或說我們,對此商品可能沒以太多理解的人,確實需要許多論述... 許多... 但這些論述是否僅是一個合理化,但至少有意義,並且建立往後案件可遵循的方法。

根據此案例,就想到CAFC曾經拋棄的「新穎特徵 / point of novelty」判斷原則,兩者雖不同,但有點像。在此釐清,新穎特徵原則是要比對先前技術而釐清新穎特徵,再以此新穎特徵(讓普通觀察者來看)比對被告設計。而本篇提到的原則,是要先得出“非功能性”特徵,以此裝飾性的元件比對被告設計,倒不用比對先前技術來確認。

普通觀察者是否被欺瞞的設計侵權判斷原則 - Egyptian Goddess, Inc. v. Swisa, Inc. (Fed. Cir. 2008)

[前言]
本篇討論關於判斷設計專利與被告設計之間差異的標準的經典案例「Egyptian Goddess, Inc. v. Swisa, Inc., 543 F.3d 665 (Fed. Cir. 2008)」,那為何要研究本案?

下篇要討論的 - Range of Motion Products, LLC v. Armaid Company Inc. (Fed. Cir. Feb. 2, 2026,此案在CAFC En Banc聯席法官否決複審(The petition for rehearing en banc is denied)後,確立CAFC在Feb. 2, 2026的判決,其中特別引用本篇Egyptian判決。

判斷設計侵權的步驟簡單地說就是先確認設計專利範圍,也就是基於本篇討論的案例 - Egyptian Goddess Inc. v. Swisa, Inc. (Fed. Cir. 2008)的判決意旨:比起文字描述,設計範圍的解釋較佳地是基於圖面(illustration)的表示,判斷設計侵權與否,則以普通觀察者(定義為熟悉先前設計的人/消費者)的眼光判斷是否造成混淆來斷定。

"a design is better represented by an illustration ‘than it could be by any description and a description would probably not be intelligible without the illustration."



另一理由是,因為發現原本想要理解的前例(即Litton Systems, Inc. v. Whirlpool Corp. (Fed. Cir. 1984))被此案例某種程度的"否決",因此就來看看,這都是想要涵蓋各種案例(企圖如此)的本部落格漏掉的一塊。

參考本案例之前的"前例":

其中提到:
"於1984年CAFC案例Litton v. Whirlpool認為1871最高法院建立的「ordinary observer」是否有混淆(消費者購買侵權物誤認為購買具有專利的產品)的侵權判斷標準並不足夠,而是應該要確認設計專利相較於先前技術「具有新穎性的部分」是否有混淆來進行侵權比對。"

其中提到:
"縱使法院參考Groham前例以普通觀察者的眼光比較設計與產品,但為了確認侵權,法院還是引入了「新穎特徵」( "point of novelty" approach)的判斷方法,也就是普通觀察者判定的"相似性"仍應基於這個新穎特徵來判斷。"

基於前述兩個先例,本案例提出新的見解(否決新穎特徵測試),也是目前主流判斷原則,先提出本案在rehearing en banc結論:

案件資訊:

EGI的系爭設計'389為一種磨指甲/拋光的工具(nail buffer),特別如下圖顯示是中空管狀方形內徑的工具,因為美國設計專利通常不用太多的文字說明,以圖為準,但法院審理時仍提供了文字解釋,甚至尺寸細節都估計出來:


在地院階段,兩個議題:系爭設計無效爭議與侵權爭議。地院判決被告Swisa並未證明系爭設計拋光工具的外觀是由其實用目的所支配(dictated by its utilitarian purpose),因此地院判決系爭專利有效。而對於被告提起侵權不成立簡易判決(summary judgment of non-infringement)請願,地院引用前例要求原告需證明:(1)以“普通觀察者”(ordinary observer test)眼光,認知被告侵權產品與系爭設計實質相似;(2)被告侵權產品“實質相同”系爭設計能區隔先前技術的“新穎特徵”(point of novelty)。

