MPEP 1825 The Drawings

第一部分為PCT的圖式規定：

• 圖式在多數專利中為必要，除了部分化學案可能不需要之外，審查委員可以要求申請人提出。
• 流程（flow sheet）與圖表（diagram）應視為圖式。
• 圖式檔案頁面大小應為A4（29.7 cm x 21 cm）。
• 圖式頁的邊界規定：
  每頁圖面不應超過26.2 cm x 17.0 cm
  最小邊界為：
  - top: 2.5 cm
  - left side: 2.5 cm
  - right side: 1.5 cm
  - bottom: 1.0 cm
• 除必要為了方便理解的文字外，圖中應不能包括文字。
• 流程圖、電路圖、方塊圖可以有文字。
• 文字不可干擾圖面。

圖示規定中，要求圖示品質，與美國過去幾百年來「手繪」圖示的要求不同，例如要求耐用（durable）、足夠密的黑色、厚度均勻和明確的線條，不要有色彩（PCT不准有彩色圖，US除非有必要）。

補充：MPEP規定「設計專利」除非有必要（需要請願），否則應該用黑白圖。（"The Office will accept color drawings or photographs in design patent applications only after the granting of a petition filed under 37 CFR §1.84(a)(2), explaining why the color drawings or photographs are necessary. "）

在很少的情況，有需要的話，可使用彩色圖，仍需要足夠品質與細節，這裡也提到PCT不允許彩色圖。
（"(b) Color. On rare occasions, color drawings may be necessary as the only practical medium by which to disclose the subject matter sought to be patented in a utility or design patent application or the subject matter of a statutory invention registration. The color drawings must be of sufficient quality such that all details in the drawings are reproducible in black and white in the printed patent. Color drawings are not permitted in international applications (see PCT Rule 11.13), or in an application, or copy thereof, submitted under the Office electronic filing system."）

其他規定：

• 橫截面應以斜線表示。
• 圖式中圖案在尺寸縮小至三分之二仍能分辨其中細節。
• 圖式中文字、數字應簡單明瞭，不混用括號、引號與文字。
• 圖中文字使用拉丁文和常用希臘字母。
• 一張圖紙可包含幾個圖。
• 如果兩張或多張圖形形成一個完整的圖形，則畫在幾張紙上的圖形應設置成可以組成這個完整圖形的樣態。
• 一個圖紙不應浪費空間。
• 不同的圖式應以阿拉伯數字連續編號，與紙張編號無關。
• 專利說明書未描述的元件就不要在圖中標示，反之亦然，圖中沒有標示的部分不用在說明書描述。
• 同一特徵（在不同圖中）應使用相同標示。
