蘋果的捲動彈回的歐洲專利狀況 - 岌岌可危

捲動彈回專利（rubber-banding patent）的專利家族：

US7469381（381專利，申請號：11/956,969，早期公開號：US2008/0168404）是一個引用至少6件2007年提出的美國臨時申請案（provisional）的專利案，如果加上與其他家族的聯繫，相關專利家族遍及全世界，依照EPO專利家族資料檢索顯示，此案家族成員達470多件專利！可見APPLE對此觸控專利家族的重視，算是APPLE的命脈！

相對於多數國家法院/專利局認定此專利無效（多為異議程序），美國專利局則是維持了幾項範圍有效，而最近的歐洲專利局判斷歐洲專利EP2126678為無效專利。

381專利對應的歐洲專利為EP2126678（FOSS Patents寫錯號碼，但連結正確）：
Claim 1表示如何根據觸控位置與文件邊緣、翻動邊緣等特徵決定方向。
1. A computer-implemented method, comprising:
at a device with a touch screen display,
detecting a movement of an object on or near the touch screen display;
in response to detecting the movement, translating an electronic document displayed on the touch screen display in a first direction;
in response to an edge of the electronic document being reached while translating the electronic document in the first direction while the object is still detected on or near the touch screen display, displaying an area beyond the edge of the document; and
after the object is no longer detected on or near the touch screen display, translating the document in a second direction until the area beyond the edge of the document is no longer displayed.

歐洲專利局採用以下先前技術：
（引證一）PCT Publication No. WO 03/081458 on "controlling content display", by AOL/Luigi Lira (usually just referred to as "Lira" in court documents)

（引證二）Amy Karlson et al., AppLens and LaunchTile: Two Designs for One-Handed Thumb Use on Small Devices, CHI 2005, April 2-7, 2005, Portland, Oregon, USA (typically just referred to as "LaunchTile")

引證一是America Online公司的PCT專利申請案，優先權溯及2002的多件專利申請案，其中是揭露了頗為炫目與傳神的觸控螢幕操作畫面，揭露內容描述了顯示畫面與文件的比對，也就是在瀏覽文件時，會考慮顯示畫面的寬度，並據以反應出翻動到邊界時的動作以及可視區，以及相關動畫。這算是揭露了所謂rubber-banding的基本動作，甚至更為細節。

引證二為一個有關如何以一隻手指操作小裝置（PDA、手機）的技術刊物，文件日期在2005年4月（http://www.cs.umd.edu/hcil/jazz/learn/papers/chi-applens-launchtile.pdf）
其中揭露兩種操作方法，包括縮放與翻動：

除了先前技術的阻礙外，歐洲專利局更質疑這件專利技術是否為可專利標的，質疑其中文件邊緣、使用者輸入等動作都是非技術特徵...，這樣也算是提醒我們，技術特徵應該是討論這些訊號（觸控、文件size、方向判斷）的處理，而非直接描述使用者動作與畫面流動的特徵。