根據上述兩點,地院判決被告侵權產品並沒有涵蓋系爭設計的“新穎特徵” -- 上述系爭設計圖案中「拋光工具裸露出沒有被磨砂層覆蓋的第四面」,因此侵權不成立。

EGI上訴CAFC,CAFC同意地方法院的侵權不成立的判決 - 沒有事實證明Swisa產品使用了系爭設計的新穎特徵。

甚至CAFC還進一步解釋「新穎特徵/point of novelty」可以是單一設計元素,或是一些習知設計分別具備的元素的新的組合,而此組合並非是微不足道的。


在此新穎特徵的攻防中,原告EGI列出幾項特徵的組合(如:開放與中空主體、正方形截面、隆起的長方形磨具、暴露出的角落等),法院進一步與先前技術(Nailco)比對從中得出新穎特徵 - 長方形主體(編按這裡判決文好像有錯,寫成三角形),而又認為陪審團不會認同說這個新穎特徵相對先前設計是重大的進步(non-trivial advance)。

經考量先前技術判定的非重大進步("non-trivial advance"test),CAFC認為被告侵權產品與系爭設計的差異並非微小(Swisa拋光器是四面都有磨具),因此同意地院判決而判決侵權不成立。

CAFC於2007判決:

然而,本案進入en banc(原告提CAFC複審請願被否決),但en banc同意審理,參考CAFC提出反對意見的法官DYK,見解如下:DYK不同意採用"non-trivial advance"測試作為設計基於新穎特徵的侵權判斷方法,認為這個測試與前例不一致,也沒有支持的前例,且混淆了侵權標準與設計顯而易見性的判斷,DYK認為
"non-trivial advance"測試僅針對有多個元素組合的設計,在本案不是拿來評估"設計整體"的顯而易見性,而是不當地用於評估"每個新穎特徵"的顯而易見性。


據此,法院受理rehearing en banc(全院聯席重審),各方提出幾個議題:
1. 是否要繼續使用「新穎特徵」檢視設計侵權案?
2. 是否法院應採用"non-trivial  advance test"作為判斷是否特定設計特徵為"新穎特徵"的手段?
3. 如何進行新穎特徵測試?特別是當設計的複數個特徵不同於先前設計時。
4. 是否地方法院在審理設計專利案時應執行正式的專利範圍解釋?

en banc對各議題的意見:

1. 是否要繼續使用「新穎特徵」檢視設計侵權案?

法院參照案例Gorham Co. v. White, 81 U.S. 511 (1871)意旨,分析設計專利侵權,就看設計的外觀,其中線條、結構上的細微差異都不影響實質的相同/不相同。視覺效果的一致性就是判斷兩個設計是否實質相同的主要標準("sameness of effect upon the eye, is the main test of substantial identity of design")。

法院也提到前例Litton的判決:不僅要以普通觀察者查看設計的相似度,也要得出特定新穎特徵,但en banc認為判斷設計的新穎特徵不容易,特別是在設計往往是由多個特徵組成,並不容易逐一判斷是否為設計的新穎特徵。

法院藉此案讓大家重新考量使用「新穎特徵」的侵權判定方式,新穎特徵判斷與普通觀察者測試是平行的方式,也就是沒有需要兩段式判斷侵權案件。

編按,兩段式是,普通觀察者查看設計外觀是否有欺瞞消費者以為購買了某一來源的商品;再看被告商品是否具有設計專利的新穎特徵。

2. 是否法院應採用"non-trivial  advance test"作為判斷是否特定設計特徵為"新穎特徵"的手段?

基於被告Swisa認為法院不能拋棄新穎特徵測試,但法院(en banc)不同意,只不過最終判決仍是對被告有利的結果。

法院(en banc)明確表示不使用non-trivial advance test,而這是新穎特徵測試(point of novelty test)的進一步測試,都不再使用,僅採用普通觀察者的測試法則。


本議題後面一段也頗為精彩,談到可能訴訟雙方都會尋求對自己有利的判斷法則,就討論到舉證責任,不翻譯了,呈現精彩原文:



3. 如何進行新穎特徵測試?特別是當設計的複數個特徵不同於先前設計時。4. 是否地方法院在審理設計專利案時應執行正式的專利範圍解釋?(一起理解)

不同於發明專利解釋專利範圍,其實法院並沒有被要求要解釋設計專利範圍,特別如美國最高法院已經認知設計最好的解釋就是看繪製的外觀,不會去特別解釋說明描述,也如同專利審查過程解釋設計專利範圍的方式。

"Given the recognized difficulties entailed in trying to describe a design in words, the preferable course ordinarily will be for a district court not to attempt to “construe” a design patent claim by providing a detailed verbal description of the claimed design."

