認識專門校對專利英文稿件的外國人
有些公司也有雇用外國朋友校稿，我們公司就有！
常常從他們身上學到很多東西
當漂亮的英文與Claim的英文相遇時，有否掙扎？
我的外國朋友就有，但其實兩者並不相違背！專利說明書或是申請範圍還是可以用漂亮的英文撰寫，尤其是Claim，我希望我有能力可以討論英文Claim的撰寫，然後分享
因為平常都有與同事或是長官討論這類問題，累積了不少之知識 看看嘍！
以下分享一點點小問題：
"the center of a disc" 的"center"是否需要在第一次出現時使用"不定"冠詞 "a"
當然 以不要挑戰審查委員或是希望案子順利進行的話 加上"a"應是不會錯
只是"不漂亮"
其實 審查委員不一定正確，我們就常常質疑審查委員的判斷標準不一
每次OA都是充滿機會的，原因是每個審查委員有不同的標準
我們常常需要想到審查委員的主觀判斷
雖然 就事務所角度 應該是讓案子順點好 順著審委的動作好些！
只不過 正確的觀念還是一定要有的
M.P.E.P 2173.05(e) 規定有關前述基礎的判斷
Inherent components of elements recited have antecedent basis in the recitation of the components themselves. For example, the limitation "the outer surface of said sphere" would not require an antecedent recitation that the sphere has an outer surface. See Bose Corp. v. JBL, Inc., 274 F.3d 1354, 1359, 61 USPQ2d 1216, 1218-19 (Fed. Cir 2001) (holding that recitation of "an ellipse" provided antecedent basis for "an ellipse having a major diameter" because "[t]here can be no dispute that mathematically an inherent characteristic of an ellipse is a major diameter").
簡單來說
就是與生俱來(inherent)的特徵不需要用"a"，因為它是definite的！
有個原則：
If the scope of a claim would be reasonably ascertainable by those skilled in the art, then the claim is not indefinite.
