TIPO Patent Application Accelerated Examination Program

TIPO Patent Application Accelerated Examination Program (AEP, 發明專利加速審查) has been tried for one year.

AEP, actually similar with the prevailed PPH among some countries, is useful to the applicants who meet the commercial dispute, or infringement event regarding the pending application. Those applicants may submit a request for accelerating the examination to TIPO attached with the required documents or evidences if their foreign applications have been granted or the related examination opinions or search reports have been issued. The related documents are helpful to the TIPO examiner accelerating the examination.

Requirements for the TIPO AEP:

• reason 1: The application(s) corresponding to the pending TW application in one or more foreign countries has been granted.
• reason 2: The examination opinion or search report for the application(s) in USPTO/JPO/EPO corresponding to the pending TW application has been issued but not given decision.
• reason 3: commercial implementation.
