失去權利時間的終權聲明 - 37 CFR 1.137(d)

37 CFR 1.137規定如何將「拋棄的申請案」、「被終結的程序」或是「限制的再審程序」復權(revival),然而,既然案件曾經失去權利,那這段時間的權利怎麼算?

在37 CFR 1.137(d)規定中,任何「復權請願(petition to revive)」應附帶「終權聲明(terminal disclaimer)」以及費用,聲明將權利中止的這段時間的權利貢獻給公眾,其中特別的是,這是針對設計專利申請案(design),以及1995年6月8日以前申請的發明或植物專利申請案。

如此可知,如果在1995年6月8日後的發明與植物專利申請案就不受到此規定的限制,也如37 CFR 1.137(d)(3)規定,以上規定的「terminal disclaimer」就不適用在1995年6月8日當日或之後「要提出復權請願」的發明或植物專利申請案,也就是說,專利家族中有某件專利提出復權請願時,不用附帶「終權聲明」,也就不會影響此專利的其他家族專利。

所述「終權聲明(terminal disclaimer)」,根據37 CFR 1.321,專利權人可針對一件專利中的單一或全部專利範圍提出終權聲明,將未屆期專利期限貢獻給公眾。實務上,常見於同一申請人/發明人下的專利家族中專利權有衝突時,如專利之間存在非法定重複專利(Non-Statutory Double Patenting)(也就是兩件或多件專利之間存在的差異為顯而易見)的問題時,可以終權聲明克服。

其中界定出各種專利(申請案)拋棄的樣態,如未於期限內回應官方意見、申請人主動聲明放棄,以及各中細節。

這裡解釋了,為何1995年6月8日當日或之後的發明與植物申請案在復權請願中不用提出終權聲明?

理由是:當專利(申請案)復權後(復權請願應於申請人收到,「專利期限調整(patent term adjustment)」程序就會自動消除這部份時間。

"3. Utility and Plant Applications Filed on or After May 29, 2000
In utility and plant applications filed on or after May 29, 2000, a terminal disclaimer should not be required as a condition of granting an untimely petition to withdraw the holding of abandonment. This is because any patent term adjustment is automatically reduced under the provisions of 37 CFR 1.704(c)(4) in applications subject to the patent term adjustment provisions of the American Inventors Protection Act of 1999 (AIPA) if a petition to withdraw a holding of abandonment is not filed within two months from the mailing date of the notice of abandonment, and if applicant does not receive the notice of abandonment, any patent term adjustment is reduced under the provisions of 37 CFR 1.704(a) by a period equal to the period of time during which the applicant "failed to engage in reasonable efforts to conclude prosecution" (processing or examination) of the application."

