採用經過合約約束的平台架構的軟體侵權議題 - Caddo Systems, Inc. v. Siemens Aktiengesellschaft (AG) (Fed. Cir. 2023)

在合法平台下架構的軟體可以免除專利侵權 - 

案件資訊:

案件緣起專利權人Caddo等對Siemens提起專利侵權訴訟,地方法院根據Caddo與Microsoft之前訴訟的和解合約作出簡易判決:Caddo I: Caddo Systems, Inc. v. Siemens Aktiengesellschaft (AG) (N.D. Ill. Feb. 11, 2022):Siemens AG's motion to dismiss for lack of personal jurisdiction is granted缺乏個人管轄權)。本次2023年判決也是因為缺乏個人管轄權(personal jurisdiction)判決撤銷對Siemens的告訴(Caddo II),事實上Caddo II涉及兩個議題:採用經過合約約束的平台架構的軟體的侵權議題以及個人管轄權

Caddo對上述兩個判決提起上訴。

系爭專利有六件,US7,191,411為最早專利,其餘為接續案。'411揭露一種圖形使用者介面顯示的多層折疊選單結構(multi-level hierarchical collapsing menu structure),每個項目對應一個功能、位置指標(pointer)其他層的指標。


既然這是Microsoft公司和解的案子,顯然是值得參考的專利(純軟體專利,我猜微軟"不方便"質疑專利適格性,怕是影響這類專利的標準,也會影響到自己!),Claim 1界定一種使用上述圖形化使用者介面的多層摺疊選單結構的導覽方法,所提出的選單中多層結構中的各種項目對應特定功能、位置與其他層的指標,導覽方法包括:(1)提供GUI選單系統,顯示各層項目;(2)自動建構主動路徑(Active Path)作為一序列階層主動連結(active link);(3)顯示主動路徑(Active Path),這樣可以讓預選的主動連結觸發同層的選單選項,但不會影響所顯示的主動路徑(Active Path)'411說明書定義Active Path:"Active Path (上圖100) is a graphical user interface enabling the user to directly access any of the hierarchical levels in a given path."。

1. A method for navigating within a multi-level hierarchical collapsing menu structure where each level in the menu contains plural items, each said item being at least one of a function, a pointer to a location, and a pointer to another level, said method comprising the steps of:
providing a graphical user menu system displaying the items of a given level and enabling selection thereof, wherein access of said given level requires sequential access of each of the levels preceding said given level in the hierarchy;
automatically constructing an Active Path as a sequence of hierarchical active links as items are selected using the graphical user menu system without the need for any additional interaction with the graphical user system, with one said active link corresponding to each of the items selected, each said active link being independently selectable thereby providing direct access to the hierarchical level from which the corresponding item was selected without the need to navigate using said graphical user menu system; and
displaying the Active Path as an alternative to the graphical user menu system for navigating the multi-level hierarchical collapsing menu structure after the user has finished selecting items using the graphical user system such that the Active Path is displayed after the multi-level hierarchical collapsing menu structure has collapsed;
wherein pre-selecting a given active link triggers the display of sibling menu items on the level associated with said given active link without disturbing the displayed Active Path.

侵權被告產品是「
Siemens Industry’s Desigo CC software and Siemens AG’s website」。

在Caddo I案中,Siemens被告產品是第三方廠商Telerik提供的軟體 - “RadBreadcrumb” software,而此軟體是架構在Microsoft的.NET及其子系統WPF(Windows Presentation Foundation)平台之上,此微軟的平台提供提供程式庫以建立使用者介面應用程式,所述“RadBreadcrumb” software就是使用.NET架構產生GUI互動元件。

根據上述關聯性,地方法院認為若沒有微軟的架構,上述被告軟體就無法運作,因此,基於微軟與Caddo之間的合約,其中包括授權、豁免、互不提告等協議,因此限制了Caddo了主張其專利權的權力。本案中Siemens的被告軟體為第三方產品,並架構在微軟的平台上,相互的關係判決文中用"combination, usage or aggregation(集成)"等用語。

如此,Siemens即拿出Caddo與Microsoft的合約主張被告產品是受到其中協議的保護,因為被告產品全部都是使用.NET架構,若沒有.NET就不能運作。地院在簡易判決中判定上述合約保護範圍涵蓋被告產品,使其排除侵權告訴。

CAFC法院同意上述地院判決,且判定Caddo並未提出證據證明被告侵權產品是否有任一部份沒有使用.NET,因此被告軟體可免除侵權告訴。

以上教導我們,當軟體架構在已經有合約約束的平台上時,也會受到合約中"互不提告"的協議保護。然而,其實若侵權事件並非發生在美國,美國法院甚至沒有管轄權。

接著是個人管轄權議題,其中涉及的問題是Siemens為德國公司,受到德國法律的管轄,而Siemens目前沒有美國辦公室與據點,也沒有美國員工。Siemens AG的網站主機在美國之外,其中沒有在美國買賣商品,明顯地,美國法院對其沒有個人管轄權,且對於被告侵權產品也沒有個人管轄權。