但實務上,地方法院階段是由陪審團解釋專利範圍,雖然解釋設計的描述可能並不明智,但向陪審團描述法院自己的分析對於設計侵權判斷其中各種設計特徵仍有幫助。這裡特別列舉本案,可參考以下各圖比對,法院可以向陪審團指出設計特徵,如本案系爭設計只有三個面有磨具(拋光用的結構),但被告產品則四面都有磨具,還可指出先前設計(Falley、Nailco)的結構特徵。

下圖為法院將已知前案與被告商品(Swisa Buffer)與系爭設計('389)並排比較。


確實以上針對設計說明的解釋是對理解設計有幫助,但en banc仍認為對於設計專利的解釋,法院不應如以上逐字理解來解釋設計專利範圍。這當然跟法院僅採用普通觀察者的眼光來看設計是否侵權的方法有關。

法院進一步定義「普通觀察者/一般觀察者/ordinary observer」,並非是對此設計(磨指甲/拋光的工具(nail buffer))一概無知的人,而是對此類產品(先前的設計)有一定熟悉的消費者,也就是已經熟悉這裡提到的兩件先前設計-Falley與Nailco的普通觀察者。

en banc結論:
en banc採用不同於CAFC/地方法院的方法(需基於先前技術判斷新穎特徵的non-trivial advance test),而是以普通觀察者的測試方法(regular observer test,回歸Gorham法則)判定侵權不成立(無須先判斷新穎特徵),但沒有否認CAFC的方法,認為兩者是平行的測試方法。

然而,en banc"似乎"也承認/無法否定這件案子一脈相承都是先比對先前技術得出系爭設計的新穎特徵再判斷是否被告侵權產品有此新穎特徵來判斷侵權與否,使得即便en banc判定設計侵權僅會採用普通觀察者法則,即便採用不同的方法,仍同樣地判斷兩個設計之間差異不能說不小而判定侵權不成立。


一個熟悉先前設計的消費者(買者)沒有因為設計專利與被告設計的相似度而被欺瞞/誤認以為買了某一來源(原本想買)的產品,因此判定侵權不成立。


my two cents:
以上結論很簡單,產品設計是否有侵害某設計專利權,就以普通觀察者來看兩者的差異是否會造成購買商品的人誤認以為買了某來源的商品,而無須根據先前技術先判斷出新穎特徵,再以新穎特徵來確認被告商品是否有此特徵。

設計是否有專利性(新穎性、非顯而易見性等)的判斷不同侵權判斷,直接參考MPEP 1504 Examination,取得設計專利的要件須考量:裝飾性(ornamentality)、新穎性(novelty)、非顯而易見性(nonobviousness)、可實施性(enablement)與明確性(definiteness)。(參考:https://www.uspto.gov/web/offices/pac/mpep/s1504.html)

其中需要先判斷設計申請案的裝飾性特徵,所謂設計是針對裝飾目的的設計,而非針對功能或機構上的產品。設計專利權僅授與whoever invents any new, original, and ornamental design for an article of manufacture。也就是取得設計專利,要具備新穎且非顯而易知的裝飾性特徵,而此裝飾特徵還是要從設計整體來看,也就設計的主軸是以裝飾為出發點(primarily ornamental),並不是將設計拆解後分別功能性與裝飾性特徵,因此以實用性為出發點的產品外觀一般裝飾性並不強。

"A determination of ornamentality is not a quantitative analysis based on the size of the ornamental feature or features but rather a determination based on their ornamental contribution to the design as a whole."

1984年確立「新穎特徵基準」案例-Litton Systems, Inc. v. Whirlpool Corp. (Fed. Cir. 1984)

(編按,本篇僅提出討論,基於新穎特徵測試(point of novelty test)的設計侵權判斷已經不是主流原則,本篇報導主要是要帶出下一篇與下下篇的討論,到現代的案例中已經不太用"point of novelty" test。或說參考新穎特徵非主流,但仍有意義,如以下my two cents)

確定設計侵權判斷應基於「新穎特徵」的經典案例「Litton Systems, Inc. v. Whirlpool Corp., 728 F.2d 1423 (Fed. Cir. 1984)」,案件資訊:

Whirlpool對地院作出侵犯兩件系爭專利成立的判決提出上訴,其中還涉及專利有效性、虛假標示、不公平競爭等爭議。地院判決Whirlpool侵權成立以及判出損害賠償。(15 U.S. Code § 1125 - False designations of origin, false descriptions, and dilution forbidden)