  • (a) Revival on the basis of unintentional delay. If the delay in reply by applicant or patent owner was unintentional, a petition may be filed pursuant to this section to revive an abandoned application or a reexamination prosecution terminated under § 1.550(d) or § 1.957(b) or limited under § 1.957(c).
  • (b) Petition requirements. A grantable petition pursuant to this section must be accompanied by:
    • (1) The reply required to the outstanding Office action or notice, unless previously filed;
    • (2) The petition fee as set forth in § 1.17(m);
    • (3) Any terminal disclaimer (and fee as set forth in § 1.20(d) ) required pursuant to paragraph (d) of this section; and
    • (4) A statement that the entire delay in filing the required reply from the due date for the reply until the filing of a grantable petition pursuant to this section was unintentional. The Director may require additional information where there is a question whether the delay was unintentional.
  • (c) Reply. In an application abandoned under § 1.57(a), the reply must include a copy of the specification and any drawings of the previously filed application. In an application or patent abandoned for failure to pay the issue fee or any portion thereof, the required reply must include payment of the issue fee or any outstanding balance. In an application abandoned for failure to pay the publication fee, the required reply must include payment of the publication fee. In a nonprovisional application abandoned for failure to prosecute, the required reply may be met by the filing of a continuing application. In a nonprovisional utility or plant application filed on or after June 8, 1995, abandoned after the close of prosecution as defined in § 1.114(b), the required reply may also be met by the filing of a request for continued examination in compliance with § 1.114.
  • (d) Terminal disclaimer.
    • (1) Any petition to revive pursuant to this section in a design application must be accompanied by a terminal disclaimer and fee as set forth in § 1.321 dedicating to the public a terminal part of the term of any patent granted thereon equivalent to the period of abandonment of the application. Any petition to revive pursuant to this section in either a utility or plant application filed before June 8, 1995, must be accompanied by a terminal disclaimer and fee as set forth in § 1.321 dedicating to the public a terminal part of the term of any patent granted thereon equivalent to the lesser of:
      • (i) The period of abandonment of the application; or
      • (ii) The period extending beyond twenty years from the date on which the application for the patent was filed in the United States or, if the application contains a specific reference to an earlier filed application(s) under 35 U.S.C. 120, 121, 365(c), or 386(c) from the date on which the earliest such application was filed.
    • (2) Any terminal disclaimer pursuant to paragraph (d)(1) of this section must also apply to any patent granted on a continuing utility or plant application filed before June 8, 1995, or a continuing design application, that contains a specific reference under 35 U.S.C. 120, 121, 365(c), or 386(c) to the application for which revival is sought.
    • (3) The provisions of paragraph (d)(1) of this section do not apply to applications for which revival is sought solely for purposes of copendency with a utility or plant application filed on or after June 8, 1995, to reissue applications, or to reexamination proceedings.
  • (e) Request for reconsideration. Any request for reconsideration or review of a decision refusing to revive an abandoned application, or a terminated or limited reexamination prosecution, upon petition filed pursuant to this section, to be considered timely, must be filed within two months of the decision refusing to revive or within such time as set in the decision. Unless a decision indicates otherwise, this time period may be extended under:
    • (1) The provisions of § 1.136 for an abandoned application;
    • (2) The provisions of § 1.550(c) for a terminated ex parte reexamination prosecution, where the ex parte reexamination was filed under § 1.510; or
    • (3) The provisions of § 1.956 for a terminated inter partes reexamination prosecution or an inter partes reexamination limited as to further prosecution, where the inter partes reexamination was filed under § 1.913.
  • (f) Abandonment for failure to notify the Office of a foreign filing. A nonprovisional application abandoned pursuant to 35 U.S.C. 122(b)(2)(B)(iii) for failure to timely notify the Office of the filing of an application in a foreign country or under a multinational treaty that requires publication of applications eighteen months after filing, may be revived pursuant to this section. The reply requirement of paragraph (c) of this section is met by the notification of such filing in a foreign country or under a multinational treaty, but the filing of a petition under this section will not operate to stay any period for reply that may be running against the application.
  • (g) Provisional applications. A provisional application, abandoned for failure to timely respond to an Office requirement, may be revived pursuant to this section. Subject to the provisions of 35 U.S.C. 119(e)(3) and § 1.7(b), a provisional application will not be regarded as pending after twelve months from its filing date under any circumstances.

  • (a) A patentee owning the whole or any sectional interest in a patent may disclaim any complete claim or claims in a patent. In like manner any patentee may disclaim or dedicate to the public the entire term, or any terminal part of the term, of the patent granted. Such disclaimer is binding upon the grantee and its successors or assigns. A notice of the disclaimer is published in the Official Gazette and attached to the printed copies of the specification.   • (b) An applicant may disclaim or dedicate to the public the entire term, or any terminal part of the term, of a patent to be granted. Such terminal disclaimer is binding upon the grantee and its successors or assigns. The terminal disclaimer, to be recorded in the Patent and Trademark Office, must:
    • (1) Be signed by the applicant or an attorney or agent of record;
    • (2) Specify the portion of the term of the patent being disclaimed;
    • (3) State the present extent of applicant’s ownership interest in the patent to be granted; and
    • (4) Be accompanied by the fee set forth in § 1.20(d).
  • (c) A terminal disclaimer, when filed to obviate judicially created double patenting in a patent application or in a reexamination proceeding except as provided for in paragraph (d) of this section, must:
    • (1) Comply with the provisions of paragraphs (b)(2) through (b)(4) of this section;
    • (2) Be signed in accordance with paragraph (b)(1) of this section if filed in a patent application or in accordance with paragraph (a)(1) of this section if filed in a reexamination proceeding; and
    • (3) Include a provision that any patent granted on that application or any patent subject to the reexamination proceeding shall be enforceable only for and during such period that said patent is commonly owned with the application or patent which formed the basis for the judicially created double patenting.
  • (d) A terminal disclaimer, when filed in a patent application or in a reexamination proceeding to obviate double patenting based upon a patent or application that is not commonly owned but was disqualified as prior art as set forth in either § 1.104(c)(4)(ii) or (c)(5)(ii) as the result of activities undertaken within the scope of a joint research agreement, must:
    • (1) Comply with the provisions of paragraphs (b)(2) through (b)(4) of this section;
    • (2) Be signed in accordance with paragraph (b)(1) of this section if filed in a patent application or be signed in accordance with paragraph (a)(1) of this section if filed in a reexamination proceeding; and
    • (3) Include a provision waiving the right to separately enforce any patent granted on that application or any patent subject to the reexamination proceeding and the patent or any patent granted on the application which formed the basis for the double patenting, and that any patent granted on that application or any patent subject to the reexamination proceeding shall be enforceable only for and during such period that said patent and the patent, or any patent granted on the application, which formed the basis for the double patenting are not separately enforced.