CAFC同意地方法院簡易判決,撤銷本次侵權訴訟。

專利答辯歷史影響形成"不會被勸阻結合先前技術"的結論 - Elekta Ltd. v. Zap Surgical Systems, Inc. (Fed. Cir. 2023)

本案例討論幾個經典的103議題 - 先前技術結合的動機,特別是一句話:相關領域技術人員因為理解先前技術的優點,因此不會因為有困難而被勸阻去結合相關前案,也因此判定結合這些前案具有成功的合理期待,以及。

Elekta Ltd. v. Zap Surgical Systems, Inc. (Fed. Cir. 2023)案件資訊:

系爭專利:US7,295,648(IPR2019-01659)

專利權人Elekta針對PTAB在IPR程序中作出系爭專利'648為顯而易見的最終決定提起上訴,其中議題涉及顯而易見性的先前技術結合動機(motivation to combine)以及成功的合理期待(reasonable expectation of success)。

系爭專利'648關於一種被離子輻射照射治療的方法,裝置就如一個線性加速度器(linear accelerator,稱"linac"),用於加速其中帶電離子,Claim 1界定一個離子輻射裝置,包括可旋轉的環形支撐、輻射源,通過重合的旋轉軸與支撐軸產生輻射光束。


1. A device for treating a patient with ionising radiation comprising:
a ring-shaped support, on which is provided a mount, a radiation source attached to the mount;
the support being rotateable about an axis coincident with the centre of the ring;
the source being attached to the mount via a rotateable union having a [sic] an axis of rotation
axis which is non-parallel to the support axis;
wherein the rotation axis of the mount passes through the support axis of the support and the radiation source is collimated so as to produce a beam which passes through the co-incidence of the rotation and support axes.

2019年,ZAP對系爭專利'648提起IPR程序,案件啟始後,PTAB判定系爭專利部分被挑戰請求項不具非顯而易見,引用前案為:US4,649,560 
(“Grady”); a publication, K.J. Ruchala et al., Megavoltage CT image reconstruction during tomotherapy treatments, PHYS. MED. BIOL. 45, 3545–3362 (2000) (“Ruchala”); and US4,998,268 (“Winter”)

Grady揭露安裝在可轉動支撐的滑臂上的X光管:

Ruchala揭露一種以Linac為基礎的斷層放射治療系統,如CT,病患在儀器當中,外部偵測器在旋轉以施藥到腫瘤上,強調設置不影響病患其他敏感結構。

Winter提供可精準定位以進行放射治療的CT掃描器,可同時拍攝與治療。

在IPR無效意見中,異議人ZAP提起眾多前案,
針對此挑戰,專利權人Elekta答辯認為相關領域技術人員沒有動機去結合這些前案也主張組合這些前案並沒有成功的合理期待。然而,PTAB在其最終決定中根據Grady、Ruchala與其他前案文獻的"組合"認為系爭專利被挑戰的專利範圍不具非顯而易見。

案件上訴CAFC,議題就是:"Whether a skilled artisan would have been motivated to combine references or would have had a reasonable expectation of success in combining references are questions of fact reviewed for substantial evidence."。

議題一:相關領域技術人員是否有動機結合先前技術?本案先前技術包括輻射放射攝影技術與放射治療。

先假定相關領域人員為具有一般常識、一般智慧與一般知識的創造力的人,且在顯而易見性上的判斷並非總要要求先前技術能明顯地具有結合的動機,因此其中涵蓋了審查人員主觀的判定。

就一般實務而言,答辯人要證明先前技術沒有結合的動機,就是主張這些前案沒有彼此需要,例如本案專利權人Elekta主張沒有必要將X光造影設備由線性加速度治療設備所取代,因為缺乏精度,如這段話:"According to Elekta, the Grady device is for imaging and does not contemplate a heavy linac or account for the lack of precision that would result from the linac’s additional weight."。

看來PTAB理解Elekta這段說明,但是卻認為線性加速度器在當時是已知,其中要解決的精度問題可以由機器手臂充分處理,且特別引用了系爭專利'648的審查歷史,認為專利權人當時並沒有主張排除造影設備為相關技術,且也認為在工程設計中,放射成像和放射治療設備具有高幾何精度,並引用ZAP專家證詞認為相關領域技術人員不會不去結合這些先前技術


PTAB判定相關領域一般技術人員可以理解先前技術運用三維操作的能力,因此不會因為難以容納線性加速度器而被勸阻(dissuaded)不去結合這些先前技術,或是說,因為精度的需求有動機去結合這些先前技術。


CAFC同意PTAB意見,除了基於事實證據外,也參考了系爭專利'648的審查歷史,其中特別的判斷依據是專利權人並沒有在審查過程中並沒主張所述成像設備不是相關前案~,因此使得PTAB審查人員與法官都判定因為沒有排除相關前案,也因此判定相關領域的人不會被勸阻結合先前技術的結論~

這也反映patently-o關於此案例的文章名稱:How Prosecution History Can Support a Motivation to Combine ? 

