英國取消omnibus請求項寫法

英國發布修法，其中一個重點是，撰寫請求項範圍時，原本頗為特殊的規定 - 綜合性的請求項（omnibus claim）撰寫方式要被拋棄了，除非這是必要的寫法。所述綜合性的請求項就是直接在請求項中引述一或多張圖式的寫法。

拋棄這種請求項形式的理由大約就是與EPO不同調，感覺怪怪的，還有範圍邊界比較不明確等，事實上，世界上多數國家無法接受這種寫法，根據網路資訊，目前接受Omnibus請求項的國家剩下紐西蘭與南非，澳大利亞與加拿大則是為「除非必要，否則也不接受」的態度。

自2017/4/6開始，英國專利就不准使用"omnibus claims"寫法。
"From 6 April 2017 it will generally no longer be allowable to include omnibus claims in UK patent applications."

如果請求項範圍不能以文字、數學或化學式表示，還能採用omnibus claims。
"They will only be allowed if the technical features of the invention cannot otherwise be clearly and concisely defined using words, a mathematical or chemical formula or any other written means."

現在開始，審查委員會以objections通知申請人不要使用omniblus claims，2017/4/6後，不能修改核准專利加入omnibus claims。現行核准專利不會要求撤除這樣的專利範圍。
"Furthermore, from 6 April 2017 it will no longer be possible to amend a granted patent to insert an omnibus claim."

紐西蘭智慧局網站中公佈的審查指南中，第39章規範專利說明書內容很豐富，有空可以查閱，教導大家如何撰寫說明書，以及各種描述方式的申請專利範圍，例如：開放式/封閉式專利範圍、product-by-process、請求項中的商標表示、請求項中的"功效描述"（可能會導致不明確）、功能用語、Markush Claims、Omnibus Claims、專利範圍可及之處（reach through claims）、用途發明（suitability for use）等。

其中Omnibus Claims的描述：所謂Omnibus請求項為引用說明書中實施例或圖式的請求項範圍，並不是直接描述技術特徵。早先的法院判決承認Omnibus請求項。如果在Omnibus請求項中使用"substantially"等用語產生過廣的限制，並不適當，因此如此導致沒有限定在某個實施例中，表示涵蓋到整個說明書內容，更表示涵蓋了說明書中所揭露的先前技術。Omnibus請求項可以依附另一非Omnibus請求項。

範例："An apparatus substantially as herein described with reference to the figures and/or examples"。

範例："An apparatus of claim 1 substantially as herein described with reference to the figures and/or examples"。