系爭專利US3,843,859關於微波爐的"門",但因為相應的商品已經在專利申請前販售且超過一年,被判定專利無效。

有效性議題:
Whirlpool當庭主張系爭設計不具進步性(非顯而易知性),設計是否顯而易見的判斷是由相關領域一般技術人員比對先前技術與申請的設計的整體,這部分判斷原則與發明專利無異,都是採用Graham判斷步驟。對此,Whirlpool一口氣提出7件前案,其中有GE、Sharp的微波爐產品。

Graham是有點經驗的人都知道的103前例,有許多參考資料,其中之一:Graham v. John Deere Co. 判例(https://enpan.blogspot.com/2012/10/graham-v-john-deere-co.html):
  1. Determining the scope and contents of the prior art.(確認前案的範疇)
  2. Ascertaining the differences between the prior art and the claims at issue.(查明權利範圍與前案的差異)
  3. Resolving the level of ordinary skill in the pertinent art.(分辨發明相關領域的一般技術水平)
  4. Considering objective evidence present in the application indicating obviousness or nonobviousness.(考慮申請案中顯而易見或非顯而易見的的客觀證據)
    這部份也就是日後稱為Graham factors -- secondary considerations:商業上成功、解決長期未解決的需求、克服別人的失敗

事實上,在產品比對設計圖面時,都可以找到一些差異,基於Graham判斷步驟,其中考慮客觀證據的部分,專利權人Litton主張「商業上的成功」,這個主張之前需要先證明商業上的成功是基於此「設計」,而不是其他因素。經法院審理後,認為雖專利對應商品在商業上成功,卻無法證明與其設計有關。

"... evidence of commercial success must clearly establish that the commercial success is attributable to the design, and not to some other factor, such as a better recognized brand name or improved function... there is no evidence attributing this success to the Litton design. Thus, the evidence of commercial success is of no help to Litton in this case."

在系爭設計的有效性判決上,地方法院認同系爭設計是採用一種"輕量"的門,但CAFC認為這個判斷沒有根據。特別的是,Whirlpool提出的意見是將系爭設計拆分成多個獨立部件,再證明每個部件都各別出現在先前技術中,但法院睿智地認為一件設計/發明都是許多先前技術的組合,有新的部分也有舊的部分,這樣比對並沒有意義。法院雖認為Litton的設計與先前技術之間有許多相似之處,但也不認同Whirlpool的意見,判定系爭設計有效。

侵權議題:
關於侵權,CAFC法官引用100多年前的最高法院案例 - Gorham Co. v. White, 81 U.S. (14 Wall.) 511, 20 L. Ed. 731 (1871) :一個普通觀察者(ordinary observer),如消費者,經仔細觀察後,發現兩個設計實質上相同,而且其相似性足以欺瞞消費者(普通觀察者)以為買了某個商品來源的商品,則可判定設計侵權成立。

""if, in the eye of an ordinary observer, giving such attention as a purchaser usually gives, two designs are substantially the same, if the resemblance is such as to deceive such an observer, inducing him to purchase one supposing it to be the other, the first one patented is infringed by the other.""

然而,縱使法院參考Groham前例以普通觀察者的眼光比較設計與產品,但為了確認侵權,法院還是引入了「新穎特徵」( "point of novelty" approach)的判斷方法,也就是普通觀察者判定的"相似性"仍應基於這個新穎特徵來判斷。

"That is, even though the court compares two items through the eyes of the ordinary observer, it must nevertheless, to find infringement, attribute their similarity to the novelty which distinguishes the patented device from the prior art. (This "point of novelty" approach applies only to a determination of infringement."