如此,這樣是否牽拖太過了?其實CAFC仍參照了其他前案的資訊,將上ZAP專家證詞有力地支持相關設備組合的需求與其可能性,因此判定多件先前技術有結合的動機以使系爭專利發明為顯而易知。


議題二組合這些前案是否有成功的合理期待?

所謂成功的合理期待,就是指相關領域技術人員是否對於結合先前技術能達成系爭專利具有成功的合理期待?("Reasonable expectation of success refers to the likelihood of success in combining references to meet the limitations of the claimed invention.")

這部分討論恐怕是更為主觀與隱含(implicit)的判斷,CAFC引用前先案例認為在此議題下,可以接受隱含的主觀意見。

在本案中,CAFC法官可以合理地領悟PTAB考量並隱含地基於前述結合的動機與相關證據斷定組合這些前案的成功的合理期待。

結論同樣地基於上述意見,相關領域技術人員因為理解先前技術的優點,因此不會因為有困難而被勸阻去結合相關前案


議題三:針對專利權人Elekta主張,即便PTAB認為有其隱含的發現,但沒有實質證據支持這個隱含的發現而有成功的合理期待。

CAFC的回應是,關於成功的合理期待的證據就如結合的動機的證據,其中參照了先前技術內容、相關領域一般技術人員的知識,以及相關案例,因此做出本案的結論:實質證據(substantial evidence)支持相關領域一般技術人員有成功的合理期待去組合先前技術(Grady and Ruchala

好吧,這些103議題都有很多不確定性,分析好多好多相關議題的案例,仍是"欣賞"其中的論述,但在自己心中都沒有定論,卻也學習很多答辯論證的方式。

日本自April 1, 2022後不再接受多項依附多項附屬項(補充資料)

還是要感謝網友「正義龍CYL」在本部落格「引用記載形式獨立項筆記(https://enpan.blogspot.com/2019/09/blog-post.html)」的回應(抱歉現在才看到,網友針對某篇地回應我只會在該文"跳出"到排行版才會看到~~~)。

該篇部落格提到「歐洲、日本是允許多項附屬項間之直接或間接引用」,但網友提醒「日本已經於2022.04禁止了多項附屬項依附多項附屬項 (包含直接或是間接)」。

再複習與提醒自己(我自己都忘了),日本專利局對於April 1, 2022當日或之後發明與新型專利申請案中多項附屬多項的請求項,將不審理其新穎性、進步性與明確性。

根據JPO官網公告修訂審查基準(examination guidelines)https://www.jpo.go.jp/e/system/laws/rule/guideline/patent/kaitei/rev_202204.html),從April 1, 2022之後將不接受「multi-multi」請求項。

The draft revision of the Examination Guidelines for Patent and Utility Model in Japan (hereinafter, simply referred to as the “Examination Guidelines”) has been prepared based on the discussions at the 16th meeting of the Working Group on the Patent Examination Standards supervised by the Patent System Subcommittee under the Intellectual Property Committee of the Industrial Structure Council. The public comments were invited from February 10 to March 11, 2022.

The Examination Guidelines related to Multi-Multi Claim Restriction is revised in light of the public comments.

(Note) The term "Multi-Multi Claim" as restricted by the revised Ministerial Ordinance means "any dependent claim that refers to more than one other claim in the alternative ("multiple dependent claim") which depends from any other multiple dependent claim."

The revised Examination Guidelines is applied to examination of the applications filed on or after April 1, 2022.


根據「Part II Chapter 2 Section 5 Ministerial Ordinance Requirement on Statement of Claims」(https://www.jpo.go.jp/e/system/laws/rule/guideline/patent/kaitei/document/rev_202204/02-02-5.pdf)規定,多項附屬項直接或間接依附另一多項附屬項將導致專利範圍不容易辨識的問題,即限制這類申請專利範圍。

關於一件具有「多實施例」的設計申請案

本篇筆記是基於USPTO的「設計專利申請指南」(https://www.uspto.gov/patents/basics/apply/design-patent)。

設計創作人在一件設計中,可能會同時提出修改方案,如果修改前後的設計彼此之間具有「專利性區隔(patently distinct)」,不屬於同一個設計概念(single design concept),應以不同設計申請案提出申請。

反之,如果修改前後的外觀仍在同一設計概念下,就可以用一件設計申請案提出申請,如此,一件設計申請案就會包括「多個實施例」,這是符合美國設計專利規定。(根據前篇報導,在其他國家都有不同的程序,在我國是衍生設計:https://enpan.blogspot.com/2017/06/blog-post_30.html)。

