一些設計專利圖說的筆記

設計專利以圖說為申請專利範圍，美國設計專利不用過多描述，僅表明每一張圖的意義即可，不過中華民國設計專利卻要求有「說明書」與「圖式」：
中華民國設計專利審查基準有云：
『申請設計專利應備具說明書及圖式，以明確且充分揭露申請專利之設計（claimed design）；其中，說明書應載明設計名稱、物品用途及設計說明。』

然而重點應該在「圖」，「說明書」部份則是希望限定專利範圍在特定領域、用途與特定物品上，而解釋專利範圍時，「說明書」僅為參酌。如何解釋設計專利範圍，專利法第136條第2項有云：
『設計專利權範圍，以圖式為準，並得審酌說明書。』

如最新審查基準第三篇第一章「說明書及圖式」的內容提到：
『設計專利權範圍，以圖式為準，並得審酌說明書。因此設計之圖式係界定申請專利之設計的主要基礎，於解釋申請專利之設計時，應綜合圖式中各視圖（包含立體圖、六面視圖、平面圖、單元圖或其他輔助圖）所揭露之點、線、面所構成一具體設計，並得審酌說明書中文字記載之內容，據以界定申請專利之設計的範圍。』


到了美國，仍需要說明書（description），不過一切從簡，僅需表明各圖的意思，舉一些例子，可以為參考（多數時候，用抄的比較不會錯！）：

「一般產品外觀的設計需立體圖、六面視圖的描述」

FIG. 2 is a front view for the electronic device holder shown in FIG. 1.
FIG. 3 is a rear view for the electronic device holder shown in FIG. 1.
FIG. 4 is a left side view for the electronic device holder shown in FIG. 1.
FIG. 5 is a right side view for the electronic device holder shown in FIG. 1.
FIG. 6 is a top view for the electronic device holder shown in FIG. 1; and,
FIG. 7 is a bottom view for the electronic device holder shown in FIG. 1.

「部份設計專利需要表明虛線部份非主張範圍，電腦圖符不需各角度圖式」
The FIGURE is a front view of a display screen or portion thereof with icon showing my new design.
The broken line showing of a display screen or a portion thereof and the line around the icon forms no part of the claimed design.

「電腦圖形使用者界面的設計仍可能為部份設計專利，同時可以表示多種實施例（使用的方式）」

FIG. 1 is a front view of a display screen portion thereof with a graphical user interface showing our new design;
FIG. 2 is a front view of a second embodiment thereof;
FIG. 3 is a front view of a third embodiment thereof;
FIG. 4 is a front view of a fourth embodiment thereof;
FIG. 5 is a front view of a fifth embodiment thereof; and,
FIG. 6 is a front view of a sixth embodiment thereof.
The broken line showing of display screens, portions of display screen, text and graphical elements form no part the claimed design.

「一個裝置的設計可以表明某些線條並非是裝置而已」
The shade lines in the Figures show contour and not surface ornamentation.


「設計有時是在微小的地方，可以以放大圖表示」
 FIG. 9 is an enlarged elevational view of a representative corner of the electronic device.


「動態圖形變化的設計專利可以表示這些圖示為循序變動」

FIG. 1 is a front view of a a display screen or portion thereof with animated graphical user interface showing a first image in the sequence showing our new design;
FIG. 2 is a second image thereof; and,
FIG. 3 is a third image thereof.
The broken lines in the Figures show portions of a display screen or portion thereof with animated graphical user interface and portions of the display screen or portion thereof which form no part of the claimed design.
The appearance of the animated images sequentially transitions between the images shown in FIGS. 1-3. The process or period in which one image transitions to another forms no part of the claimed design.


「如果其中包括色彩，應敘明」
The patent file contains at least one drawing executed in color. Copies of this patent with a color drawing will be provided by the Office upon request and payment of the necessary fee.

「圖中若有省略的部份也應表示，比如一條線用省略記號表示」
FIG. 1 is a top plan view of a headset showing my new design, the cord in all views is drawn broken away to show indeterminate length;


「一個物品有多種使用狀態也可表示在圖說中，比如一個折疊式手機的開啟與關閉」