After Final方案筆記

此篇"https://www.mbhb.com"文章標題「when final is not so final」實在是很傳神,常有人問,這件案子是否可以「AFCP」,還是「pre-Appeal」,或是等「Advisory Action」...,這實在是沒有一定「准」的方案,這些方案就是這個標題寫的,當「最後」不是那麼「最後」時,有點把握的話就可以試試看。

這裡隨著這篇文章"再次"筆記After Final方案。

方案一:pre-Appeal(前期訴願,MPEP 1204.02)

因為pre-appeal為appeal前期方案,無法修正專利範圍,因此僅能針對目前claim的情況下,需要有一定把握,討論議題適用在「引用法條錯誤、明顯沒有核駁基礎、專利範圍解釋錯誤、前案引用錯誤」等情況,這裡介紹一個成功案例:Amazon的Fintech專利筆記(https://enpan.blogspot.com/2017/06/amazonfintech.html)

此案專利US8682802獲准前曾經面對三次核駁(non-final, final, and non-final),接著提出pre-Appeal,主要是針對USPTO以專利不符103規定的核駁意見,不囉唆,就針對Claim 1中兩個步驟提出意見,如面對常見103核駁,審查意見先以第一引證案對比大部份技術元件,再以第二引證案補足第一引證案沒有教示的特徵,申請人(Amazon)引用引證案內容,證明引證案並未揭示系爭案專利範圍中的特徵。



在pre-appeal的策略是,在無法修正專利範圍的情況下,針對審查委員引用前案的錯誤理解提出答辯,先強調第一引證案並沒有「教示」或「建議」請求項特徵,即便引用了第二引證案,在此案中再證明了第二引證案並未「補足」第一引證案的缺乏(deficiency)。



pre-Appeal在短短5頁內需要萃取出答辯核心,針對獨立請求項與前案的比較,面對多件前案時,需要證明主要引證案無法教示或建議審查意見所對應的特徵,再證明次要引證案並未補足主要引證案的不足,甚至無法與主要引證案結合(沒有動機)。(編按,此案例是證明審查意見引用前案的錯誤,這也是通常103答辯,因此不論任何階段都可參考)

此案例直接在pre-appeal階段核准專利!

方案二:AFCP(終駁後快速審理方案(After Final Consideration Pilot 2.0))

進入AFCP的條件(這僅是客觀條件,但任何情況都可挑戰):
(1) 根據終駁意見而刪除或符合形式規定的請求項修正。
(2) 修正被異議(objected to)請求項為獨立請求項。
(3) 如果有僅需加入一些限制而可以被認定獲准時的請求項,且這些修正僅需要有限的審查與檢索。
(4) 沒有刪除被終駁的專利範圍,僅多了一些有限的限制條件而僅需要有限的審查與檢索。
(5) 加入新的限制而僅須一些審查與檢索的工作。
(6) 回應終駁意見,並有符合條件的宣示而僅需要有限的審查與檢索工作。

這裡截圖一件Final OA提出多處Claim缺點的意見(claim objections)後,雖然可以直接提出修正,但似乎沒有把握,之後申請人通過AFCP修正專利範圍後獲准專利。

方案三:Post-Prosecution Pilot (“P3”) program(已經終止)