所述在一件設計概念下的多個修正方案,英文是「modified forms」,如以下摘錄的段落,第二段提到設計專利申請案僅能有一項申請專利範圍,獨立且分別的設計應用不同申請案提出申請,因為不能被一項申請專利範圍所支持。

文末提到,然而,一個設計概念下經修改後的樣式(modified forms),或是一個設計概念下的多個實施例(embodiments),可以用一個申請案提出申請。列舉4個花瓶範例,這幾個花瓶之間僅最小配置差異(minimal configuration differences),例如瓶口有平的、有斜的、瓶蓋有圓的、有方的,這樣可以用一件設計申請案提出申請。


然而,提出申請之後,若審查過程提出的先前設計已經揭露(或相近)這幾個花瓶之間的相同設計概念,當限縮外觀特徵到其中一個差異時,將使得這幾個花瓶之間缺乏相同設計概念,因此除母案外,其餘可以分割申請案提出申請。

再找另外一例:D797323,說明書表明其中有多個在一個設計概念下的實施例。

重點:要表達出多個實施例之間的相同設計概念,就需要善用虛線或陰影表達出不主張設計部分。

第二範例:D980258

此範例是Apple Inc.的多狀態GUI設計(顯示Airpod音量),既然是多狀態,就會有不同狀態的圖式,說明書講明這些圖式為不同狀態與不同實施例。

Types of Designs and Modified Forms

An ornamental design may be embodied in an entire article or only a portion of an article, or may be ornamentation applied to an article. If a design is directed to just surface ornamentation, it must be shown applied to an article in the drawings, and the article must be shown in broken lines, as it forms no part of the claimed design.

A design patent application may only have a single claim (37 CFR § 1.153). Designs that are independent and distinct must be filed in separate applications since they cannot be supported by a single claim. Designs are independent if there is no apparent relationship between two or more articles. For example, a pair of eyeglasses and a door handle are independent articles and must be claimed in separate applications. Designs are considered distinct if they have different shapes and appearances even though they are related articles. For example, two vases having different surface ornamentation creating distinct appearances must be claimed in separate applications. However, modified forms, or embodiments of a single design concept may be filed in one application. For example, vases with only minimal configuration differences may be considered a single design concept and both embodiments may be included in a single application.

本案例確認「一般觀察者測試」:
在一般觀察者(較佳為"
熟悉相關先前技術的人")查看系爭專利與被告侵權產品時,係以整體設計來判斷是否會被混淆(欺騙),但在判斷之前,卻要先釐清何謂"功能性元件",觀地排除功能性元件,才針對其中視覺上的差異比對。觀念:設計要有意識地將非功能元件置入設計中,才能稱為設計,才能算是創作。

引用上述案例Richardson案中專利範圍解釋時整體上並沒有排除功能元件,反而包括了這些元件中的裝飾元素,該案外觀設計中:榔頭的外觀就是因為其功能目的、夾東西的鉗口、圓頸...等)形成其整體外觀的一部分,因此不認為應該因為設計中的功能性元素而排除其相關的結構外觀(structural aspect),因為這些功能性元素已經透過專利範圍解釋為「裝飾性設計(ornamental design)」。

關於「真實欺騙(actual deception)」判斷,設計專利的侵權判斷時,有個要件就是普通消費者視覺上是否造成混淆或欺騙為購買某物時以為是另一有設計專利的產品,如果是,侵權成立。

對於設計侵權判斷,採用兩部分測試:(1)解釋設計的保護範圍;(2)比對設計的保護範圍與被告產品設計,其中採用一般觀察者(ordinary observer)測試,也就是,以一般觀察者來看系爭設計與被告產品是否實質相同(substantially the same)?如果一般觀察者購買被告產品時,會以為是買了另一個,兩者為"實質相同"。

CAFC採用「一般觀察者/普通觀察者」測試法,比對設計與被告侵權物,兩者很像,共用了許多特徵,但仍須考量設計中的「功能性元素」以及相關先前設計的特徵,當將這些特徵提醒一般觀察者注意,就得出被告侵權產品與系爭設計之間的明顯差別,使得法院最後判定系爭設計與被告侵權物並非「實質相同」。

關於外觀商標(trade dress): 要證明trade dress侵權,要證明三件事:(1)系爭設計與被告物之間有混淆的相似性;(2)外觀商標的主特徵為非功能特徵;(3)外觀商標具有第二含意(second meaning/secondary meaning),也就是系爭設計讓大眾建立了一種識別性。

裝置專利就是看結構差異 - Hewlett-Packard Co. v. Bausch & Lomb Inc. (Fed. Cir. 1990)

本篇討論1990年HP與Bausch案例,這是基於前一篇MPEP2114的筆記所引用的案例,可參考: MPEP 2114 - 裝置發明僅使用習知裝置固有功能的顯而易見性(https://enpan.blogspot.com/2023/09/mpep-2114.html)。

