發明專利權為申請日起20年，這是通則，例外是需要檢驗的藥品、植物以及經過期限調整（PTA）的專利。如果原始專利過期，如何延續專利權，如果找到新用途，則是一種方向，例如本篇討論Esketamine藥品的專利，面臨的阻礙就是102問題就是了。
Ketamine（K他命）開發之初為醫療（麻醉）用途，但是因為會產生幻覺，則多數使用在動物身上，人類使用則是在多數國家被列為三級毒品。Ketamine的合成溯及到1962年，最早專利則是溯及比利時1963年專利（Belgian patent no.634208），1966年在美國獲准專利（U.S. patent 3254124），1971年獲得德國專利（German patent 2062620），1970年在美國FDA核准上市。（資料來源：WHO）
這回Johnson & Johnson（嬌生）公司在美國與歐洲藥品管理局提出「Esketamine」抗憂鬱藥申請，這是一種K他命（Ketamine）形式的藥，

最早的US20130236573揭露一種用於治療憂鬱症的Esketamine（Esketamine for the treatment of treatment-refractory or treatment-resistant depression），顯然就是一種「使用發明」，目前專利審查狀態在9/9/2016最終審查意見（Final Office Action），面臨的就是「新穎性（102）」核駁意見，前案包括US20090306137，以及引用wikipedia所揭露的Esketamine。
請求項始終不變：
請求項1界定一種治療難治或耐藥性憂鬱症的方法（新的醫療用途），方法就是對病患施以有療效的劑量的Esketamine。
"1. A method for the treatment of treatment-refractory or treatment-resistant depression comprising administering to a patient in need thereof, a therapeutically effective amount of esketamine."
所面對的102前案為US20090306137（憂鬱症治療）如下：
"1. A method for treating one or more of major depression, obsessive-compulsive disorder, panic disorder, social anxiety disorder, social phobia, post-traumatic stress disorder, premenstrual dysphoric disorder, postpartum depression, major depression, dysthymia, treatment-resistant major depression, treatment-resistant bipolar disorder, and generalized anxiety disorder, or a symptom thereof, in an animal comprising internally administering to the animal an effective amount of Iloperidone or an active metabolite thereof."
my two cents:
新的用途，特別是新的醫療用途，應該是可專利的，經典的如「威而剛」專利（US6469012），這回Esketamine不准專利，還是因為有相關前案而定，但是發明人仍在答辯中，爭議包括Wikipedia的時間是否在系爭案的申請日前，以及引用前案是否採用如Ketamine成份的藥。
如果核准K他命為抗憂鬱藥，應該會有新聞出來，拭目以待吧！