從本篇引用"https://www.mbhb.com"文章得知這個P3方案,P3自2016年7月開始施行,是一種結合pre-appeal與AFCP兩者優點的方案,也是一種降低RCE案件數量的快捷方案,不過,這僅小規模試行,目前也就沒有了。

P3的特點:
沒有規費,申請人之前對相同申請案不能提過pre-appeal或AFCP,須在Final OA後、notice of appeal前提出P3,申請人要同意參與P3會議與審查委員會開會,並進行20分鐘內的討論,答辯意見也不能超過5頁,可提出不放大專利範圍的修正。

之後P3委員會發出決定,會有3種結果:

(1)同意Final OA決定(final rejection upheld)。
(2)專利核准(allowable application)。

(3)重啟審查程序(reopen prosecution)。

聊天機器人訴訟討論 - 智臻智能 v. Siri

原告智臻智能網路科技公司提出侵權訴訟的根據是因為蘋果曾經提到Siri的相關專利是12/987,982 (US8660849)。

本案原告曾於2012年向蘋果提出侵權告訴,蘋果主張專利無效,結果北京高院於2015年判定原告系爭專利無效,並撤銷訴訟,不過,案件經原告上訴北京最高法院,結果判決專利有效,使得原告再次提出侵權訴訟。

系爭專利專利範圍如下,主要專利範圍界定一「聊天機器人系統」,主要元件有「用戶」與「聊天機器人」,聊天機器人具有由「人工智能服務器」提供的「人工智能與信息服務功能」,還有通訊模組,讓用戶通過通訊平台或短信平台與聊天機器人對話,聊天機器人具有「查詢服務器」、「資料庫」以及「遊戲服務器」,還有一個「過濾器」,用以區分用戶語句是否為「格式化語句」或「自然語言」,轉發給對應的服務器。

2015年「北京高院终审宣判“一种聊天机器人系统”专利纠纷案」(http://www.bjcourt.gov.cn/article/newsDetail.htm?NId=55000332&channel=100001001&type=s),其中蘋果提出無效理由:

「專利說明書公開不充分、權利要求不清楚、權利要求1、9缺少實現擬人化這一技術問題的必要技術特徵、權利要求得不到說明書的支持,權利要求1-11相對於附件1及公知常識的結合不符合專利法相關條款所規定的新穎性、創造性等。」

從判決可知,「在專利授權階段的審查中,智臻公司也認為遊戲功能是使涉案專利具備創造性的技術特徵」,法院判決專利無效理由也是針對這個「遊戲功能」,認為:「說明書僅僅記載了具有一個遊戲服務器以及提到實現互動遊戲的設想,而對於遊戲服務器與聊天機器人的其他部件如何連接,例如,對什麼樣的用戶輸入的什麼內容傳送到遊戲服務器以及如何將用戶的指令傳送到遊戲服務器中,完全沒有記載。」還進一步認為,系爭專利在處理用戶語句時,並不會將語句傳送到「遊戲服務器」,且專利權利要求1沒有清楚限定將何種語句轉發至遊戲服務器。

如此,北京高院認為,專利說明書關於如何實現遊戲功能未充分公開,另一方面,說明書中僅僅是在形式上記載了遊戲服務器,並未進一步說明遊戲服務器的組成部分和工作原理,以上種種理由致使法院判決專利無效。

已知的是,後來經上訴後,專利又有效了!

系爭專利技術關鍵在於可以根據用戶的語句提供對應的「人工智能服務器」、「查詢服務器」以及「遊戲服務器」,倒不是僅是AI的技術,或說AI的技術為「慣用」、「常規」技術,這點也是Siri的基礎,但系爭專利範圍著重的是「系統架構」,就看Siri是否使用了相應的系統架構。

我的不負責任比對如下,由於系爭專利相對簡化,文字比對確實容易讀到任何更複雜的產品,因此,系爭專利的專利性相對應該受到質疑,對於侵權判決來說,可能是較有優勢的!

并且该聊天机器人设置有一个过滤器,以用来区分所述通讯模块接收到的用户语句是否为格式化语句或自然语言,
專利有提到filter,但是是用來過濾用戶說的內容,不像是用來區分用戶語句為格式化語句或自然語言。
Siri主要訴求是處理自然語言,提出的技術都是處理自然語言。
但是,Siri中是否有系爭專利定義的「格式化語句」,其實「hi, Siri」啟動句就是了!