系爭專利:US4,384,298 (LaBarre)(訴訟中無效系爭專利的前案Re 31,684 (Yeiser),這是被告的專利)
判決日期:July 30, 1990

本案緣此HP於1986年對Bausch & Lomb提出直接侵權(direct infringement)與誘使侵權(active inducement of infringement)告訴,結果,系爭專利判定有效且B&L侵權成立,但地方法院判定B&L非主動誘使侵權,於是雙方都對判決上訴。

本案討論的議題,除系爭專利US4,384,298 (LaBarre)的顯而易知性之外,其實也關於被告提出的證據,為被告B&L自己的專利權- Re31,684 (Yeiser)。

兩件專利都是關於印刷用的大型二維繪圖機的機構,判決文中提到繪圖機有兩種形式,第一是繪圖紙不動,由機構帶動筆移動繪圖;第二種是紙在Y方向移動(捲動),筆就在X方向移動繪圖。上述兩個專利是第二種。

US4,384,298 (LaBarre)

Re31,684 (Yeiser)

系爭專利'298(LaBarre)的claim 1如下:

1. An X-Y plotter system for forming images on a web comprising:

first means being coupled to at least one edge of said web for imparting motion thereto to provide a first degree of motion during plotting onto said web in response to a first applied signal;

second means for forming selected visual images on said web and being movable to provide a second degree of motion in response to a second applied signal; and

third means responsive to a third applied signal for imparting motion to said second means;

said first means including first drive means having at least one powered drive wheel contacting the web, and an idle wheel opposite to each of said drive wheels to form a pinch roller assembly with the web between the drive and idler wheels, one of said at least one drive and idler wheels having a rough surface, and said drive and idler wheels additionally being spring biased together to cause the rough surface to make a series of indentations along the driven edge of the web to minimize slippage with these indentations  repeatedly mating with the rough surface of the drive wheel as the web is driven back and forth, wherein the rough surface on one of said at least one powered drive and idler wheels of the first drive means has a random pattern, size, and height of rough spots.
案件在USPTO審查時,審查委員已知有前案Yeiser存在,經過面詢討論,後來修正claim 1加上「wherein the rough surface on one of said at least one powered drive and idler wheels of the first drive means has a random pattern, size, and height of rough spots」特徵就獲准專利。

此段意思是,在第一驅動器的動力輪與惰輪上具有隨機圖案、大小與高度的粗糙點表面。

被告承認直接侵權,但提出自己的專利Yeiser(經過授權),認為系爭專利為顯而易知。其中理由是,B&L認為Yeiser教示滾輪上固有會建立紋路以符合滾輪本身的粗糙表面,就如系爭專利那樣。

"In particular, B L argued that the knurled wheel taught by Yeiser would inherently create indentations which would mate with the rough surface of the knurled wheel, as required by the claims of LaBarre."

但地院不同意,判決專利有效,直接侵權成立。

地院討論系爭專利顯而易知性時,找到三處與Yeiser不同的特徵,但是CAFC僅討論wherein the rough surface on one of said at least one powered drive and idler wheels of the first drive means has a random pattern, size, and height of rough spots」特徵(自然是因為這是或准專利的關鍵)。

關鍵就是在X-Y plotter的滾輪上有隨機圖樣、尺寸與高度的粗糙點是否能區隔先前技術?使其產生無法預期的功效?而使這樣的繪圖機具有非顯而易知性?

claim 1為裝置專利範圍,需要描述裝置是甚麼,而非裝置做甚麼?其中不需要在運作(功能性)上與先前技術區隔。

本案要釐清的就是,是否「滾輪上有隨機圖樣、尺寸與高度的粗糙點」與Yeiser的滾輪不同?是否相關領域一般技術人員會顯而易知地以滾輪上有隨機圖樣、尺寸與高度的粗糙點」的滾輪取代Yeiser的滾輪?

其中關鍵的意見是,並非如B&L主張認為系爭專利的特徵與先前技術沒有"operational difference",而是實際上是否Yeiser揭露了系爭專利的特徵,也就是討論的是結構上的差異。回應前篇MPEP 2114的第II節意思:引用CAFC案例"Hewlett-Packard Co. v. Bausch & Lomb Inc. (Fed. Cir. 1990)",如果"習知裝置"教示(teach)請求項裝置的所有結構特徵,請求項中主張的「裝置」使用方式(manner in which a claimed apparatus is intended to be employed)也無法與習知裝置區隔。

法院認為B&L並沒有證明為何相關領域技術人員要以滾輪上有隨機圖樣、尺寸與高度的粗糙點」的滾輪取代Yeiser的滾輪。

經客戶提起MPEP 2114中規定在「裝置專利範圍」中非結構特徵不會拿來與前案區隔,因此在裝置專利範圍中描述裝置的功能與要做的事是不會拿來評估專利性的。這是對的,然而,這仍是要看是否為先前裝置固有的功能

