Cap Export, LLC v. Zinus, Inc. (Fed. Cir. 2022)案件資訊：

本案判決一開始說到本案已經三次上訴，主要上訴人是Zinus，主要議題是對於地方法院針對「on-sale bar」的「102(a)(1),(b)(1)」專利無效簡易判決。
系爭專利'123關於一種床墊支撐（mattress support）：
1. A mattress Support comprising:
(1) a longitudinal bar with a first connector and a second connector, aheadboard with a compartment and a third connector; and
(2) a footboard with a fourth connector, wherein the first connector is adapted to attach to the third connector, wherein the second connector is adapted to attach to the fourth connector,
(3) wherein legs are attached to a bottom side of the footboard,
(4) wherein the longitudinal bar and the footboard fit inside the compartment of the head board,
(5) wherein the first connector is directly connected to the third connector, and the second connector is directly connected to the fourth connector in an assembled state of the mattress support,
(6) wherein the first connector is not connected to the third connector, and the second connector is not connected to the fourth connector in a compact state of the mattress Support, and
(7) wherein the longitudinal bar and the footboard are contained inside the compartment in the compact state of the mattress Support.
本案經來來往往攻防後，最新的議題是「on-sale bar」，Cap Export提起系爭專利無效的證據是名稱為「Mersin」床，由Woody Furniture賣給Zinus/Mr. Lawrie，並且是在系爭專利"Critical date"（一般是指優先權日的前一年）之前就有此販售行為，Zinus似乎默認這個在專利申請前的商業販售行為，但有個特別的爭議是：
Zinus提出，系爭產品"Mersin"床的組裝說明書有錯，其實是另一個床組"Fusion"床的組裝說明。更者，Zinux提出其行銷主管的聲明，她的工作是監視同行競爭者的產品，特別是網路上的，她認為床組"錯放"為不同版本的組裝說明書並非少見（"not uncommon"）。
特別的是，各方一致認為"Fusion"床的組裝說明書完全對應到系爭專利claim 1的所有元件，因此"Mersin"床的組裝方式（涉及結構特徵）是否與"Fusion"床一樣變成很重要的侵權判斷根據。Zinus的答覆是"Mersin"缺乏系爭專利claim 1中的特定組裝元件或步驟：
此圖是法院提出的"Fusion"床的圖式，其中橫木的一端有向下轉彎的垂片（tab），並連結一個托架（bracket），但Zinus宣稱"Mersin"床並沒有這個結構，因此"Mersin"床與"Fusion"床不同，表示"Mersin"床與系爭專利範圍不同。
然而，地方法院是同意Cap Export的說法，也就是，"Fusion"床的組裝說明書適用"Mersin"床，也就證明Zinus系爭專利申請前（critical date以前）已經商業販售對應產品"Mersin"床。
Zinus上訴CAFC。
違反新穎性的on-sale bar觸發的條件是，在critical date以前(1)已經商業販售，並且(2)也預備要取得專利。
Zinus主張，在地方法院審理過程其實是有許多的爭議，地院不應以簡易判決做出結論，也否決了其他審判，也就是認為地院在on-sale bar判斷上過於草率。其中主要爭議是，放在"Mersin"床組中的組裝說明書是錯放了"Fusion"床的說明書，而且經過上圖比對證明"Mersin"床與"Fusion"床不同。
結果是地院認為沒有理由說Fusion說明書不能適用Mersin，但卻忽略了許多事實證據，還有證人的說法，CAFC認為此簡易判決不當。
"The district court reviewed the evidence and concluded that no reasonable jury could find that the Fusion instructions do not apply to the as-sold Mersin bed."
最終，Cap Export提出"Fusion"床與"Mersin"床連結的證據，這算是很重要的事實，但地院僅以簡易判決（summary judgment）終結審判，排除進一步的審判程序。其中事實的爭議在於，是否"Mersin"床與跟系爭專利請求項一致的"Fusion"床一樣？是否Cap Export有更多證據？
因為地院簡易判決不當，CAFC發回地院重審。
my two cents:
結構專利範圍因為涉及具體設計，或者比較沒有較廣專利範圍的解釋空間，本案至少是一個個元件對應被告侵權產品，或是相似產品，如果結構特徵不同，即便用了比較上位的寫法或是說明，都有可能被解釋比較細節而攤出來比對。