系爭專利有關「格式化語句」是指「格式化命令」,也就是系統設定好的固定語句,根據說明書記載:「如果是格式化命令语句,即送到查询模块24处理,如果是一个自然语句,则 送到对话模块23处理」
并根据区分结果将该用户语句转发至相应的服务器,该相应的服务器包括人工智能服务器、查询服务器或游戏服务器。
Siri可以與用戶互動,專利沒有明講這幾個服務器,但就功能而言,應該有。

my two cents:
關於之後侵權訴訟之戰,若以十分對詳細的蘋果專利來解構Siri,確實可以輕易得出被系爭專利所涵蓋到的內容,因此,蘋果最初以專利無效作為訴訟主軸是對的,只是案件被翻盤,使得蘋果可能會面對較嚴苛的挑戰。

询模块连接的是查询服务器。
4、如权利要求1所述的聊天机器人系统,其特征在于,所述的人工智
能服务器对应的数据库为对话数据库,该数据库的数据来源有三部
分组成:人工添加部分、对话过程中用户教话添加部分和网络学习
添加部分。
5、如权利要求4所述的聊天机器人系统,其特征在于,所述的对话数
据库的数据来源中,采用了一种自我学习的方式,该数据库不仅可
以通过聊天机器人与用户对话的过程进行自我学习,还可以通过英
特网网络学习的方式,不断扩充自己的数据库信息。
6、如权利要求1所述的聊天机器人系统,其特征在于,所述的查询服
务器对应的数据库为信息数据库,该数据库的数据来源有三部分组
成:自建信息库部分、与专业内容服务商合作部分和网络精确搜索
部分。
7、如权利要求6所述的聊天机器人系统,其特征在于,所述的信息数
据库的数据来源中,采用了一种精确搜索功能,可以快速、精确地搜
索到用户所需要的信息。
8、如权利要求1所述的聊天机器人系统,其特征在于,所述的数据库
还包括有一个用户数据库,该数据库中记录了用户基本资料、访问
记录、自定义菜单、用户定制信息,并可以随时添加新的用户数据
资料。
9、一种使用如权利要求1至8中任一项所述的聊天机器人系统与机器人
聊天的方法,其特征在于,包括如下步骤:用户找到联机的聊天机
器人,并通过即时通讯平台发送对话语句,即时通讯平台将该对话

块发送给用户。
10、如权利要求9所述的方法,其特征在于,过滤器传送对话信息至查
询服务器时,查询服务器对信息数据库访问有一个优先权级别顺序:
查询服务器首先对信息数据库的自建信息库部分进行搜索,如果没

可口可樂放棄「ZERO」商標專用,但仍留下伏筆 - Royal Crown Co. v. Coca-Cola (Fed. Cir. 2020)

本篇討論Royal Crown Co. v. Coca-Cola (Fed. Cir. 2020)商標「ZERO」的爭議訴訟,本案為延續2018年一場CAFC訴訟(飲料界的ZERO商標爭議 - Royal Crown v. Coca Cola (Fed. Cir. 2018))案件發回TTAB重審的決定,當年,CAFC並未做出決議,而是要求TTAB以更高的標準來判斷「ZERO」是否對Coca-Cola具有識別性且可專用。

CAFC認為,對於通用字,如ZERO,是否具有識別性,應該要有更高水平的證據。

終究一句話,TTAB在做此決定時,並沒有先定義品牌識別性的判斷水平為何?使得CAFC要作這個識別性是否足夠的判斷時,沒有足夠的證據,因此發回TTAB重審,並需要對通用性(genericness)定義一個適當的法律標準:如果不是通用,在判斷其識別性(distinctiveness)前,應該要考量這個標誌是否高度敘述性。

本案緣起Coca-Cola提出16件針對「ZERO」飲料的商標申請,Royal提出異議(opposition),主張這些標誌為通用(generic)或是僅是「敘述(merely descriptive)」零卡路里的飲料特徵,要求撤銷商標申請案。



