日本訴願程序、時機與成果筆記

日本專利局下有「專利審查部」與「訴願部（審判與訴願部，Trial and Appeal Department (TAD)）」，訴願部的使命是：解決專利審查爭端。

"The Trial and Appeal Department (TAD) at the JPO, which is responsible for the trial and appeal system in Japan, has a mission to endeavor to use industrial property rights effectively for developing Japanese industry under the trial and appeal system."

"The Trial and Appeal Department (TAD), one of the departments of the JPO, plays two major roles. One is a role as "Upper instance court for examination" to determine the validity of the examiner's decision of refusal. The other is a role of "Approaching an early resolution of intellectual property disputes" to contribute a review the validity of the rights and to resolve the disputes."

訴願的流程與適用範圍，從大架構看，訴願是專利商標審查決定的救濟程序，或是解決爭議（異議、舉發、撤銷、修正）的專利局部門。

執行訴願審查時，由3或5位行政法官（administrator judge）組成訴願委員會（panel）審理案件，並會舉辦口審（oral proceedings），情境示意圖：

提起訴願的時機與資格：
(1)當申請人不服審查結果（核駁審定），可提起訴願。
(2)當「任何人」對獲准的專利、商標有意見時，可向TAD提起異議程序（opposition）。
(3)任何人對獲准專利、設計與商標不服時，可向TAD提起舉發（invalidation）。
(4)任何人要撤銷商標權（rescission），可向TAD提起撤銷案。
(5)專利權人提起錯誤修正，可提起訴願。
(6)任何人需要JPO對於權利範圍的意見時，可向TAD請求advisory opinion。