在此就做些筆記。

MPEP2114規範「裝置與物品專利範圍」中的功能性用語。

第I節描述"裝置申請專利範圍"中固有特徵與功能性限制,其中說明裝置專利範圍可以結構或功能來描述,引用案例「In re Schreiber」提到,如果審查委員認為功能性限制為"先前技術"固有特徵(inherent characteristic of the prior art)時,即建立新穎性或顯而易知性的表面證據prima case of anticipation or obviousness),而審查委員需要解釋「先前技術的結構固有地擁有所要求保護的裝置的功能性限制」。這時,責任就落在申請人,申請人要證明先前技術結構並沒有這些功能性特徵。

重點一:因此裝置專利範圍中涉及功能性的特徵是否有專利性的意義,是要比對先前技術來決定。

第II節規範「裝置專利範圍中沒有與先前技術區隔的操作方法」。

重點二:裝置專利範圍應界定裝置是什麼,而不是裝置做什麼。

引用CAFC案例"Hewlett-Packard Co. v. Bausch & Lomb Inc. (Fed. Cir. 1990)",如果"習知裝置"教示(teach)請求項裝置的所有結構特徵,請求項中主張的「裝置」使用方式(manner in which a claimed apparatus is intended to be employed)也無法與習知裝置區隔。

根據案例Ex parte Masham (Bd. Pat. App. & Inter. 1987),其中claim 1前言部分描述裝置"用於混合流動顯影材料",而其主體描述混合物(means for mixing),此混合物靜置浸於顯影材料中。此發明被駁回理由是先前技術已經揭露結構特徵,而混合物僅部分浸於顯影材料,但其預期使用就是混合流動顯影劑。訴願委員認為是否部分或全部浸於顯影劑中對結構特徵比對而言並不影響。


第III節中,說明習知裝置可執行專利裝置所有的功能但不見得能預期(anticipate)到此裝置。

重點三:即便習知裝置執行了所有請求項描述的功能,如果仍有結構差異,習知裝置並未能預期此請求項發明。(此重點為平衡上述重點,說明裝置發明還是以結構特徵為主。

其中特別說明的是,功能手段用語的結構等同說明書對應的結構,引用CAFC案例In re Donaldson (Fed. Cir. 1994)。參考In re Robertson (Fed. Cir. 1999),此案例中,發明為具有三個固定元件的尿布,習知技術則包括有兩個固定元件,但執行了相同的功能。法院解釋專利範圍,認為其要求三個分開的固定元件,判定先前技術並未"固有地或是明白地"揭露分離的三個固定元件。

第IV節中,判斷是否電腦實現的功能性專利特徵相對先前技術為符合102, 103發明。

功能性專利範圍因為並不限定在特定結構而可能涵蓋所有可以執行所述功能的裝置,因此,如果先前技術揭露了可以固有地執行請求項功能的裝置,裝置可能就不符102, 103專利要件。

關於電腦實現的發明,參考CAFC案例Intel Corp. v. U.S. Int'l Trade Comm’n (Fed. Cir. 1991),法院判定"programmable"的請求項用語涵蓋範圍為要執行請求項記載之功能的產品上。其中重要的是,若其中新開發的功能或特性為先前技術固有的,並不能與先前技術區隔。

反之,電腦實現的功能請求項可以通過限制能夠執行該功能的結構來限定裝置的功能。參考前例Nazomi Communications, Inc. v. Nokia Corp. (Fed Cir. 2014),申請專利範圍為可執行處理暫存器為底與疊層為底的指令的CPU,原告主張專利範圍涵蓋能執行請求項描述的功能的硬體,但法院判定系爭專利範圍是軟硬體的組合以能執行其中功能,但被告硬體就不被專利範圍所涵蓋,理由是被告硬體無法致動軟體功能。

重點四:可參考「軟硬體結合產生的功能專利主張權利失利(Nazomi Comms. v. Nokia Corp.)(https://enpan.blogspot.com/2014/03/cafcnazomi-comms-v-nokia-corp.html)」,本篇的結論是:因為功能描述限縮了專利範圍所稱的硬體特徵,CAFC判斷侵權不成立

重點五:電腦實現的功能專利範圍仍可以很廣的,因為所謂電腦可以各種具有不同複雜度與算力的裝置("Computer-implemented functional claim limitations may also be broad because the term “computer” is commonly understood by one of ordinary skill in the art to describe a variety of devices with varying degrees of complexity and capabilities.",參考案例In re Paulsen (Fed. Cir. 1994))。

因此,申請專利範圍包括了"computer",並不會限定在有特定特徵的裝置,除非改寫成其他用語而清楚定義為其他特別的意思。

重點六:基於KSR判例(KSR Int’l Co. v. Teleflex Inc. (2007)),在電腦上實現已知功能,如果其中為在一般目的電腦上自動完成已知功能,而沒有超過習知技術可預期的運用,為顯而易知