前情提要:
回到前一輪爭議,2016年TTAB作出偏向Coca-Cola的決定,撤回Royal提出的異議主張,因為缺乏證明「ZERO」對於「零卡路里(zero-calorie)」產品(soft drinks, sports drinks, energy drinks)為通用(generic),反而Coca-Cola證明「ZERO」一詞對相關飲料具有識別性(distinctiveness),不過,僅及於soft drinks與sport drinks(軟性飲料與運動飲料),但並不及於energy drinks(能量飲料)。於是,TTAB作出Coca-Cola獲准「ZERO」為其註冊商標,且無須宣告「不專用」ZERO。

之後,Royal上訴CAFC,CAFC於2018年作出撤回TTAB決定,因為對於「ZERO」的通用性(genericness),TTAB採用錯誤的法律標準,並且也沒有論述其識別性(distinctiveness)就認為「ZERO」具有識別性。

發回TTAB重審:
案件回到TTAB,Coca-Cola提出修正申請案請求 - 同意放棄專用「ZERO」(disclaim the term ZERO)。這時,Royal反倒是抗議這個「不專用」請求程序不當,且非可終結案件的關鍵(case-dispositive)。但TTAB仍同意Coca-Cola的請求。

Royal上訴CAFC。

CAFC階段:
Royal提出上訴議題包括:(1)TTAB程序不當,且TTAB濫用自由裁量權;(2)認為TTAB簡單同意Coca-Cola的不專用聲明就作出決定;(3)否決Coca-Cola的不專用聲明,理由是,Cocal-Cola僅針對本案作出聲明,卻可能另外再以「ZERO」提出新的商標申請案,甚至在將來訴訟中提出其涵蓋「ZERO」的範圍。(編按,Royal擔心Coca-Cola的聲明僅為了終結本次爭議,卻沒有杜絕日後的爭議)

Coca-Cola主張相關上訴議題應該終止,因為其「不專用ZERO」的聲明已經回應Royal請求的救濟程序,對於TTAB而言,Royal最初的異議是要求Coca-Cola申請商標時要聲明不專用「ZERO」,而不是對註冊程序提出異議,因此CAFC同意TTAB同意Coca-Cola修正其申請案的決定。

也就是說,Coca-Cola適當地回應了Royal在其異議提出的要求,使得Coca-Cola提出disclaimer of the term ZERO(不專用ZERO)的修正即使得法院撤銷上訴。(上訴議題僅針對提出救濟的議題)

其實CAFC雖僅針對Royal救濟議題進行審理,但因為TTAB的意見仍是認為ZERO為通用以及對相關產品僅敘述性(merely descriptive),這已經對Royal很有幫助了!



my two cents:
雖然如文中顯示,Coca-Cola僅針對本次異議提出「disclaimer of the term ZERO」,而沒有要求撤銷相關商標申請,甚至也沒有杜絕Coca-Cola日後再次提出ZERO相關商標註冊的可能,但其中主要還是反映出訴訟策略,過度簡化訴訟議題可能會導致對手有迴避訴訟的可能。這可能歸咎於原告/異議者與其律師的訴訟/異議策略不當,完全沒有讓Coca-Cola承認ZERO的通用性以及僅是對零卡路里的敘述而已。

(1)概念階段,從想法、概念到實現。
(2)專利申請階段,撰寫專利說明書(或臨時案),到完成申請。
(3)審查階段,提交申請專利後,進入專利局審查程序,包括公開、審查、修正、答辯直到終駁、放棄或獲准專利(領證)。
(4)救濟階段,這是PTAB階段,包括訴願、再審、再領證、專利後異議程序(IPR、PGR)、行政訴訟、侵權訴訟,直到專利到期,進入公眾領域(public domain)。

設計專利的侵權實例 - 戴姆勒(賓士) v. 帝寶

修車時,如果是換車燈,沒有特別需求的話,應該是要找與原本一樣的車燈,連同內部鎖孔、固接的方式都要一樣,要不然可能還嵌不進去,一旦選擇的是「副廠」車燈,外觀與內部結構,可能也都可能會與原廠一樣,這時...如果遭遇了原廠「設計專利」,就麻煩了,這大概是副廠產品廠商的宿命!(常識來說,應該不會有副廠故意做不一樣的,除非是需要更酷炫、有其他厲害的功能的改裝,不然,特別是高級車,一般車主應該還是要找"一樣"的吧!)