(編按,以普通觀察者判斷侵權的案例名稱是Groham,但顯而易見性判斷步驟案例是Graham,歷史也是頗幽默的。)

於是,法院基於設計專利中的「新穎特徵」(這些也是系爭設計有效的依據)- 微波爐外部的條紋門框、無把手的門以及控制面板上的桿子等,經比對被告侵權產品,判定Whirlpool商品並沒有這些特徵,侵權不成立。

CAFC否決地院判決,作出系爭專利中的發明專利無效、Whirlpool設計侵權不成立、Whirlpool並無虛假標示(False designations of origin)等訴訟不成立判決。其中發明專利無效是因為專利權人的對應商品販售時間在專利申請前超過一年。

my two cents:
雖然「point of novelty」 approach不被現在法院採用,但是我仍認同其中的意義:當被告商品在市場上有許多的相似商品(如本案的微波爐),也有許多的設計專利,當要判斷其中之一設計與其中之一商品是否"相似",用其中的新穎特徵來比對算是頗為合理的方法。

美國設計的圖式範例與規定 - 筆記

實務上,「美國設計申請案」規定是比其他各國更嚴格,要求比較多,從範例來看看美國設計專利的規定。

Straight-line surface shading(直線表面陰影)

The design must be represented by a drawing that complies with the requirements of § 1.84 and must contain a sufficient number of views to constitute a complete disclosure of the appearance of the design. Appropriate and adequate surface shading should be used to show the character or contour of the surfaces represented. Solid black surface shading is not permitted except when used to represent the color black as well as color contrast. Broken lines may be used to show visible environmental structure, but may not be used to show hidden planes and surfaces that cannot be seen through opaque materials. Alternate positions of a design component, illustrated by full and broken lines in the same view are not permitted in a design drawing. Photographs and ink drawings are not permitted to be combined as formal drawings in one application. Photographs submitted in lieu of ink drawings in design patent applications must not disclose environmental structure but must be limited to the design claimed for the article.

II. SURFACE SHADING

While surface shading is not required under 37 CFR 1.152, it may be necessary in particular cases to shade the figures to show clearly the character and contour of all surfaces of any 3-dimensional aspects of the design. Surface shading is also necessary to distinguish between any open and solid areas of the article. However, surface shading should not be used on unclaimed subject matter, shown in broken lines, to avoid confusion as to the scope of the claim.

Lack of appropriate surface shading in the drawing as filed may render the design nonenabling and indefinite under 35 U.S.C. 112(a) and (b), (or for applications filed prior to September 16, 2012, pre-AIA 35 U.S.C. 112, first and second paragraphs). Additionally, if the surface shape is not evident from the disclosure as filed, the addition of surface shading after filing may comprise new matter. Solid black surface shading is not permitted except when used to represent the color black as well as color contrast. Oblique line shading must be used to show transparent, translucent and highly polished or reflective surfaces, such as a mirror. Contrast in materials may be shown by using line shading in one area and stippling in another. By using this technique, the claim will broadly cover contrasting surfaces unlimited by colors. The claim would not be limited to specific material either, as long as the appearance of the material does not patentably depart from the visual appearance illustrated in the drawing.

III. BROKEN LINES

The two most common uses of broken lines are to disclose the environment related to the claimed design and to define the bounds of the claim. Structure that is not part of the claimed design, but is considered necessary to show the environment in which the design is associated, may be represented in the drawing by broken lines. This includes any portion of an article in which the design is embodied, or applied to, that is not considered part of the claimed design. See In re Zahn, 617 F.2d 261, 204 USPQ 988 (CCPA 1980). Unclaimed subject matter may be shown in broken lines for the purpose of illustrating the environment in which the article embodying the design is used. Unclaimed subject matter must be described as forming no part of the claimed design or of a specified embodiment thereof. A boundary line may be shown in broken lines if it is not intended to form part of the claimed design. Applicant may choose to define the bounds of a claimed design with broken lines when the boundary does not exist in reality in the article embodying the design. It would be understood that the claimed design extends to the boundary but does not include the boundary. When a boundary line is introduced via amendment or in a continuation application, the introduction of the boundary line must comply with the written description requirement of 35 U.S.C. 112(a) (or for applications filed prior to September 16, 2012, pre-AIA 35 U.S.C. 112, first paragraph). See In re Owens, 710 F.3d 1362, 1366-67, 106 USPQ2d 1248, 1251 (Fed. Cir. 2013). For example, unclaimed boundary lines should satisfy the written description requirement where they make explicit a boundary that already exists, but was unclaimed in the original disclosure. See Owens, 710 F.3d at 1368-69, 106 USPQ2d at 1252. Where no boundary line is shown in a design application as originally filed, but it is clear from the design specification that the boundary of the claimed design is a straight broken line connecting the ends of existing full lines defining the claimed design, applicant may amend the drawing(s) to add a straight broken line connecting the ends of existing full lines defining the claimed subject matter where such amendment complies with the written description requirement of 35 U.S.C. 112(a) (or for applications filed prior to September 16, 2012, pre-AIA 35 U.S.C. 112, first paragraph). Additionally, any broken line boundary other than a straight broken line may constitute new matter prohibited by 35 U.S.C. 132 and 37 CFR 1.121(f).