可參考KSR v. Teleflex案簡單描述(https://enpan.blogspot.com/2009/02/ksr-v-teleflex.html),此案例結論是:結合多種習知技術的「組合發明」落於「沒有產生超出預期的結果」、「一般技術人員能實踐可預期的變化」或是「欲解決已知問題」,不能獲得專利

相似地,電腦實現的技術常常面對的情況是,所執行的步驟都是已知的步驟,而僅是轉移到電腦執行,或合併網路瀏覽器技術執行通訊與顯示資訊,因為這些是常見技術,將判定為顯而易知,不容易或准專利。

2114 Apparatus and Article Claims — Functional Language 

For a discussion of case law which provides guidance in interpreting the functional portion of means-plus-function limitations see MPEP § 2181 - § 2186.

I. INHERENCY AND FUNCTIONAL LIMITATIONS IN APPARATUS CLAIMS

Features of an apparatus may be recited either structurally or functionally. In re Schreiber, 128 F.3d 1473, 1478, 44 USPQ2d 1429, 1432 (Fed. Cir. 1997). See also MPEP § 2173.05(g). If an examiner concludes that a functional limitation is an inherent characteristic of the prior art, then to establish a prima case of anticipation or obviousness, the examiner should explain that the prior art structure inherently possesses the functionally defined limitations of the claimed apparatus. In re Schreiber, 128 F.3d at 1478, 44 USPQ2d at 1432. See also Bettcher Industries, Inc. v. Bunzl USA, Inc., 661 F.3d 629, 639-40,100 USPQ2d 1433, 1440 (Fed. Cir. 2011). The burden then shifts to applicant to establish that the prior art does not possess the characteristic relied on. In re Schreiber, 128 F.3d at 1478, 44 USPQ2d at 1432; In re Swinehart, 439 F.2d 210, 213, 169 USPQ 226, 228 (CCPA 1971) (“where the Patent Office has reason to believe that a functional limitation asserted to be critical for establishing novelty in the claimed subject matter may, in fact, be an inherent characteristic of the prior art, it possesses the authority to require the applicant to prove that the subject matter shown to be in the prior art does not possess the characteristic relied on”).

II. MANNER OF OPERATING THE DEVICE DOES NOT DIFFERENTIATE APPARATUS CLAIM FROM THE PRIOR ART

“[A]pparatus claims cover what a device is, not what a device does.” Hewlett-Packard Co.v.Bausch & Lomb Inc., 909 F.2d 1464, 1469, 15 USPQ2d 1525, 1528 (Fed. Cir. 1990) (emphasis in original). A claim containing a “recitation with respect to the manner in which a claimed apparatus is intended to be employed does not differentiate the claimed apparatus from a prior art apparatus” if the prior art apparatus teaches all the structural limitations of the claim. Ex parte Masham, 2 USPQ2d 1647 (Bd. Pat. App. & Inter. 1987) (The preamble of claim 1 recited that the apparatus was “for mixing flowing developer material” and the body of the claim recited “means for mixing ..., said mixing means being stationary and completely submerged in the developer material.” The claim was rejected over a reference which taught all the structural limitations of the claim for the intended use of mixing flowing developer. However, the mixer was only partially submerged in the developer material. The Board held that the amount of submersion is immaterial to the structure of the mixer and thus the claim was properly rejected.).

III. A PRIOR ART DEVICE CAN PERFORM ALL THE FUNCTIONS OF THE APPARATUS CLAIM AND STILL NOT ANTICIPATE THE CLAIM

Even if the prior art device performs all the functions recited in the claim, the prior art cannot anticipate the claim if there is any structural difference. It should be noted, however, that means-plus-function limitations are met by structures which are equivalent to the corresponding structures recited in the specification. In re Donaldson, 16 F.3d 1189, 1193, 29 USPQ2d 1845, 1848 (Fed. Cir. 1994). See also In re Robertson, 169 F.3d 743, 745, 49 USPQ2d 1949, 1951 (Fed. Cir. 1999) (The claims were drawn to a disposable diaper having three fastening elements. The reference disclosed two fastening elements that could perform the same function as the three fastening elements in the claims. The court construed the claims to require three separate elements and held that the reference did not disclose a separate third fastening element, either expressly or inherently.).