這裡討論一個媒體關注度很高的案例,甚至是個指標性的案例,似乎需要動用到國家力量才可能協助的產業!

法院表示,設計專利的侵權與否應該要以容易引起普通消費者注意的部位或特徵為重點,而不是被告自己主張要比對的部份,也不是像被告以局部放大的方式來凸顯的特徵,這些並不能作為比對區別基礎。

關於系爭設計是否可「據以實施」,這點法院也給了明確的判斷,根據專利法施行細則對於設計圖說的規定,僅止於應由立體圖及六面視圖、二個以上立體圖、平面圖及單元圖呈現,至於其中六面視圖應如何繪製,並沒有進一步規定。解釋上,應回歸專利法本身的規定,也就是使該新式樣所屬技藝領域中具有通常知識者,能瞭解其內容,並可據以實施即可。也就是說,不容易證明「設計」無法據以實施。

關於系爭設計是否具有「創作性」,這點是根據「視覺上」比對前案而決定,如下圖,綜觀被證3 、4 、5 、6 的設計外觀,與系爭專利其實在視覺感受上都有明顯的不同。這從以下本判決比較圖(五)就可以很容易地看得出來。其中特別是系爭專利在立體圖上所呈現「葉片形罩體」與「佈設具條紋之反射罩」特徵,都沒有在被證3 、4 、5 、6 的先前設計當中有所揭示,也沒有任何蛛絲馬跡或發想上的線索可以認為將被證3 、4 、5 、6 進行簡單的改變或修飾,就可以得到「葉片形罩體」與「佈設具條紋之反射罩」特徵。


法院判決「原告行使權利並沒有違反公平交易法」,理由主要為:

(1)原告不具有獨占地位。法院先解釋「公平交易法上所稱的獨占」,是指事業在相關市場處於無競爭狀態,或具有壓倒性地位,可排除競爭的能力。相關市場的界定,最主要是從需求者的觀點判斷替代性之有無及其程度。主要理由是,賓士車屬於高價車種,市佔率也非很高,消費者也有別的選擇,被告也可以有別的製造選擇,法院因此認為原告並不具有獨占地位,也就不可能有違反公平交易法第9 條第1 款或第4 款所列的獨占事業違法行為。

(2)原告沒有限制競爭疑慮的行為。被告將原告拒絕授權為抗辯理由,但法院認為,在一個完全競爭的相關市場中,專利授權與否,本是私法自治、契約自由的範圍,法院並沒有必要介入,難以認定有限制競爭的疑慮。

(3)原告沒有足以影響交易秩序的顯失公平行為。法院認為,被告所舉汽車製造商對德國立法者所為的承諾,只有政治性質,並沒有任何法律效力,無法構成被告抗辯原告違反禁反言原則的法律基礎,也無法憑以將該項承諾比照FRAND 承諾,或認為與德國立法者構成利益第三人契約,再據以認為原告有足以影響交易秩序的顯失公平行為。

(4)原告沒有權利濫用也沒有違反誠信原則。法院認為,被告引用的證據所指承諾屬於政治性質,不能用來判斷是否有違反誠信原則。

(5)本案賠償金額應酌定為3,000萬元。判斷依據如下:


1.系爭產品銷售總額為23,162,107元
2.本案無從認列被告的銷售成本
3.系爭專利的利潤貢獻度應為100%,雖被告主張系爭專利對於系爭產品的銷售利潤貢獻度應該只有33%,但被告並未舉證,使得法院認為系爭專利對於系爭產品銷售利潤的貢獻度應為100%。
4.本案賠償額應酌定為3,000萬元。(其中判斷頗為有趣,涉及是否蓄意侵權,可參考判決原文)

(6)原告的損害賠償請求權沒有罹於時效。

本案判決:本院審理後,於108 年6 月21日全案辯論終結,並於108年8月16日宣判。判決結果認定被告侵權責任成立,被告應連帶給付原告新臺幣3,000 萬元、被告帝寶公司不得直接或間接、自行或委託他人製造、為販賣之要約、使用或為上述目的而進口侵害系爭專利之產品及被告帝寶公司應銷毀相關侵權產品及必要處置,並駁回原告刊登道歉啟事之請求。