The two most common uses of broken lines are to disclose the environment related to the claimed design and to define the bounds of the claim. Structure that is not part of the claimed design, but is considered necessary to show the environment in which the design is associated, may be represented in the drawing by broken lines. This includes any portion of an article in which the design is embodied, or applied to, that is not considered part of the claimed design. See In re Zahn, 617 F.2d 261, 204 USPQ 988 (CCPA 1980). Unclaimed subject matter may be shown in broken lines for the purpose of illustrating the environment in which the article embodying the design is used. Unclaimed subject matter must be described as forming no part of the claimed design or of a specified embodiment thereof. A boundary line may be shown in broken lines if it is not intended to form part of the claimed design. Applicant may choose to define the bounds of a claimed design with broken lines when the boundary does not exist in reality in the article embodying the design. It would be understood that the claimed design extends to the boundary but does not include the boundary. When a boundary line is introduced via amendment or in a continuation application, the introduction of the boundary line must comply with the written description requirement of 35 U.S.C. 112(a) (or for applications filed prior to September 16, 2012, pre-AIA 35 U.S.C. 112, first paragraph). See In re Owens, 710 F.3d 1362, 1366-67, 106 USPQ2d 1248, 1251 (Fed. Cir. 2013). For example, unclaimed boundary lines should satisfy the written description requirement where they make explicit a boundary that already exists, but was unclaimed in the original disclosure. See Owens, 710 F.3d at 1368-69, 106 USPQ2d at 1252. Where no boundary line is shown in a design application as originally filed, but it is clear from the design specification that the boundary of the claimed design is a straight broken line connecting the ends of existing full lines defining the claimed design, applicant may amend the drawing(s) to add a straight broken line connecting the ends of existing full lines defining the claimed subject matter where such amendment complies with the written description requirement of 35 U.S.C. 112(a) (or for applications filed prior to September 16, 2012, pre-AIA 35 U.S.C. 112, first paragraph). Additionally, any broken line boundary other than a straight broken line may constitute new matter prohibited by 35 U.S.C. 132 and 37 CFR 1.121(f).

However, broken lines are not permitted for the purpose of indicating that a portion of an article is of less importance in the design. See In re Blum, 374 F.2d 904, 153 USPQ 177 (CCPA 1967). broken lines may not be used to show hidden planes and surfaces which cannot be seen through opaque materials. The use of broken lines indicates that the environmental structure or the portion of the article depicted in broken lines forms no part of the design, and is not to indicate the relative importance of parts of a design.

In general, when broken lines are used, they should not intrude upon or cross the showing of the claimed design and should not be of heavier weight than the lines used in depicting the claimed design. When broken lines cross over the full line showing of the claimed design and are defined as showing environment, it is understood that the surface which lies beneath the broken lines is part of the claimed design. When the broken lines crossing over the design are defined as boundaries, it is understood that the area within the broken lines is not part of the claimed design. Therefore, when broken lines are used which cross over the full line showing of the design, it is critical that the description of the broken lines in the specification explicitly identifies their purpose so that the scope of the claim is clear. As it is possible that broken lines with different purposes may be included in a single application, the description must make a visual distinction between the two purposes; such as --The broken lines immediately adjacent the shaded areas represent the bounds of the claimed design while all other broken lines are directed to environment and are for illustrative purposes only; the broken lines form no part of the claimed design.-- Where a broken line showing of environmental structure must necessarily cross or intrude upon the representation of the claimed design and obscures a clear understanding of the design, such an illustration should be included as a separate figure in addition to the other figures which fully disclose the subject matter of the design. Further, surface shading should not be used on unclaimed subject matter shown in broken lines to avoid confusion as to the scope of the claim.

The following form paragraphs may be used, where appropriate, to notify applicant regarding the use of broken lines in the drawings.

The design must be represented by a drawing that complies with the requirements of § 1.84 and must contain a sufficient number of views to constitute a complete disclosure of the appearance of the design. Appropriate and adequate surface shading should be used to show the character or contour of the surfaces represented. Solid black surface shading is not permitted except when used to represent the color black as well as color contrast.