IV. DETERMINING WHETHER A COMPUTER-IMPLEMENTED FUNCTIONAL CLAIM LIMITATION IS PATENTABLE OVER THE PRIOR ART UNDER 35 U.S.C. 102 AND 103

Functional claim language that is not limited to a specific structure covers all devices that are capable of performing the recited function. Therefore, if the prior art discloses a device that can inherently perform the claimed function, a rejection under 35 U.S.C. 102 and/or 35 U.S.C. 103 may be appropriate. See In re Translogic Technology, Inc., 504 F.3d 1249, 1258, 84 USPQ2d 1929, 1935-1936 (Fed. Cir. 2007) (The claims were drawn to multiplexer circuit. The patent at issue claimed “coupled to” and “coupled to receive” between various portions of the circuitry. In reference to the claim phrase “input terminals ‘coupled to receive’ first and second input variables,” the court held that “the claimed circuit does not require any specific input or connection … [a]s such, ‘coupled to’ and ‘coupled to receive’ are clearly different … [a]s shown in [the figures of the] patent, input terminals … only need to be ‘capable of receiving’ an input variable for the multiplexer circuit as claimed”. Therefore, the specification supported the claim construction “that ‘coupled to receive’ means ‘capable of receiving.’”); Intel Corp. v. U.S. Int'l Trade Comm’n, 946 F.2d 821, 832, 20 USPQ2d 1161, 1171 (Fed. Cir. 1991) (The court held that “programmable” claim language required only that the accused product could be programmed to perform the claimed functionality.);In re Schreiber, 128 F.3d 1473, 1478, 44 USPQ2d 1429, 1432 (Fed. Cir. 1997); In re Best, 562 F.2d 1252, 1254, 195 USPQ 430, 433 (CCPA 1977); In re Ludtke, 441 F.2d 660, 663-64, 169 USPQ 563, 566-67 (CCPA 1971); In re Swinehart, 439 F.2d 210, 212-13, 169 USPQ 226, 228-29 (CCPA 1971) (“[I]t is elementary that the mere recitation of a newly discovered function or property, inherently possessed by things in the prior art, does not cause a claim drawn to those things to distinguish over the prior art”). See MPEP § 2112 for more information.

Conversely, computer-implemented functional claim limitations may narrow the functionality of the device, by limiting the specific structure capable of performing the recited function. Nazomi Communications, Inc. v. Nokia Corp., 739 F.3d 1339, 1345, 109 USPQ2d 1258, 1262 (Fed Cir. 2014) (The claims were drawn to a CPU that can perform processing of both register-based and stack-based instructions. Appellant alleged infringement of the claims based on claim construction requiring only hardware capable of performing the claimed functionalities. Contrasted with the finding of Intel Corp. v. U.S. Int'l Trade Comm’n, 846 F.2d 821, 832, 20 USPQ2d 1161, 1171 (Fed. Cir. 1991), the court found that “[s]ince hardware cannot meet these limitations in the absence of enabling software, the claims are properly construed as claiming an apparatus comprising a combination of hardware and software capable of practicing the claim limitations.”).

Computer-implemented functional claim limitations may also be broad because the term “computer” is commonly understood by one of ordinary skill in the art to describe a variety of devices with varying degrees of complexity and capabilities. In re Paulsen, 30 F.3d 1475, 1479-80, 31 USPQ2d 1671, 1674 (Fed. Cir. 1994). Therefore, a claim containing the term “computer” should not be construed as limited to a computer having a specific set of characteristics and capabilities, unless the term is modified by other claim terms or clearly defined in the specification to be different from its common meaning. Id. In Paulsen, the claims, directed to a portable computer, were rejected as anticipated under 35 U.S.C. 102 by a reference that disclosed a calculator, because the term “computer” was given the broadest reasonable interpretation consistent with the specification to include a calculator, and a calculator was considered to be a particular type of computer by those of ordinary skill in the art. Id.

When determining whether a computer-implemented functional claim would have been obvious, examiners should note that broadly claiming an automated means to replace a manual function to accomplish the same result does not distinguish over the prior art. See Leapfrog Enters., Inc. v. Fisher-Price, Inc., 485 F.3d 1157, 1161, 82 USPQ2d 1687, 1691 (Fed. Cir. 2007) (“Accommodating a prior art mechanical device that accomplishes [a desired] goal to modern electronics would have been reasonably obvious to one of ordinary skill in designing children’s learning devices. Applying modern electronics to older mechanical devices has been commonplace in recent years.”); In re Venner, 262 F.2d 91, 95, 120 USPQ 193, 194 (CCPA 1958); see also MPEP § 2144.04. Furthermore, implementing a known function on a computer has been deemed obvious to one of ordinary skill in the art if the automation of the known function on a general purpose computer is nothing more than the predictable use of prior art elements according to their established functions. KSR Int’l Co. v. Teleflex Inc., 550 U.S. 398, 417, 82 USPQ2d 1385, 1396 (2007); see also MPEP § 2143, Exemplary Rationales D and F. Likewise, it has been found to be obvious to adapt an existing process to incorporate Internet and Web browser technologies for communicating and displaying information because these technologies had become commonplace for those functions. Muniauction, Inc. v. Thomson Corp., 532 F.3d 1318, 1326-27, 87 USPQ2d 1350, 1357 (Fed. Cir. 2008).
